Can officials who take annual leave be paid transport expenses and traveling allowance in Vietnam?

Pursuant to the provisions at Point a, Clause 1, Article 4 of Circular No. 141/2011/TT-BTC as follows:

Regulations on payment for transport expenses and traveling allowance upon annual leave taking
1. Expenditure contents and payment rate:
a) People taking their leave will be paid traveling allowance (equivalent to the rate of allowance under the current regulation on traveling allowance) and transportation expenses upon annual leave taking.

According to the above regulations, officials who take annual leave are paid transport expenses and traveling allowance. However, the implementation of this provision only applies to some specific cases.

Pursuant to Clause 1, Article 2 of Circular No. 141/2011/TT-BTC as amended by Clause 1, Article 1 of Circular No. 57/2014/TT-BTC as follows:

Subjects of application:
1. The subjects are paid with traveling transportation expenses and traveling allowance upon annual leave taking:
a) Cadres and officials who are lowland people working in highland, deep-lying, remote, border and island areas with a regional allowance coefficient of 0.5 or higher (as prescribed in the Circular No. President No. 11/2005/TTLT-BNV-BLDTBXH-BTC-UBDT dated January 5, 2005 of the Ministry of Home Affairs, Labour, Invalids and Social Affairs, Ministry of Finance and the Committee for Ethnic Minorities) and people living in the highlands and regions deep-lying, remote, border and island areas with a regional allowance coefficient of 0.5 or more, working in lowland areas, are eligible for annual leave as prescribed by the Labor Code, approved by the head of the agency or unit to take an annual leave to visit their families, parents, spouse, children or hometown.
b) Cadres and officials working the other areas are eligible for annual leave as prescribed by labor law and approved by the head of agency or unit to issue permission for annual leave to visit their spouse, children, parents (of the husband or wife) who are sick or dead.

Thus, officials who fall into the above cases will be paid for transportation; traveling allowance when taking annual leave.

How much is the payment for transport expenses and traveling allowance when officials take annual leave?

According to the provisions of Article 4 of Circular No. 141/2011/TT-BTC, the level of payment for transport expenses and traveling allowances when officials take annual leave is determined as follows:

(1) Transport expenses

Pursuant to Point b, Clause 1, Article 4 of Circular No. 141/2011/TT-BTC as follows:

b) Transportation expenses include: transportation expenses (excluding aircraft) of the organizations or individuals carrying business of passenger business as prescribed by law including: roundtrip transportation expenses from home to railway station, bus station; train and coach tickets to the annual leave destination and in the opposite direction.
Payment rate: At the prices stated on the ticket, ticket invoice; the fare does not include the costs of other services (Sightseeing tours, special services as requested). In case the cadres and officials taking their leave by the aircraft with legal tickets will be paid at the maximum rate of public passenger transport by roadway, railway and waterway vehicles in line with the route of leave.
For road sections without means of transport of organizations or individuals carrying on business of passenger transport as prescribed by law and the people taking their leave must hire other means of transportation, then the head of agency or units will consider and decide on the payment for the expenses of means hired on the basis of contract of means hiring or payment voucher to the owner of the means of transportation based on the number of kilometer actually taken and unit price regulated in the agency or unit’s internal spending rules.
If the people taken their annual leave by their own vehicles will be paid the amount spent on their own vehicles by the actual number of kilometer taken in proportion to the common transport rate of the public means of transport at localities but not exceeding the rate of self-sufficient amount spent on means of transport upon taking business trip and must be regulated in the agency or unit’s internal spending rules.
In case people taking their annual leave in combination with business trip and relative visit, they will only be paid the traveling allowance without payment for fares of annual leave because it is included in the traveling expenses.

Thus, the payment of transport expenses for officials on annual leave is determined according to the above regulations.

(2) Stay allowances

Determined equivalent to the level of stay allowance according to the current per diem regime.

Pursuant to Article 6 of Circular No. 40/2017/TT-BTC on stay allowances as follows:

Stay allowances
1. Stay allowances mean amounts paid by agencies or units to their staff on work trips in addition to their salaries for a period from the date they begin until they finish their work trips and return to their agencies or units (including time of journey and stay in work-trip destinations).
Stay allowance payable to a person on work trip: VND 200,000/day.
For a work trip within a day, the head of an agency or unit shall decide the level of stay allowance based on the actual number of hours of the work trip, the work time outside working hours (including the time of journey) and the distance from the agency or unit to the work-trip destination, which must be included in the internal spending regulations of the agency or unit.
2. Officials, public employees and contractual employees working on the mainland who are sent on work trips at sea or on islands are entitled to the maximum stay allowance of VND 250,000/person/day of actual work trip (applicable to days during which they work at sea or on islands and travel days at sea or to and from islands). In specific sectors for which allowances for work trips at sea or on islands have been stipulated by competent authorities, the highest allowance level (stay allowance or work trip allowance) may be applied to payment to persons on work trips.

Thus, the level of stay allowance for officials on annual leave is determined at VND 200,000/day.

In case of going to the sea, island, sea or island, the traveling allowance is VND 250,000/person/day.

What are the conditions and time limit for payment of traveling allowance in Vietnam?

Pursuant to Point 2.1, Clause 2, Article 4 of Circular No. 141/2011/TT-BTC as amended by Clause 3, Article 1 of Circular No. 57/2014/TT-BTC as follows:

2. Conditions, time limit, payment procedures:
2.1. Conditions, time limit for payment:
a) Money spent on vehicles of annual leave will be paid once for every year.
b) Cadres and officials may agree with the heads of agencies or units to take a lump-sum leave every three years and only be paid once for the annual leave as prescribed in Article 4 of this Circular.

Thus, the conditions and time limit for payment of transport expenses and traveling allowance comply with the above provisions.
