Principles for Determining Job Positions in the Construction Sector
According to Clause 1, Article 3 of Circular 11/2023/TT-BXD, it is regulated as follows:
Principles and Basis for Determining Job Positions in the Construction Sector
1. The principles for determining job positions in the construction sector are performed in accordance with Article 3 of Decree No. 62/2020/ND-CP dated June 1, 2020, of the Government of Vietnam on job positions and public servant payroll.

Regarding Article 3 of Decree 62/2020/ND-CP, it is stipulated as follows:
Principles for Determining Job Positions and Managing Public Servant Payroll
1. Compliance with the regulations of the Communist Party and the law on job positions, management, and use of public servant payroll.
2. Conformity with the functions, tasks, powers, and organizational structure of agencies and organizations.
3. Ensure consistency, synchronization between determining job positions, public servant ranks with the use and management of public servant payroll.
4. Ensure scientific, objective, transparent, democratic nature and suitability with reality.
5. Link streamlining the payroll with restructuring and enhancing the quality of the public servant team in agencies and organizations.
Thus, based on the regulations mentioned above, the principles for determining job positions in the construction sector include:

Basis for Determining Job Positions in the Construction Sector
According to Clause 2, Article 3 of Circular 11/2023/TT-BXD, it is regulated as follows:

2. The basis for determining job positions in the construction sector is performed in accordance with Clause 1, Article 4 of Decree No. 62/2020/ND-CP dated June 1, 2020, of the Government of Vietnam on job positions and public servant payroll.
Regarding Clause 1, Article 4 of Decree 62/2020/ND-CP, it is stipulated as follows:

1. Basis for determining job positions:
a) Functions, tasks, powers, organizational structure of agencies and organizations;
b) Complexity level, nature, characteristics, scale of activities; scope, serving objects; professional management process according to sectoral regulations.

Process for Approving Job Positions in the Construction Sector
According to Article 7 of Decree 62/2020/ND-CP, it is stipulated as follows:
Process for Approving Job Positions
1. Agencies and organizations under the Ministry, Governmental Agencies, agencies affiliated with the Government of Vietnam, organizations established by the Government of Vietnam or the Prime Minister that are not public service providers, People's Committee of provinces and centrally-run cities (collectively referred to as ministries, central, and local authorities) based on Clause 1, Article 4 of this Decree and instructions of the competent authority on job positions to develop their job position schemes, and send to the agencies and organizations specified in Clause 2 of this Article for appraisal.
2. The agency or organization assigned with the personnel organization task of the ministries, central, and local authorities shall receive dossiers, appraise job position schemes, compile job positions of agencies and organizations under the ministries, central, and local authorities, and submit to the competent authority for decision specified in Clause 3 of this Article.
3. The head of the ministries, central, and local authorities approves job positions in the agencies and organizations under their management authority.
Thus, based on the above regulations, the process for approving job positions in the construction sector is performed as follows:
Step 1:
Agencies and organizations under the Ministry, Governmental Agencies, agencies affiliated with the Government of Vietnam, organizations established by the Government of Vietnam or the Prime Minister that are not public service providers, People's Committee of provinces and centrally-run cities develop their job position schemes in the construction sector, and send to the agencies and organizations specified in Clause 2, Article 7 of Decree 62/2020/ND-CP for appraisal.
Step 2:
The agency or organization assigned with the personnel organization task of the ministries, central, and local authorities shall receive dossiers, appraise job position schemes, compile job positions in the construction sector of agencies and organizations under the ministries, central, and local authorities, and submit to the competent authority for decision specified in Clause 3, Article 7 of Decree 62/2020/ND-CP.
Step 3:
The head of the ministries, central, and local authorities approves job positions in the construction sector in the agencies and organizations under their management authority.
