According to Decision 706/QD-BGTVT in 2022 on the re-announcement of Long Binh inland waterway port

"Article 1. Announcement of Long Binh inland waterway port to receive Vietnamese and foreign watercraft with a full tonnage of up to 5,000 tons at wharves No. 1, No. 2, No. 3. Other contents according to Decision No. 1575/QD-BGTVT dated August 10, 2020 of the Minister of Transport.
Article 2. In the course of port operation, Southern Rivers Corporation is responsible for strictly complying with current regulations on management of port operations and inland waterway terminals and Decision No. 1575/QD-BGTVT dated August 10, 2020 of the Minister of Transport.
Article 3. Region III Inland Waterway Port Authority is responsible for specialized state management at the port and collects fees and charges as prescribed."

Thus, from June 6, 2022, the Minister of Transport of Vietnam announced that Long Binh inland waterway port will receive Vietnamese and foreign watercraft with a full tonnage of up to 5,000 tons at wharfs number 1, 2, and 3.

According to Clause 1, Article 18 of Decree No. 08/2021/ND-CP on management of inland waterway activities, stipulating the competence to announce activities of inland waterway ports and wharves:

- Authority to announce activities

- The agency that negotiates the technical specifications for the construction of inland waterway ports and wharves specified in Clause 2, Article 15 of this Decree is concurrently the agency competent to announce the operation of inland waterway ports and wharves.

Procedure for announcing the operation of an inland waterway port?

According to Clause 2, Article 18 of Decree 08/2021/ND-CP stipulating the management of inland waterway activities, the documents and procedures for announcing the operation of inland waterway ports are:

- Dossier to announce the operation of inland waterway ports

+ An application form for announcement of inland waterway port operations, made according to Form No. 12 in the Appendix to this Decree;

+ A certified copy or a copy and presentation of the original for comparison of the competent agency's written approval of the investment project on construction of an inland waterway port;

+ A certified copy or a copy and presentation of the original for comparison of documents on land use for construction of an inland waterway port issued by a competent authority;

+ A copy of the decision approving the project or the technical design of the inland port facility;

+ Minutes of acceptance of completed construction and put into use; as-built drawings of the ground, vertical projection and cross-section of the inland waterway port;

+ Minutes of acceptance of results of detecting obstacles in port waters; record of confirmation of signal establishment at the port;

+ A copy of the certificate of technical safety and environmental protection of the pontoon and mooring buoy subject to registration (if the pontoon is used as a wharf);

+ Written acceptance of fire prevention and fighting issued by competent authorities as prescribed;

+ A copy of the certificate of conformity with the security of the inland waterway port receiving foreign watercraft (for the inland waterway port receiving foreign watercraft);

+ A copy of the competent authority's decision to announce the opening of a dedicated channel (if any) for an inland waterway port with a dedicated channel.

- Order of activity announcement

+ Before putting an inland waterway port or wharf into operation, the owner of an inland waterway port or wharf shall submit, directly or by another suitable form, 01 set of documents to the Vietnam Inland Waterway Administration (for inland waterway ports). inland receiving foreign watercraft on national inland waterways, specialized inland waterways connected to national inland waterways and inland waterways ports specified at Point b, Clause 2, Article 15 of this Decree). Department of Transport (for inland waterway ports receiving foreign watercraft on local inland waterways, specialized inland waterways connected to local inland waterways and specified inland waterway ports and wharves). at Point c, Clause 2, Article 15 of this Decree) requesting the announcement of activities;

+ For inland waterway ports receiving foreign watercraft: Within 05 working days from the date of receipt of a complete dossier as prescribed, the Vietnam Inland Waterway Administration and the Department of Transport shall appraise the application, if eligible, report to the Ministry of Transport of Vietnam. Within 05 working days from the date of receipt of complete dossiers and appraisal report, the Ministry of Transport of Vietnam shall issue a decision to announce the operation of inland waterway ports;

+ For inland waterway ports that do not accept foreign watercraft: Within 05 working days from the date of receipt of a complete dossier as prescribed, the Vietnam Inland Waterway Administration or the Department of Transport shall issue it decide to announce the operation of inland waterway ports ;

+ For inland wharves: Within 5 working days from the date of receipt of a complete filing as prescribed, the Department of Transport shall issue a decision to announce the operation of the inland wharf.

- Announcement of an inland waterway port to receive foreign watercraft at an inland waterway port that has been announced to operate

+ In case an inland waterway port has been announced for operation, if there is a need to receive foreign watercraft, the port owner shall send a written report to the Ministry of Transport; The Ministry of Transport of Vietnam collects opinions from the Ministry of National Defense, the Ministry of Public Security and the People's Committee of the province on assurance of national defense and security for inland waterway ports according to the provisions of Point a, Clause 5, Article 15 of this Decree . Within 02 working days from the date of receipt of a written agreement from the Ministry of National Defense of Vietnam, the Ministry of Public Security of Vietnam, the provincial People's Committee, the Ministry of Transport of Vietnam shall issue a written approval of the inland waterway port to receive the means of transport. foreign ships to the port owners;

+ The port owner sends the application for announcement of the inland waterway port according to the provisions of Points a and i, Clause 2 of this Article to the Ministry of Transport of Vietnam. Within 05 working days from the date of receipt of the port owner's dossier, the Ministry of Transport of Vietnam shall issue a decision to announce the operation of an inland waterway port to receive foreign watercraft.
