Promotion for Active-duty Officers

1. Active-duty officers are promoted when they meet the following conditions:

a) Meet the standards stipulated in Article 12 of this Law;

b) Their current rank is lower than the highest rank prescribed for the position or title they are holding;

c) Meet the promotion consideration term stipulated in Clause 2 of this Article.

2. The term for promotion consideration for active-duty officers is stipulated as follows:

Second Lieutenant to First Lieutenant: 2 years;

First Lieutenant to Senior Lieutenant: 3 years;

Senior Lieutenant to Captain: 3 years;

Captain to Major: 4 years;

Major to Lieutenant Colonel: 4 years;

Lieutenant Colonel to Senior Lieutenant Colonel: 4 years;

Senior Lieutenant Colonel to Colonel: 4 years;

Colonel to Major General, Rear Admiral of the Navy: minimum 4 years;

Major General, Rear Admiral of the Navy to Lieutenant General, Vice Admiral of the Navy: minimum 4 years;

Lieutenant General, Vice Admiral of the Navy to Colonel General, Admiral of the Navy: minimum 4 years;

Colonel General, Admiral of the Navy to General: minimum 4 years;

The time officers spend studying at school is counted towards the promotion consideration term.

3. The age of active-duty officers considering promotion from the rank of Colonel to Major General, Rear Admiral of the Navy should not exceed 57 unless otherwise required by decision of the President.

4. Active-duty officers with exceptional achievements may be considered for accelerated promotion but not exceeding the highest rank prescribed for the position or title they hold.

The promotion consideration term for active-duty officers of the People's Army at the Colonel level is stipulated as follows:

- Major to Lieutenant Colonel: 4 years;

- Lieutenant Colonel to Senior Lieutenant Colonel: 4 years;

- Senior Lieutenant Colonel to Colonel: 4 years.

Additionally, active-duty officers with exceptional achievements may be considered for accelerated promotion but not exceeding the highest rank prescribed for the position or title they hold.
