In which cases can bodies, organizations and titles of the state re-register their seal samples in Vietnam? What is the application for re-registration of the seal sample when it is lost?
Pursuant to the provisions of Article 15 of Decree No. 99/2016/ND-CP, state bodies, organizations and titles may re-register their seal samples in the following cases:
- The seal is deformed, worn-out, damaged or has changed material;
- Bodies, organizations or titles of the State have change of organization or name;
- Bodies, organizations or titles of the State lose their seals.
In case of loss of seal, the state agency, organization or title must prepare a dossier for re-registration of the seal according to the provisions of Clause 3, Article 15 of Decree No. 99/2016/ND-CP, subsection 2 Section B Part II Administrative procedures promulgated together with Decision No. 3191/QD-BCA in 2022 as follows:
- For the person appointed to submit the application:
+ Letter of introduction or power of attorney;
+ Citizen ID card or valid ID card or Passport.
- For bodies, organizations and titles of the state that have lost their seals:
+ A written request for re-registration of the seal sample of the agency, organization or title of the state using the seal, clearly stating the reason and certified by the direct management agency or competent authority;
+ Certificate of seal sample registration issued previously.
In which, the following should be noted:
- For dossiers submitted directly: Documents and papers included in the dossiers are originals or certified copies or copies enclosed with the originals for comparison by the receiving officer in accordance with law.
- For dossiers submitted online: documents and papers in the dossier are electronic documents signed digitally by a competent person and digitally signed by bodies or organizations as prescribed by law (electronic documents in PDF format).

What are the procedures for re-registration of the seal sample in case of loss?
Procedures for re-registration of seal samples in case of loss of state bodies, organizations or titles are now carried out according to subsection 2, Section B, Part II Administrative procedures promulgated together with Decision No. 3191/QD-BCA in 2022.

Step 1 | A state agency, organization or title that wishes to re-register the seal sample due to its lost seal shall submit the following dossier: - Direct - Or via postal service at the Police Department for administrative management of social order - Ministry of Public Security during office hours on weekdays. - Or apply online through the National Public Service Portal or the Public Service Portal of the Ministry of Public Security. |
Step 2 | The receiving officer checks the validity and composition of the dossier. - If the dossier is valid and has sufficient components, the dossier shall be received for settlement and sent a receipt of the dossier directly or by postal service or by email (if any) to the person assigned by the agency, organization, or organization. The title of the state sent to contact to submit the application. - If the dossier is invalid or lacks components, the dossier shall not be accepted and the Instructions for completing the dossier shall be sent directly or via postal service or by email (if any) to the person assigned by the agency or organization. Step 3 | Based on the appointment date on the application receipt, the person who is sent by an agency, organization or title to submit the application file will receive the results directly or receive the results via postal service, including the seal and the Certificate of seal sample registration. |
If the lost seal has been found after its use value was destroyed, will it be revoked?
In Clause 1, Article 18 of Decree No. 99/2016/ND-CP on handover, recovery or cancellation of seal and cancellation of seal use value as follows:
Handover, recovery or cancellation of seal and cancellation of seal use value
1. The bodies, organizations or titles of the State shall have to hand over their seal to the seal sample registration body specified in Article 12 of this Decree in the following cases:
a) Re-registration of seal sample due to its deformation, wear-out, damage, change of material or when the bodies, organizations or titles of the State have change of their organizations or names;
b) There is a decision on division, separation, merger, consolidation, dissolution, operational termination or duty termination from the competent authorities;
c) There is a decision on recovery of establishment and operation, operation registration certificate or operation permit from the competent authorities;
d) The lost seal has been found after its use value was destroyed;
dd) There is a decision on temporary suspension or suspension of operation from the competent authorities;
e) The cases specified in Paragraphs , 2, 3, 4, 5, 6, 7 and 8, Article 6 of this Decree.
Thus, it can be seen that, according to the above provisions, for a lost seal found after its use value has been destroyed, the bodies, organizations or titles of the State shall have to hand over their seal to the seal sample registration body.
