Circular 05/2024/TT-BTP on regulations of civil judgment execution statistics policies effective from July 26, 2024?
On June 10, 2024, the Minister of Justice issued Circular 05/2024/TT-BTP stipulating the reporting regime for civil judgment execution statistics and monitoring administrative judgment execution.
Circular 05/2024/TT-BTP regulates the reporting regime for civil judgment execution statistics and monitoring administrative judgment execution (hereinafter collectively referred to as the civil judgment execution statistics report); the use and publication, dissemination of statistical information; inspection, verification, commendation, and handling of violations in the implementation of the civil judgment execution statistics reporting regime.
The subjects to which Circular 05/2024/TT-BTP applies include:
- The General Department of Civil Judgment Execution; Departments of Judgment Execution under the Ministry of National Defense; provincial-level Civil Judgment Execution Departments, centrally-affiliated cities (hereinafter collectively referred to as Civil Judgment Execution Departments); Military Region-level Judgment Execution Offices and equivalents (hereinafter collectively referred to as Military Region-level Judgment Execution Offices); district, town-level, provincially affiliated city Civil Judgment Execution Sub-departments (hereinafter collectively referred to as Civil Judgment Execution Sub-departments);
- Civil judgment executors, officials engaging in civil judgment execution, monitoring administrative judgment execution; civil judgment executors, officers, professional soldiers engaging in civil judgment execution in the military;
- Organizations and individuals related to civil judgment execution activities, monitoring administrative judgment execution as prescribed by law.

Regulations on civil judgment execution statistical reporting period effective from July 26, 2024?
Article 5 of Circular 05/2024/TT-BTP stipulates the civil judgment execution statistical reporting period.
Civil judgment execution statistical reports include periodic statistical reports and ad hoc statistical reports:
- Periodic statistical reports include monthly, bi-monthly, quarterly, four-monthly, five-monthly, six-monthly, seven-monthly, eight-monthly, nine-monthly, ten-monthly, eleven-monthly, and twelve-monthly reporting periods. The twelve-month statistical reporting period is the annual statistical reporting period.
The statistical reporting period is calculated starting from October 1 of the current year and ends on the last day of the month of each statistical reporting period. The civil judgment execution statistical reporting year begins on October 1 of the previous year and ends on September 30 of the following year.
- Ad hoc statistical reports are carried out based on written requests from authorized individuals to meet state management requirements in civil judgment execution and monitoring administrative judgment execution. The written request for an ad hoc statistical report must clearly state the time, duration, content of the statistical report, and other requirements (if any) for the required agency or individual to implement.
How to prepare civil judgment execution statistical reports effective from July 26, 2024?
Article 8 of Circular 05/2024/TT-BTP stipulates the preparation of statistical reports as follows:
- At the end of the statistical reporting period, the agencies and individuals specified in clause 1, Article 3 of Circular 05/2024/TT-BTP must close the data, finalize the accounts to prepare statistical report forms. The results of any period must be reported within that period. It is strictly prohibited to transfer statistical data arising in the current period to the next period.
- At the end of the 3-month, 6-month, 10-month, and 12-month statistical reporting periods, the Civil Judgment Execution Sub-departments close the data, prepare the list of cases without execution conditions that have been transferred to a separate monitoring register; the list of ongoing civil judgment execution cases; the list of state compensation cases being monitored and resolved (including cases handled by the People's Courts); the list of civil judgment execution cases for credit institutions to be sent to the Civil Judgment Execution Departments.
The Civil Judgment Execution Departments close the data, prepare the list of cases without execution conditions that have been transferred to a separate monitoring register; the list of ongoing civil judgment execution cases; the list of state compensation cases being monitored and resolved (including cases handled by the People's Courts); the list of civil judgment execution cases for credit institutions at the Civil Judgment Execution Departments and compile a comprehensive list for the entire province to be sent to the General Department of Civil Judgment Execution for monitoring and management.
The Military Region-level Judgment Execution Offices close the data, prepare the list of unexecuted civil judgment execution cases, the list of state compensation cases being monitored and resolved, and send it to the Judgment Execution Departments under the Ministry of National Defense for monitoring and management.
- At the end of the 12-month statistical reporting period, the Civil Judgment Execution Sub-departments close the data, prepare the list of unexecuted civil judgment execution cases to be transferred to the next period and send it to the Civil Judgment Execution Departments. The Civil Judgment Execution Departments close the data, prepare the list of unexecuted civil judgment execution cases to be transferred to the next period at the Civil Judgment Execution Departments and compile a comprehensive list for the entire province to be sent to the General Department of Civil Judgment Execution for monitoring and management.
- The date of preparing the statistical report is the date when the executor compiles the data and prepares the statistical report to be sent to the unit head, or the date when the Civil Judgment Execution Sub-departments, Civil Judgment Execution Departments compile the data and prepare the provincial statistical report to be sent to the immediate superior level.
- The manner of recording and preparing statistical reports is done according to the instructions in the explanation of the forms.
Circular 05/2024/TT-BTP takes effect from July 26, 2024.
