Vietnam: Will the Communist Party members who are indifferent, insensitive or prevent the detection, reporting and handling of acts of domestic violence be disciplined?
- If a member of Communist Party of Vietnam is indifferent and insensitive or prevents the detection, reporting and handling of acts of domestic violence, will he/she be reprimanded?
- If a member of Communist Party of Vietnam commits acts of domestic violence, will he/she be warned or dismissed?
- If a member of Communist Party of Vietnam commits acts of domestic violence, will he/she be expelled from the Party?
- What were the previous regulations on domestic violence violations for members of Communist Party of Vietnam ?

According to Clause 1, Article 50, Regulation 69-QD/TW in 2022 stipulates:
"Article 50. Violations against regulations on domestic violence prevention and control
1. Communist Party members who violate one of the following violations, causing less serious consequences, shall be disciplined in the form of reprimand:
a) Using or spreading information, images, sounds, or objects that incite domestic violence.
b) Preventing the exercise of the legal rights and obligations in the relationship between grandparents and grandchildren, between parents and children, between husbands and wives as well as among brothers and sisters..
c) Being indifferent, insensitive or preventing the detection, reporting and handling of acts of domestic violence..."

If a member of Communist Party of Vietnam commits acts of domestic violence, will he/she be warned or dismissed?
According to Clause 1, Article 50, Regulation 69-QD/TW in 2022 stipulates:
"Article 50. Violations against regulations on domestic violence prevention and control
...
2. If a person who has been disciplined as prescribed in Clause 1 of this Article repeats the offense or commits it for the first time, causing serious consequences or violates one of the following cases, the discipline shall be in the form of warning or dismissal ( if there is a position):
a) Appropriating or destroying private property of family members or common property of the family.
b) Forcing family members to work too hard or to make financial contributions beyond their means; controlling the income of family members in order to create financial dependence.
c) Illegally forcing a family member out of their residence.
d) Forcing, inciting, instigating and assisting others to cause domestic violence.
d) Tolerating, covering up, failing to handle or handling unlawfully acts of domestic violence."
If a member of Communist Party of Vietnam commits acts of domestic violence, will he/she be expelled from the Party?

3. In case of violation of Clauses 1 and 2 of this Article, causing very serious consequences or in one of the following cases, the discipline shall be in the form of expulsion:
a) Taking revenge on and punishing those who discover, report, and prevent acts of domestic violence.
b) Torturing, mistreating, beating or committing other acts infringing upon health and life; insulting, insulting honor and dignity; isolating, driving away or putting constant psychological pressure on family members or people who have contributed to their care."
What were the previous regulations on domestic violence violations for members of Communist Party of Vietnam ?
According to Article 32 of Regulation 102-QD/TW in 2017 stipulating:
"Article 32. Violation of domestic violence
1- Communist Party members who violate one of the following circumstances, causing less serious consequences, shall be disciplined in the form of reprimand:
a) Using and spreading information, images and sounds to incite domestic violence.
b) Preventing the exercise of rights and obligations in family relations between grandparents and grandchildren; between father, mother and child; between husband and wife; between brothers, sisters and brothers.
c) Preventing the detection, declaration, prevention and handling of domestic violence acts.
2- In case a violation has already been disciplined in Clause 1 of this Article but recidivism or first violation causes serious consequences or violates one of the following cases, the discipline shall be in the form of warning or dismissal. (if there is a position):
a) Appropriating, destroying or intentionally damaging the private property of another family member or the common property of the family.
b) Forcing family members to work too hard or contribute financially beyond their means; controlling the income of family members in order to create financial dependence.
c) Illegally forcing a family member out of their residence.
d) Forcing, inciting, instigating and assisting others to commit acts of domestic violence.
d) Tolerating, covering up, failing to handle or handling acts of domestic violence in contravention of law provisions.
3- In case of violations specified in Clauses 1 and 2 of this Article causing very serious consequences or in one of the following cases, the discipline shall be in the form of expulsion:
a) Taking revenge on and punishing those who discover, report, and prevent acts of domestic violence.
b) Torturing, mistreating, beating or committing other acts infringing upon health and life; insulting, insulting honor and dignity; isolating, driving away or putting constant psychological pressure on family members or people who have contributed to their care."
Thus, Communist Party members who are indifferent, insensitive or prevent the detection, reporting and handling of domestic violence acts will be disciplined according to the above provisions.
