Has Circular 01/2024/TT-BVHTTDL been issued regulating doping control in sports activities?

On May 17, 2024, the Minister of Culture, Sports and Tourism issued Circular 01/2024/TT-BVHTTDL regulating doping control in sports activities.

Circular 01/2024/TT-BVHTTDL governs the following subjects:

- Circular 01/2024/TT-BVHTTDL regulates doping control in sports activities, including:

+ Education, communication

+ Doping testing

+ Result management

+ Responsibilities of organizations and individuals in doping control.

- Doping control in sports activities is implemented following the regulations of the World Anti-Doping Code, International Standards of the World Anti-Doping Agency, and Vietnam's doping control regulations.

Circular 01/2024/TT-BVHTTDL applies to the following subjects:

- Circular 01/2024/TT-BVHTTDL applies to organizations and individuals participating in sports activities, other organizations and individuals related to sports in Vietnam; Vietnamese organizations and individuals participating in sports activities abroad.

How is the doping testing procedure in sports activities implemented from July 9, 2024?

Circular 01/2024/TT-BVHTTDL stipulates the doping testing procedure in sports activities as follows:

Doping testing authority:

According to Article 8 of Circular 01/2024/TT-BVHTTDL, the authority to test for doping in sports activities is as follows:

- The anti-doping organization in Vietnam has the right to test any athlete for doping according to the World Anti-Doping Code.

- Athlete management agencies and sports tournament organizers may request the Anti-Doping Organization in Vietnam to test athletes for doping when necessary in accordance with the World Anti-Doping Code.

- In cases where international sports federations authorize or request doping testing, the Anti-Doping Organization in Vietnam cooperates with relevant sports federations to carry out doping testing according to the regulations of the World Anti-Doping Code and international standards on Testing and Investigations of the World Anti-Doping Agency.

Sample collection for doping testing:

According to Article 9 of Circular 01/2024/TT-BVHTTDL, the regulations for sample collection for doping testing in sports activities are as follows:

- The Anti-Doping Organization in Vietnam is responsible for:

+ Planning and organizing sample collection for doping testing.

+ Ensuring the sample collection, storage, and transportation processes comply with the World Anti-Doping Code and relevant international standards.

- The individual collecting the sample must undergo training and be certified according to the World Anti-Doping Code and relevant international standards.

Notification of doping test sample results:

According to Article 10 of Circular 01/2024/TT-BVHTTDL, the notification of doping test sample results in sports activities is as follows:

- Within 5 working days from the date of receiving the doping test results, the Anti-Doping Organization in Vietnam must notify in writing the test results to:

+ The Sports Department;

+ Agencies and organizations requesting doping tests, athletes, and athlete management units.

- For athletes with suspicious sample analysis results of doping violation, the notification process shall be conducted according to the World Anti-Doping Code and relevant international standards.

Exemption due to treatment for athletes:

According to Article 11 of Circular 01/2024/TT-BVHTTDL, the regulations for exemption from doping testing in sports activities due to treatment for athletes are as follows:

- Athletes with medical files proving the necessity of using banned substances or methods for treatment must be approved with an exemption according to the World Anti-Doping Agency regulations and International Standards for Therapeutic Use Exemptions.

- Athletes do not violate the World Anti-Doping Code when banned substances or methods are detected in the sample or possession if they have an appropriate therapeutic use exemption permitting the use of banned substances or methods.

Therapeutic Use Exemption Committee:

According to Article 12 of Circular 01/2024/TT-BVHTTDL, the regulations for the Therapeutic Use Exemption Committee in sports activities for treating athletes are as follows:

- The Director of the Anti-Doping Organization in Vietnam establishes the Therapeutic Use Exemption Committee in accordance with the International Standards for Therapeutic Use Exemptions to review the reasonableness of treatment records for therapeutic use exemption of athletes.

- The Therapeutic Use Exemption Committee consists of 3 to 9 members, the number of members must be odd. Committee members are medical experts and qualified individuals as stipulated by the World Anti-Doping Code and International Standards for Therapeutic Use Exemptions.

- The Therapeutic Use Exemption Committee operates on democratic principles, voting by majority, and in accordance with the World Anti-Doping Code and International Standards for Therapeutic Use Exemptions.

- The Therapeutic Use Exemption Committee is responsible for referring to the regulations of the World Anti-Doping Code and International Standards for Therapeutic Use Exemptions to perform the review, assessment, and approval process for therapeutic use exemption for athletes.

- The operational duration of the Therapeutic Use Exemption Committee is specified in the Establishment Decision of the Committee.

When is Circular 01/2024/TT-BVHTTDL effective?

According to Article 24 of Circular 01/2024/TT-BVHTTDL, the effective date is as follows:

- Circular 01/2024/TT-BVHTTDL is effective from July 9, 2024.

- In cases where the documents referenced in Circular 01/2024/TT-BVHTTDL, the World Anti-Doping Code, or international standards are amended or supplemented, the new regulations applicable and implemented shall be consistent with the provisions of Clause 2 Article 3 of the Law on Physical Training and Sports 2006.

- The following legal documents will cease to be effective from the date Circular 01/2024/TT-BVHTTDL becomes effective:

+ Circular 17/2015/TT-BVHTTDL

+ Circular 01/2023/TT-BVHTTDL amending and supplementing a number of articles of Circular 17/2015/TT-BVHTTDL.
