Has there been the deadline for issuing the Decree on the new salary regime for Vietnamese officials, public employees, and armed forces?

The Government has just issued Resolution 01/NQ-CP on the tasks and key solutions for implementing the Socio-Economic Development Plan and State Budget Estimate for 2024, which includes important directives related to salary reform for officials, public employees, and armed forces.

Accordingly, the Government will implement comprehensive, synchronized, and effective salary policy reforms based on Resolution 27-NQ/TW 2018 of the Central Executive Committee on salary policy reform for officials, public employees, armed forces, and workers in enterprises.

The construction of job positions for officials and public employees in the state administrative system will be completed before March 31, 2024. At the same time, clear responsibilities will be assigned to each ministry, sector, locality, and head of agency to serve as the basis for implementing salary policy reforms from July 1, 2024.

Efforts will continue to be made to effectively implement the comprehensive administrative reform program, with a focus on institutional and organizational reforms, officials, public services, and administrative procedures. The development of an e-Government towards a digital government will be emphasized, promoting national digital transformation.

Efforts will be made to enhance the development of online public service delivery systems for citizens and businesses.

Synchronized implementation of orientations, policies, and laws on anti-corruption and anti-negative practices will be carried out. Transparency and accountability in inspection activities will be strengthened.

According to Appendix IV, specific tasks for each sector and field in 2024 (attached to Resolution 01/NQ-CP), the Ministry of Home Affairs is assigned as the lead agency to implement, and by May 2024, it must complete the issuance of a new decree regulating the salary regime for officials, public employees, and armed forces.

Therefore, currently, the salary regime for officials, public employees, and armed forces is being implemented according to the provisions of Decree 204/2004/ND-CP.

If the new decree is issued, it may replace Decree 204/2004/ND-CP.

From July 1, 2024: What subjects does the new salary schedule apply to after the salary reform in Vietnam?

Recently, the Chairman of the National Assembly issued Resolution 104/2023/QH15 on the State Budget Estimate for 2024.

According to Resolution 104/2023/QH15, comprehensive salary policy reforms will be implemented based on Resolution 27-NQ/TW 2018. In accordance with the spirit of Resolution 27-NQ/TW 2018, 05 new salary schedules will be developed based on job positions, titles, and leadership positions to replace the current salary schedule system. The transition from the old salary to the new salary will be carried out, ensuring that the new salary is not lower than the current salary received. These reforms will apply to officials, public employees, and armed forces and include the following:

Table 01: Salary schedule for officials and public employees holding leadership positions (elected and appointed) in the political system from central to local levels.

Table 02: Salary schedule based on expertise and professional titles for officials and public employees without holding leadership positions.

Table 03: Salary schedule for military officers, officers, and non-commissioned officers in the police force (based on positions, titles, military ranks, or ranks).

Table 04: Salary schedule for professional soldiers and technical staff in the police force.

Table 05: Salary schedule for defense workers and police officers (with a proportional relationship between the salary of armed forces and administrative officials as it is currently).

Therefore, starting from July 1, 2024, when implementing the salary reform, there will be 05 new salary schedules based on job positions for the following groups:

- Officials and public employees holding leadership positions.

- Officials and public employees without holding leadership positions.

- Military officers.

- Officers and non-commissioned officers in the police force.

- Professional soldiers.

- Technical staff in the police force.

- Defense workers.

- Police officers.

However, according to the content of Resolution 104/2023/QH15, the salary reform based on Resolution 27-NQ/TW 2018 has been finalized, but there hasn't been an official document issued regarding the application of the 05 new salary schedules for the mentioned groups.

From July 1, 2024: What is the basis for development of 05 new salary schedule in Vietnam?

According to the spirit of Resolution 27-NQ/TW 2018, the design and development of the 05 new salary schedules for officials, public employees, and armed forces will be based on the following factors:

- Annuling the current statutory pay rate and salary coefficient, and establishing a specific basic salary amount in the new salary schedule.

- Implementing a unified labor contract regime in accordance with the provisions of the Labor Code (or service provision contract) for individuals performing redundant and service jobs (requiring training below intermediate level), without applying the officials and public employees salary schedule to these individuals.

- Determining the minimum salary level for officials and public employees in the public sector as the salary level for individuals performing jobs requiring intermediate level training (level 1), which should not be lower than the minimum salary level for trained workers in the business sector.

- Expanding the wage relationship as a basis for determining specific salary levels in the salary schedule system, gradually approaching the wage relationship in the business sector that is suitable for the state's resources.

- Improving the system of regular wage increases and premature salary increases for officials, public employees, and armed forces personnel in accordance with the provisions of the new salary schedule.
