Pursuant to the provisions of Article 15 of Decree 73/2023/ND-CP as follows:

Responsibilities of the agency using officers

1. Timely review and approve innovative and creative proposals per the provisions of Article 8 of this Decree.

2. Respect, encourage, and motivate the proposing officers and the individuals, groups, or organizations implementing the proposal. Assign appropriate tasks during the implementation of the proposal by the officers, individuals, or organizations.

3. Ensure conditions, promptly invest in, and fully equip the necessary equipment and means for work; arrange the organizational structure, personnel, and budget for the approved proposal.

4. Implement necessary measures according to legal regulations to protect the officers, individuals, and organizations from obstacles and difficulties during and after the implementation of the innovative and creative proposal approved by competent authorities.

5. Regularly direct, guide, monitor, inspect, promptly resolve, and address issues regarding mechanisms and resources; consider adjustments suitable to the actual situation; detect and rectify violations (if any); require remediation of arising consequences (if any); provide objective, comprehensive, transparent evaluations of the achieved results; conduct periodic reviews and summaries; intensify communication, create social consensus, and expand effective models and practices.

6. Be accountable for approving the proposal; for not monitoring and inspecting the implementation of the proposal, or for not promptly monitoring, inspecting the implementation comprehensively and objectively without requiring the suspension or termination of the proposal, leading to damage.

7. Timely encouragement and protection of officers with innovative and creative proposals, and the officers, individuals, and organizations implementing the innovative and creative proposals within their authority, or propose to competent authorities to apply encouragement and protection measures as stipulated in Articles 10 and 11 of this Decree.

8. Annually, compile and report to the management agency on the implementation of encouraging and protecting dynamic and creative officers as prescribed in this Decree.

9. The agency and the head of the agency using officers are responsible for storing documents related to the innovative and creative proposals as per archival law regulations.

Officers implementing innovative and creative proposals that do not fully achieve or only partially achieve the set objectives but are assessed by the using agency as having complied with policies, having clear motives, and acting for the common good as stipulated in point b, Clause 2, Article 5 of this Decree, shall be exempted from liability under relevant laws.

3. Officers implementing innovative and creative proposals that do not fully achieve or only partially achieve the set objectives, causing damage, but are assessed by the using agency as having complied with policies, having clear motives, and acting for the common good as stipulated in point b, Clause 2, Article 5 of this Decree, shall be considered for liability exemption, reduction, or mitigation under relevant laws.

- Fulfill the responsibilities of the agency using officers.

- Emphasize the role and responsibility in encouraging and protecting the proposing officers and the individuals, groups, or organizations implementing the proposal; do not abuse power in resolving matters within their authority during the implementation of the proposal by the officers, individuals, or organizations.

- Report in writing to the party committee and the equivalent party organization on issues arising during the implementation (if any) and the evaluation of the proposal's results.

- Proactively guide and create consensus among the agency's leadership in organizing the implementation of the proposal.

- When necessary, based on the assessment results of the agency's leadership collective and councils, issue documents within their authority or propose to competent authorities to issue legal documents related to the innovative and creative proposal.
