What are the cases of renewal or re-grant of citizen identity cards in Vietnam?

Pursuant to the provisions of Article 23 of the Law on Citizen Identitication in Vietnam 2014 stipulates as follows:

Article 23. Cases of renewal or re-grant of citizen identity cards
1. A citizen identity card shall be renewed in the following cases:
a/ The cases specified in Clause 1, Article 21 of this Law;
b/ The card is damaged and unusable;
c/ Change of family name, middle name, first name and characteristics for identification of the card holder;
d/ Gender re-assignment or native place re-determination;
dd/ There is incorrect information in the citizen identity card;
e/ Upon request of the card holder.
2. A citizen identity card shall be re-granted in the following cases:
a/ It is lost;
b/ The card holder has Vietnamese nationality restored under the Law on Vietnamese Nationality.

At the same time, pursuant to Article 21 of the Law on Citizen Identification in Vietnam 2014 stipulates as follows:

Article 21. Age eligible for renewal of citizen identity cards in Vietnam
1. A citizen identity card must be renewed when a citizen reaches full 25 years, full 40 years and full 60 years.
2. Citizen identity cards which are granted, renewed or re-granted within 2 years before a citizen reaches the age specified in Clause 1 of this Article remain to be valid until he/she reaches the subsequent age eligible for card renewal.

According to the above provisions, citizens may change back their citizen identity cards in the following cases:

- When citizens reach full 25 years old, full 40 years old and full 60 years old.

- The card is damaged and cannot be used;

- Change information about surname, middle letter, first name; identity traits;

- Gender reassignment, hometown;

- There is an error in the information on the citizen ID card;

- When citizens request.

What is the procedure for re-granting a citizen ID card in Vietnam?

Pursuant to the provisions of Article 11 of Circular 59/2021/TT-BCA stipulating the procedures for redemption of citizen identity cards as follows:

(1) The citizen shall go to the competent police office to receive the request to exchange the citizen identity card where the citizen permanently or temporarily resides to request the issuance of a citizen identity card.

(2). The police officer of the place where the request is received in return for the citizen identity card shall receive citizen information:

- Search for citizen information in the national database on population;

- Level type selection and description of identity characteristics

- Fingerprint acquisition;

- Portrait photography;

- Print the citizen identity information receipt form, the population information collection form (if any), the update form,

- Edit residential information (if any) for citizens to check, sign and clearly state their names;

- Collect fees as prescribed;

- Issuance of appointments to return settlement results.

(3). Withdraw the identity card, citizen identity card in use in case the citizen carries out procedures for transferring from the identity card to the citizen identity card, changing the citizen identity card.

(4). Look up the citizen identity letter to verify citizen information (if any).

(5). Processing and approving dossiers in exchange for citizen identity cards.

(6). Return the citizen identity card in Vietnam.

In case the registered citizen returns the citizen identity card to the required address, the police agency shall make a list and coordinate with the delivery service provider to do so and the citizen must pay the prescribed fee.

Can citizens who re-grant their citizen ID cards have their used ID revoked in Vietnam?

Pursuant to the provisions of Article 24 of the Law on Citizen Identification in Vietnam 2014 stipulates as follows:

Article 24. Order and procedures for renewal or re-grant of citizen identity cards
1. The procedures specified in Clause 1, Article 22 of this Law.
2. In case of renewal of a citizen identity card as a result of change of information specified at Point c, d or dd, Clause 1, Article 23 of this Law while such change has not yet been updated in the national population database, the citizen shall submit a copy of the competent agency’s document proving the change.
3. Used citizen identity cards shall be revoked for the cases specified in Clause 1, Article 23 of this Law.

According to the above provisions, in cases where citizens exchange their citizen identity cards specified in Clause 1, Article 23 of the Law on Citizen Identification in Vietnam 2014, they must withdraw their used citizen identity cards.

When re-granting for a citizen ID card, how long will it take to get a new card in Vietnam?

Pursuant to the provisions of Article 25 of the Law on Citizen Identification in Vietnam 2014 stipulates as follows:

Article 25. Time limit for grant, renewal or re-grant of citizen identity cards
From the date of receiving a complete dossier as prescribed in this Law, a citizen identification management agency shall grant, renew or re-grant a citizen identity card for a citizen within:
1. Seven working days, in cities or towns, in case of grant and renewal; or 15 working days, in case of re-grant;
2. Twenty working days, in highland mountainous, border and island districts for all cases;
3. Fifteen working days, in remaining areas for all cases;
4. Based on the roadmap for administrative reform, the Minister of Public Security shall stipulate the shortening of the time limit for grant, renewal and re-grant of citizen identity cards.

According to the above regulations, the time limit for redemption of the citizen identity card in Vietnam is as follows:

- Seven working days, in cities or towns, in case of grant and renewal; or 15 working days, in case of re-grant;

- Twenty working days, in highland mountainous, border and island districts for all cases;

- Fifteen working days, in remaining areas for all cases;

This time limit is calculated from the date of receipt of complete documents as prescribed.
