Is it possible to apply for the replacement of a citizen ID card in Vietnam if the date of birth specified in the issued card is incorrect?

Under point d, clause 1, Article 23 of the Law on Citizen Identification 2014, the cases for changing the ID card are as follows:

Cases of replacement and reissuance the Citizen ID card

1. The Citizen ID card shall be replaced in the following cases:

a) Cases stipulated in clause 1, Article 21 of this Law;

b) The card is damaged and cannot be used;

c) Change in information regarding family name, middle name, first name; physical characteristics;

d) Gender reassignment, change in place of origin;

dd) Errors in information on the Citizen ID card;

e) Upon request from the citizen.

2. The Citizen ID card shall be re-issued in the following cases:

a) The Citizen ID card is lost;

b) Reacquisition of Vietnamese nationality under the Law on Vietnamese Nationality.

If the date of birth specified in the issued card is incorrect, the citizen must contact the issuing authority to have the card replaced in accordance with the provisions.

Under point c, clause 2, Article 5 of Circular 59/2019/TT-BTC, the cases of fee exemption and non-payment are as follows:

Cases of fee exemption and non-payment

1. Cases of fee exemption

a) Changing the citizen identity card when the State changes the administrative boundaries;

b) Replacement and reissuance the citizen identity card for citizens who are the father, mother, spouse, children under 18 of martyrs; war invalids, those entitled to the same policies as war invalids; children under 18 of war invalids and those entitled to the same policies as war invalids; sick soldiers; citizens residing permanently in border communes; citizens residing permanently in island districts; ethnic minorities in particularly difficult socio-economic communes; citizens belonging to poor households under the law;

c) Replacement and reissuance the citizen identity card for citizens under 18 who are orphans of both parents and have no one to rely on.

2. Cases of non-payment

a) Citizens who are 14 years old and older making first-time citizen identity card procedures according to the provisions of clause 1, Article 19, clause 2, Article 32 of the Law on Citizen Identification;

b) Changing the citizen identity card according to the provisions of Article 21 and point a, clause 3, Article 32 of the Law on Citizen Identification;

c) Changing the citizen identity card when there are errors in the information on the citizen identity card caused by the error of the Citizen Identification management authority.

Therefore, applicants for the replacement of citizen ID cards due to the fault of the identification-managing authority in Vietnam arre not required to pay fees.

What are the procedures for the replacement of the citizen ID card in Vietnam?

According to Article 11 of Circular 59/2021/TT-BCA, the procedures for the issuance, replacement, and reissuance of the chip-based citizen ID card are stipulated as follows:

Procedures for the issuance, replacement, and reissuance of the Citizen ID card

1. Citizens shall go to the competent police authority where they are permanently or temporarily residing to request the issuance, replacement, and reissuance of the Citizen ID card.

2. Police officers at the receipt authority shall collect citizen information: Search for citizen information in the national database on population; select the type of issuance and describe physical characteristics; collect fingerprints; take portrait photos; print the citizen ID card information collection form, the population information collection form (if any), the form for updating and correcting population information (if any) for the citizen to check, sign, and clearly write their name; collect the fee as prescribed; issue a receipt with a deadline for returning the results.

3. Collect the old ID card or Citizen ID card in use if the citizen applies for conversion from the old ID card to the Citizen ID card or requests replacement of the Citizen ID card.

4. Search the archives of citizen identification to verify citizen information (if any).

5. Process and approve the application for issuance, replacement, and reissuance of the Citizen ID card.

6. Return the Citizen ID card and the result of the issuance, replacement, and reissuance. In cases where citizens register for the Citizen ID card to be delivered to a specified address, the police authority shall list and cooperate with the delivery service unit to perform this task, and citizens shall bear the delivery fee as prescribed.
