Criteria for Evaluating the Quality of Public Employees at the Level of Non-Completion of Duties in 2023: What Criteria Are Included?
Criteria for Assessing the Quality of Public Employees at the Level of Not Completing Tasks in 2023?
Based on the provisions in Article 15 of Decree 90/2020/ND-CP, which content was annulled by Clause 4 Article 1 of Decree 48/2023/ND-CP, regulating the criteria for assessing public employees at the level of not completing tasks.
Specifically, the assessment criteria include the following:
(1) Public employees not holding management positions, if having any of the following criteria, will be rated as not completing tasks:
- Displaying signs of ideological and political degradation, ethics, lifestyle, self-evolution, self-transformation as assessed by the competent authority;
- More than 50% of the criteria for task performance results according to the signed labor contract, according to the given plan, or specific assigned tasks failing to ensure progress, quality, and efficiency;
- Having violations handled with disciplinary actions during the assessment year;
(2) Public employees in management positions, if having any of the following criteria, will be rated as not completing tasks:
- Displaying signs of ideological and political degradation, ethics, lifestyle, self-evolution, self-transformation as assessed by the competent authority;
- More than 50% of the criteria for task performance results according to the signed labor contract, according to the given plan, or specific assigned tasks failing to ensure progress, quality, and efficiency;
- Units or fields of work assigned to be in charge completing less than 50% of targets and tasks;
- Units under the direct management authority related to embezzlement, corruption, wastefulness and being handled according to the law's provisions;
- Having violations handled with disciplinary actions during the assessment year.

Who has the Authority to Evaluate and Classify Public Employees?
Based on the provisions of Clause 3 Article 16 of Decree 90/2020/ND-CP, it is stipulated as follows:

3. For public employees
The authority and responsibility to evaluate and classify the quality of public employees is carried out according to the provisions of Clauses 1, 2, and 3 Article 43 of the Law on Public Employees.
Referring to Article 43 of the Law on Public Employees 2010, it is stipulated as follows:
Responsibility to Evaluate Public Employees
1. The head of a public service provider is responsible for organizing the evaluation of public employees under their management.
2. Depending on specific conditions, the head of a public service provider conducts the evaluation or assigns and delegates the evaluation of public employees under their management. The person assigned the authority to evaluate public employees must take responsibility before the head of the public service provider for the evaluation results.
3. The person with the appointing authority is responsible for evaluating managing public employees in the public service provider.
4. The Government of Vietnam stipulates the detailed procedures for evaluating public employees as prescribed in this Article.
Thus, based on the provisions mentioned above, the authority to evaluate and classify public employees includes the following:
- The head of a public service provider is responsible for organizing the evaluation of public employees under their management.
- Depending on specific conditions, the head of a public service provider conducts the evaluation or assigns and delegates the evaluation of public employees under their management. The person assigned the authority to evaluate public employees must take responsibility before the head of the public service provider for the evaluation results.
- The person with the appointing authority is responsible for evaluating managing public employees in the public service provider.
When is the Annual Evaluation and Classification of Public Employees Quality in 2023?
Based on the provisions of Clause 2 Article 20 of Decree 90/2020/ND-CP, it is stipulated as follows:
Annual Evaluation and Classification Time for Quality of Officials and Public Employees
1. The evaluation and classification of the quality of officials and public employees are carried out annually.
For officials and public employees transferred to new work units, the new agency, organization, or unit is responsible for evaluation and classification. In cases where they have worked in the old agency, organization, or unit for 06 months or more, a combined opinion of the old agency, organization, or unit is required, except for cases where the old agency, organization, or unit no longer exists.
2. The evaluation and classification of the quality of officials and public employees must be conducted before December 15 annually, before the evaluation, classification of the quality of party members, and the annual review and commendation summary of agencies, organizations, and units.
For public service providers working in the field of education, training, and some other areas where the end of the work year is before December, the head of the public service provider decides the evaluation and classification of the quality of public employees.

Thus, based on the above provisions, the annual evaluation and classification of the quality of public employees in 2023 will be conducted before December 15, 2023, before the evaluation and classification of the quality of party members and the annual review and commendation summary of agencies, organizations, and units.
