Will a person that was deported from Vietnam be permitted for entry for patient visiting?
Pursuant to the provisions of Article 21 of the Law on entry, exit, transit, and residence of foreigners in Vietnam 2014, it is stipulated as follows:
Cases of suspension from entry
1. Any of the conditions in Clause 1 Article 20 of this Law is not satisfied.
2. Children under 14 years of age without parents, guardians or authorized custodians.
3. Forging papers or providing false information to obtain entry/exit/residence permit.
4. Any person suffering from a mental disease or infectious disease that threatens the public health.
5. Any person that was deported from Vietnam within the last 03 years.
6. Any person that was compelled to leave Vietnam within the last 06 months.
7. For reasons of epidemic prevention.
8. For reasons of natural disasters.
9. For reasons of national defense, national security, social order, and social safety.
Thus, based on the above regulations, in case any person that was deported from Vietnam within the last 03 years, he/she will not be allowed to enter Vietnam. Therefore, persons who are being deported from Vietnam cannot return to Vietnam to visit sick people because they have not been allowed to enter Vietnam.

When will persons be permitted for entry in Vietnam?
Pursuant to the provisions of Article 20 of the Law on entry, exit, transit, and residence of foreigners in Vietnam 2014, amended by Clause 11, Article 1 of the Law on amendments to a number of Articles of Law on entry, exit, transit and residence of foreigners in Vietnam 2019, stipulates as follows:
Entry eligibility
1. A foreigner shall be permitted for entry if he/she:
a) possesses a passport or documents enabling international travel, except for cases of visa-free entry as specified in this Law.
Passport of a foreigner wishing to make entry in form of unilateral visa-free must be valid at least for another 6 months; and
b) does not fall into categories of entry suspension specified in Article 21 of this Law.
2. A foreigner making entry on electronic visas must fully satisfy all conditions specified in Clause 1 of this Article and make entry via international border checkpoints decided by the Government
Accordingly, to enter Vietnam, foreigners need to meet the following conditions:
- Possesses a passport or documents enabling international travel, except for cases of visa-free entry as specified.

What are the rights and obligations of the deportee in Vietnam?
Pursuant to the provisions of Article 7 of Decree 142/2021/ND-CP, the rights and obligations of the deportee are as follows:
(1) Rights of the deportee:
- Know the reason for the deportation, receive the deportation decision at least 48 hours before the execution;
- Require an interpreter when working with a competent agency or person;
- Receive statutory benefits as prescribed in Decree No. 65/2020/ND-CP dated June 10, 2020 on benefits for people staying at accommodation establishments during the waiting period for exit;
- Bring their lawful property out of the Vietnamese territory;
- Lodge complaints and file whistleblowing reports in accordance with the law on settlement of complaints and whistleblowing reports.
(2) Obligations of the deportee:
- Fully comply with the provisions stated in the decision on penalty for administrative violations including the deportation;
- Present identification papers at the request of immigration authorities;
- Comply with Vietnamese law and abide by the management of the police whilst deportation in in progress;
- Quickly fulfill all civil, administrative and economic obligations as prescribed by law (if any);
- Complete the necessary procedures to leave the Vietnamese territory.
