Who is considered for a pay raise ahead of schedule in the People's Court in Vietnam?

According to Clause 1, Article 1 of the Regulation on pay raise ahead of schedule, issued together with Decision 932/QD-TANDTC in 2017 as follows:

- Regulations on pay raise ahead of schedule apply to officials, public employees and employees working in units under:

+ Supreme People's Court;

+ High People's Court;

+ People's Courts of provinces and municipalities (hereinafter referred to as provincial-level People's Courts);

+ People's Courts of districts, towns, provincial cities and the equivalent (hereinafter referred to as district-level People's Courts)

- Salary has been arranged according to the professional pay rate table of the Court branch as prescribed in Resolution No. 730/2004/NQ-UBTVQH11 dated September 30, 2004 of the National Assembly Standing Committee; professional pay rate table specified in Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary regime for officials, public employees and armed forces.

Who are not the subjects to receive a pay raise ahead of schedule at the People's Court in Vietnam?

According to Clause 2, Article 1 of the Regulation on pay raise ahead of schedule, issued together with Decision 932/QD-TANDTC in 2017 as follows:

- Unrelated subjects:

+ Officials subject to salary classification according to the salary table of positions already ranked according to their tenure;

+ Officials subject to hold the last rank in the rank or in the title;

+ Officials subject to receive a written notice or decision of a competent authority that he/she has failed to complete the assigned task or during the time he/she holds the current salary level, he/she shall be disciplined in one of the following forms: reprimand, warning, downgrading salary, demotion, dismissal, forced resignation.

What are the principles of consideration for a pay raise ahead of schedule for officials, public employees and employees at People's Courts in Vietnam?

According to Article 2 of the Regulation a pay raise ahead of schedule, issued together with Decision 932/QD-TANDTC in 2017 as follows:

"Article 2. Implementation principles
1. Implement uniformly the regime of raising the salary level ahead of time due to outstanding achievements in performing tasks for officials, public employees and employees in the People's Court.
2. Implement publicly, democratically, objectively and in accordance with regulations.
3. Implement once a year in the first quarter and end before March 31 of each year.
4. A pay raise ahead of schedule to not be considered twice in a row ahead of time due to outstanding achievements in performing tasks in the same rank or title.
5. When there is a decision for a pay raise ahead of schedule, all previous achievements will not be used to calculate the achievements for the consideration of raising the salary level before the next time limit."

Who are the subjects for priority in consideration for a pay raise ahead of schedule? What is the time to apply for a new pay raise?

According to Article 5 of the Regulation on pay raise ahead of schedule, issued together with Decision 932/QD-TANDTC in 2017 as follows:

"Article 5. Priority in consideration for a pay raise ahead of schedule
1. The consideration for a pay raise ahead of schedule is carried out in the order of reward and achievement level from highest or lower until the target for raising salary level is exhausted before the prescribed time limit (12 months, 9 months, 6 months) ).
2. In case many people have the same level of reward and achievement (including the highest achievement and other achievements), the consideration for a pay raise ahead of schedule in the order of priority is as follows:
a) Persons in the period of holding the salary rank, in addition to the highest achievements, are rewarded and also have other achievements.
b) Persons whose scientific research works and innovations in the course of their work have been applied in practice and brought about remarkable results.
c) An exemplary judge, a typical judge.
d) Persons concurrently working for the Party and socio-political organizations.
dd) Person has more seniority or has not received a pay raise ahead of schedule.
e) Persons who do not hold leadership positions.
g) People with low pay rates."

In Article 10 of the Regulation on pay raise ahead of schedule, issued together with Decision 932/QD-TANDTC in 2017 on the time of calculating the new pay raise (ahead of schedule) is as follows:

"Article 10. Time to apply for new pay raise (ahead of schedule)
The time to apply the new pay raise includes the time keeping the old salary level plus the number of months ahead of schedule (12 months, 9 months, 6 months) is equal to the time prescribed for regular pay raise.
In case the date of signing the decision for a pay raise ahead of schedule of enjoying the new salary level, the employee is entitled to arrears and pays social insurance the additional salary difference between the new salary and the old salary according to the provisions of the Law on Social Insurance.
Example: Mr. Nguyen Van A is a primary judge of the People's Court of District B, in province C. The pay raise ahead of schedule are as follows:
- Mr. Nguyen Van A was upgraded to the regular salary level from level 5, pay rates 3.66 to level 6 pay rates 3, 99 ranks of primary judges since December 1, 2011.
- In 2012 and 2013, Mr. Nguyen Van A was continuously recognized as a grassroots emulation soldier; According to the regulations on the conditions and standards of achievement level, Mr. Nguyen Van A was received a pay raise level six (06) months ahead of schedule, so in the first quarter of 2014, Mr. A was considered to raise the salary level six (06) ahead of schedule six (6) months from grade 6, pay rates 3.99 to grade 7, pay rates 4.32, rank of primary judge. The time to calculate the new salary level and the time to calculate the next pay raise is calculated from June 1, 2014."
