"Article 6. Infrastructure investment and establishment of industrial parks
1. Industrial parks can be invested in different forms. , including: industrial parks, export processing zones, supporting industrial parks, specialized industrial parks, ecological industrial parks and high-tech industrial parks (hereinafter collectively referred to as industrial parks)

3. Conditions, order and procedures for infrastructure investment and establishment of industrial zones shall comply with the provisions of this Decree and other relevant provisions of law
4. Conditions, order and procedures for infrastructure investment and establishment of an expanded industrial park shall comply with regulations similar to those of industrial parks. new file, except for the case specified in Clause 8, Article 9 of this Decree.
5. Each industrial park has one or more infrastructure investors, investors who invest in the construction and business of infrastructure of the industrial park.
6. An industrial park is determined to have been established from the date a competent authority:
a) Decides on investment policy in an industrial park infrastructure project funded by public investment in accordance with the law on investment. public private sector;
b) Approving the investment policy, concurrently approving the investor, approving the investor or granting the investment registration certificate to execute the investment project on construction and business of infrastructure of the industrial park in accordance with regulations. provisions of the law on investment."

The Decree 35/2022/ND-CP stipulates the planning on construction of industrial zones as follows:
"Article 7. Planning on construction of industrial zones
1. Planning on construction of industrial zones includes: general planning on construction of industrial zones. industrial zone construction planning, industrial park construction zoning planning and industrial park construction detailed planning (if necessary) Industrial park construction plannings are formulated, appraised and approved in accordance with the construction law.a
2. The approved general planning for construction of industrial parks and the planning of subdivisions for construction of industrial zones shall serve as the basis for:
) Organize the formulation of detailed planning on construction of industrial parks. b
) Organize the preparation of pre-feasibility study reports for industrial park infrastructure projects funded with public investment capital in accordance with the law on public investment; organize the preparation of investment project dossiers invest in the construction and business of infrastructure of industrial parks according to the provisions of the law on investment
; regulations of the law on public investment; approve investment policies on investment projects on construction and business of infrastructure of industrial zones in accordance with the provisions of the law on investment.
3. Based on the plan on development of the industrial park system in the provincial planning, the People's Committee of the province shall organize the formulation and approval of tasks, general construction planning project, and subdivision planning for the construction of industrial parks. according to the provisions of the law on construction.
4. Cases where planning tasks are not required:
a) In case of formulation of zoning planning for construction of an industrial park in an area already approved by a general construction planning or economic zone construction general planning. planning tasks are not required;
b) In case of formulation of detailed planning on construction of industrial parks in the area where the approved construction subdivision planning is available, planning tasks are not required;
c) Where planning tasks are not required as prescribed in Clause 5 of this Article.

b) Ministry of Transport, for industrial zones connected to national highways;
c) Ministry of Culture, Sports and Tourism, for industrial parks located adjacent to historical-cultural relics, natural heritage sites, national tourist areas or higher;
d) Ministry of Construction, for industrial parks located in urban areas of class II;
dd) The Ministry of National Defense, the Ministry of Public Security, for industrial parks on islands and border communes, wards and townships; coastal communes, wards, towns or other areas affecting national defense and security in accordance with the law on national defense and security and the law on investment.
7. Provincial-level People's Committees shall decide to adjust the location, adjust the size of the planning area for industrial park construction if the district-level geographical area is not changed in the following cases:
a) Adjustment of location , adjust the size of the area of the industrial park, but not more than 2% and not more than 6 hectares compared to the size of the area of the industrial park as determined in the List of industrial parks in the province or city directly. centrally;
b) Adjustment of location, adjustment of the size of the area of the industrial park not in the case specified at Point a of this Clause, but not more than 10% and not more than 30 hectares compared to the size of the industrial park that has been approved. identified in the list of industrial parks in the province or centrally run city after obtaining written opinions from the Ministry of Construction, the Ministry of Natural Resources and Environment, and the Ministry of Planning and Investment.
8. Provincial-level People's Committees assign selected investors to implement investment projects on construction and business of infrastructure of industrial parks to organize the formulation of zoning planning for construction of industrial parks (if necessary). in the area where there is a general planning to build an industrial park.
9. Investors who have been selected to implement investment projects on construction and business of infrastructure of industrial parks shall organize the elaboration of detailed planning on construction of industrial parks (if necessary).
10. Provincial-level People's Committees shall approve detailed planning projects on construction of industrial parks located in the area of two or more district-level administrative units.
11. Provincial People's Committees authorize Management Boards of industrial parks and economic zones to decide on the partial adjustment of the planning on subdivisions for construction of industrial parks; detailed planning on construction of industrial parks located in the area of two or more district-level administrative units.
12. Public service and utility works are planned to be built in the service land area of the industrial park to serve the employees working in the industrial park. The percentage of land area for construction of public utilities and service works must not exceed 10% of the total land area of the industrial park."
Thus, according to the above regulations, the ratio of the land area for construction of works public services and utilities in the service land area of the industrial park to serve the employees working in the industrial park does not exceed 10% of the total land area of the industrial park
Decree 35/2022/ND-CP takes effect from July 15, 2022.
