Can citizens performing military service take leave to return home for the 2024 Lunar New Year holiday?
Lunar New Year 2024, are citizens performing military service allowed to take leave to return home for Tet?
Based on the regulations in Clause 1, Article 50 of the Law on Military Service 2015, it is stipulated as follows:
Regimes and policies for non-commissioned officers and soldiers on active duty, discharged, and their relatives
1. For non-commissioned officers and soldiers during active service:
a) They are guaranteed prompt and sufficient provision of food, military attire, medical supplies, accommodation, monthly allowances, essential items, and cultural, spiritual needs suitable to the nature of their military task; they are guaranteed policies on holidays and Tet; they are ensured healthcare when injured, sick, or involved in accidents as stipulated by law;
b) From the thirteenth month onward, they are entitled to leave as per the policies; other emergency leave cases are decided by the Minister of National Defense;

According to the above regulations, citizens performing military service from the thirteenth month onward are entitled to leave as per the policies. Emergency leave cases are decided by the Minister of National Defense.
Based on Clause 1, Article 3 of Decree 27/2016/ND-CP, it is stipulated as follows:
Leave regime for non-commissioned officers and soldiers on active duty
1. Non-commissioned officers and soldiers on active duty from the thirteenth month onward are entitled to annual leave; the leave duration is 10 days (excluding travel time) and they are paid for transportation and travel allowances as per current regulations.

Thus, under the above regulations, citizens performing military service from the thirteenth month onward are entitled to leave as per the policies. Citizens who have completed 13 months of military service can use the leave to return home for Tet. However, those who have not completed 13 months of service will not be entitled to leave as per the policies.
Therefore, citizens performing military service from the thirteenth month onward can use their leave to go home for the Lunar New Year 2024, with a leave duration of 10 days.

Official military service enlistment schedule 2024?
On November 6, 2023, the Ministry of National Defense issued Official Dispatch 4267/BQP-TM 2023 on the selection and calling of citizens for enlistment in 2024.
According to Official Dispatch 4267/BQP-TM 2023, the military service handover for 2024 includes the following:
Implementing the Law on Military Service 2015; Decision 82/QD-TTg 2023 by the Prime Minister of the Government of Vietnam on calling citizens for enlistment in 2024; accordingly, in 2024, the selection and calling of citizens for enlistment (recruitment) will be conducted in one phase; the handover time will be within 03 days, from February 25 to the end of February 27, 2024 (from the 16th to the end of the 18th Lunar January of the Year of the Dragon).
Thus, in 2024, the selection and calling of citizens for enlistment will be conducted in one phase.
The official military service enlistment schedule 2024 is as follows:
Depending on the locality, the handover will take place within 03 days from February 25, 2023, to February 27, 2024 (i.e., from January 16 to January 18, Year of the Dragon).
In which cases are citizens exempt from military service in 2024?
Based on the regulations in Clause 1, Article 41 of the Law on Military Service 2015 supplemented by point c, Clause 1, Article 49 of the Law on Militia and Self-Defense 2019, regulations on cases eligible for temporary deferment from enlistment are:
- Not having sufficient health to serve as concluded by the Health Examination Council;
- Being the sole worker directly supporting their relatives who are no longer capable of working or have not reached working age; in families heavily affected by accidents, natural disasters, dangerous epidemics, confirmed by the commune-level People's Committee;
- Being the only child of a war invalid or a person exposed to toxic chemicals reducing work capacity from 61% to 80%;
- Having a sibling currently serving in the army; or serving in the People's Public Security forces;
- Belonging to families relocated to especially difficult socio-economic areas under the state's socio-economic development project as decided by the provincial People's Committee or higher, within the first 03 years;
- Officials and public employees; youth volunteers assigned to work in areas with particularly difficult socio-economic conditions as per law regulations;
- Currently studying at general education institutions; being trained at university level in regular systems at higher education institutions, college level in regular systems at vocational education institutions during one training course of a training level.
- Regular militia
Citizens in the aforementioned categories are eligible for temporary deferment from enlistment in 2024.
Additionally, cases stipulated in Clause 2, Article 41 of the Law on Military Service 2015 are eligible for exemption from military service enlistment in 2024, including:
- Children of martyrs or first-class war invalids;
- One sibling of a martyr;
- One child of a second-class war invalid; one child of a person exposed to toxic chemicals reducing work capacity from 81% or more;
- Crypto personnel not in the military or People's Public Security;
- Officials and public employees; youth volunteers assigned to work in areas with particularly difficult socio-economic conditions as per law regulations for 24 months or more.
Moreover, citizens who are temporarily deferred from enlistment without valid reasons for the deferment will be called for enlistment.
Citizens eligible for temporary or exemption enlistment, if volunteering, will be considered and called for enlistment.
