Vietnam: The latest procedures for issuance medical examination and treatment practice licenses announced under the Decree 96/2023/ND-CP?

On January 18, 2024, the Ministry of Health issued Decision 159/QD-BYT in 2024 on the announcement of new administrative procedures, replacement of administrative procedures, and abolition within the scope of the management functions of the Ministry of Health as regulated in the Law on Medical Examination and Treatment in 2023 on January 9, 2023, and Decree 96/2023/ND-CP on December 30, 2023 of the Government detailing some provisions of the Law on Medical Examination and Treatment.

The Ministry of Health of Vietnam has announced 36 new administrative procedures issued in the field of medical examination, treatment, and scientific research, including:

- Announcement of healthcare facilities that meet the requirements as instructional practice facilities.

- Issuance of new professional licenses for the titles of doctors, nurses, midwives, medical technicians, clinical nutritionists, peripheral emergency care practitioners, and clinical psychologists.

- Re-issuance of professional licenses for the titles of doctors, nurses, midwives, medical technicians, clinical nutritionists, peripheral emergency care practitioners, and clinical psychologists.

- Extension of professional licenses for the titles of doctors, nurses, midwives, medical technicians, clinical nutritionists, peripheral emergency care practitioners, and clinical psychologists.

- Adjustment of professional licenses.

- Issuance of new professional licenses for the titles of traditional medicine practitioners, individuals with traditional medicines, or traditional treatment methods.

- Re-issuance of professional licenses for the titles of traditional medicine practitioners, individuals with traditional medicines, or traditional treatment methods.

- Extension of professional licenses for the titles of traditional medicine practitioners, individuals with traditional medicines, or traditional treatment methods.

- Registration of professional activities.

- Revocation of professional licenses in cases stipulated in Article 35, Clause 1 of the Law on Medical Examination and Treatment in 2023.

- Consideration of recognition of professional licenses issued by competent foreign agencies and organizations.

- Issuance of new licenses for healthcare examination and treatment activities.

- Re-issuance of licenses for healthcare examination and treatment activities.

- Adjustment of licenses for healthcare examination and treatment activities.

- Announcement of eligibility for health examination, HIV/AIDS examination, and treatment.

- Issuance of certificates of registration for evaluation and certification of the quality of healthcare facilities.

- Supplementary issuance and modification of certificates of registration for evaluation and certification of the quality of healthcare facilities.

- Re-issuance of certificates of registration for evaluation and certification of the quality of healthcare facilities.

- Permitting the organization of medical missions, mobile healthcare examination and treatment, as stipulated in Article 79, Clause 1 of the Law on Medical Examination and Treatment in 2023, or individual humanitarian medical activities.

- Permitting foreigners to transfer medical examination and treatment techniques or cooperate in medical training with practical experience in medical examination and treatment.

- Announcing the conditions for remote medical examination and treatment.

- Permitting the implementation of experimental remote medical examination and treatment.

- Classification of technical expertise.

- Identifying new techniques and methods, including clearly defining cases where new techniques require clinical trials, experimentation, or official application.

- Permitting the implementation of new techniques and methods in medical examination and treatment.

- Permitting the experimental application of new techniques and methods.

- Approving the research and clinical trial of new techniques and methods.

- Approving the modification of research and clinical trials of new techniques and methods.

- Issuance of new professional licenses for the transition period for applications submitted from January 1, 2024, until the time of professional competency assessment for the titles of doctors, nurses, midwives, medical technicians, clinical nutritionists, peripheral emergency care practitioners, and clinical psychologists.

- Re-issuance of professional licenses for cases issued before January 1, 2024, for applications submitted from January 1, 2024, until the time of professional competency assessment for the titles of doctors, nurses, midwives, medical technicians, clinical nutritionists, peripheral emergency care practitioners, and clinical psychologists.

- Extension of professional licenses for the transition period for applications submitted from January 1, 2024, until the time of professional competency assessment for the titles of doctors, nurses, midwives, medical technicians, clinical nutritionists, peripheral emergency care practitioners, and clinical psychologists.

- Adjustment of professional licenses for the transition period for applications submitted from January 1, 2024, until the time of professional competency assessment for the titles of doctors, nurses, midwives, medical technicians, clinical nutritionists, peripheral emergency care practitioners, and clinical psychologists.

- Issuance of certificates of education facilities that meet the requirements for language proficiency in Vietnamese or other languages, or sufficient interpreting skills in medical examination and treatment.

- Language proficiency assessment and recognition in medical examination and treatment.

- Recognition of language proficiency in Vietnamese or other languages, or sufficient interpreting skills in medical examination and treatment.

What are the principles of provision of medical services in Vietnam?

Pursuant to the provisions of Article 3 of the Law on Medical Examination and Treatment 2023, it is clearly stated as follows:

Principles of provision of medical services
1. Respect, protect, and treat patients equally, and stop stigma or discrimination towards patients.
2. Give priority to have access to medical services to patients in a state of emergency; children aged under 6 years; pregnant women; people with extremely severe disabilities; people with severe disabilities; people aged 75 years or older; people rendering meritorious services to the revolution, depending on the particular characteristics of each medical establishment.
3. Respect, cooperate with and protect practitioners and other persons on duty at medical establishments.
4. Promptly implement and comply with regulations on professional and technical expertise in healthcare.
5. Comply with the code of professional ethics in the practice of medicine approved by the Minister of Health.
6. Ensure equality and fairness among medical establishments.

Thus, principles of provision of medical services are implemented according to the above regulations.
