Circular 01/2024/TT-TANDTC on competition and commendation work in the People's Court
Pursuant to Article 2 of Circular 01/2024/TT-TANDTC, the subjects of competition are specified as follows:
- Units under the Supreme People's Court, the Judicial Academy.- High People's Courts, Military Courts of all levels.- Provincial People's Courts, centrally-affiliated cities, and equivalents (hereinafter referred to as Provincial People's Courts).- District People's Courts, towns, district-level cities, and equivalents (hereinafter referred to as District People's Courts).- Small collectives within the aforementioned agencies and units.- Officials and public employees, workers (including those on probation) working in these agencies and units.
Thus, the subjects of competition in the work of competition and commendation include People's Courts at all levels, collectives, units under the Court system, and officials and public employees, workers working in these agencies and units.

What are the principles of commendation?
According to Article 5 of Circular 01/2024/TT-TANDTC, the principles of commendation in the People's Court are as follows:
- Democratic, accurate, public, transparent, fair, and prompt.- An individual can receive multiple commendations of the same type; however, one achievement cannot be awarded multiple times or in multiple forms; commendations are given commensurate with the achievement.- No two forms of commendation (including honorary titles) for the same achievement; exceptions are made for extraordinary achievements, commendations for contributions, or periodic commendations within the armed forces (if applicable).- Results from extraordinary achievements or thematic competitions are not used as a basis for recommending higher levels of commendation.- Ensure consistency between the nature, form, and object of commendation.- Combine moral encouragement with material incentives.- Annual commendations must be based on individual and collective assessments and classifications (according to Communist Party regulations and the law on annual performance reviews within the political system and Supreme People's Court regulations).- Commendation must be based on achieved merits.+ Merits achieved under difficult conditions and with wide-ranging impacts may receive higher levels of commendation.+ Only year-end achievements are considered for commendations; thematic competition results are noted and prioritized for subsequent commendations.+ Past commendations are not aggregated to raise the level of future commendations. Emphasize commendation for small collectives and individuals directly involved in labor, work, or combat with significant innovations.- The criteria for commendations to heads of agencies or units are based on the achievements of the collectives they lead (the commendation level for leaders is not higher than that of the collective they lead during the working year).- Commendations for Judges are based on general criteria for Judges within the agency or unit.- No commendations or recommendations for higher levels are considered for individuals or collectives during periods of disciplinary action, investigation, inspection, or audit for violations, complaints, denunciations, or corruption issues being clarified.- Individuals or collectives that have served a disciplinary term and accomplished achievements afterward are considered for commendation from the time of completing the disciplinary term.- Individuals or collectives not considered for commendation due to annulled or amended judgments but later cleared by the appellate court may be reconsidered for supplementary commendation.- No commendations for collectives with officials and public employees, workers disciplined from a warning upwards or under criminal investigation.+ Collectives with officials and public employees, workers disciplined by reprimand may still be considered if other commendation conditions and standards are met; the Reward and Commendation Council at the same level will review and propose the head of the agency or unit to decide according to their authority.- Female leaders, managers receive a one-third reduction in the time holding positions for commendation for contributions compared to general regulations (for those with later retirement age regulations, the time holding positions follows general regulations).+ When having multiple individual or collective subjects meeting the criteria for a commendation form, priority is given to female individuals or collectives with a higher female ratio.- Subsequent commendation period is calculated from the achievement date in the previous commendation decision.+ If the commendation decision does not specify the achievement date, the subsequent period is calculated from the previous decision issuance date.- The level organizing the competition awards or recommends commendation from a higher level if a high-level achievement is recognized.- Decimal numbers for individuals or collectives are rounded: under 0.5 is rounded down to 0, and 0.5 or above is rounded up to 1.
When does Circular 01/2024/TT-TANDTC take effect?
Pursuant to Article 44 of Circular 01/2024/TT-TANDTC, the provisions are as follows:
