What are the required documents for establishing the school council of a pedagogical college in Vietnam?

According to the provisions of Clause 4, Article 9 of the Charter of Pedagogical Colleges (hereinafter referred to as the Charter) issued together with Circular 23/2022/TT-BGDDT:

Procedures for establishing the school council; appointing, dismissing the Chairperson of the school council; temporarily suspending the work of the Chairperson of the school council and members; recognizing and dismissing other members of the school council

4. The application for the establishment of the school council and the appointment of the Chairperson of the school council includes:

a) A statement on the establishment of the school council, clearly stating the process for identifying members of the school council;

b) The list and résumés of the Chairperson of the school council, members of the school council; documents from the school’s managing agency appointing members to the school council; documents agreeing to join the school council and consent from the managing agency or organization for members outside the school; meeting minutes, vote counting records, ballots for the Chairperson of the school council and voting ballots for internal and external members, copies of diplomas, certificates of the person proposed for the position of Chairperson of the school council, and related supporting documents (if any).

Thus, the dossier proposing the establishment of the school council for a pedagogical college includes:

- A statement on the establishment of the school council, clearly stating the process for identifying members of the school council;

- The list and résumés of the Chairperson of the school council, members of the school council; documents from the school’s managing agency appointing members to the school council; documents agreeing to join the school council and consent from the managing agency or organization for members outside the school; meeting minutes, vote counting records, ballots for the Chairperson of the school council and voting ballots for internal and external members, copies of diplomas, certificates of the person proposed for the position of Chairperson of the school council, and related supporting documents (if any)

What are the procedures for establishing the school council of a pedagogical college in Vietnam?

According to the provisions of Clauses 1 and 2, Article 9 of Circular 23/2022/TT-BGDDT on the establishment of the school council of a pedagogical college:

Establishing the school council and appointing the Chairperson of the school council for pedagogical colleges that do not yet have a school council:

- Based on the provisions of Article 8 of this Charter and other relevant current legal regulations, the school leadership collectively meets to agree on policies, plans, and contents; assigning tasks to each member of the school leadership to direct and implement the establishment of the school council under regulations;

- Based on the provisions of Clause 2, Article 8 of this Charter and the policies and plans established by the school leadership, the school leadership collectively meets with ex officio members to determine the total number of school council members and the number of members for each section in the school council;

- Determine the quantity and structure to introduce personnel for voting in each section to participate in the school council;

- Afterwards, agree on the implementation steps for voting for the school council;

- The principal signs a document requesting the school’s managing agency to appoint representatives to the school council;

- Organize voting for internal and external members (subject to voting) as follows:

+ The principal directs specialized departments and corresponding units (if any) to introduce personnel being the school’s lecturers to vote for internal school council members being lecturers according to the determined structure and introduce personnel being external members to vote for external school council members according to the determined structure;

​+ Functional departments, research and development organizations, practice schools, public service providers, production, business, service establishments (if any) introduce personnel being public employees of the school (excluding lecturers) to vote for internal school council members being public employees according to the determined structure and introduce personnel being external members to vote for external school council members according to the determined structure.

The principle for introducing personnel for voting must ensure an excess number, and the personnel selected are based on the highest vote results down to the necessary number through the key staff conference of units (heads of specialized departments and equivalents or heads of functional departments and equivalents); the school leadership participates in the key staff conference of units to introduce personnel for voting as per the assigned units (departments, departments, and equivalents) under direct management and responsibility.

+ Based on the introduction results of voting personnel (for external personnel, there must be written consent to participate in the school council from the personnel and approval from the managing agency or organization), the school leadership reports the list of voting personnel to the CPV committee of the school.

​+ After the list is approved by the CPV committee, the principal organizes voting for internal and external members through the school delegates' conference, where the delegate participation rate must be over 50% of the total number of the school’s staff, lecturers, public employees, and employees;

+ Persons elected as members of the school council must obtain over 50% of valid votes in favor and are selected from the highest votes down to the necessary number of members.

+ The delegate participation rate must be regulated in the organizing and operating regulations of the school;

+ If the organizing and operating regulations have not been stipulated or the school has not issued the regulations, the school leadership must reach a consensus with the school’s managing agency representatives and other ex officio members of the school council for implementation;

+ After establishment, the school council must revise, supplement or issue new organizing and operating regulations according to the Law on Vocational Education, provisions on democratic practice at workplaces of the Government of Vietnam, guidance regulations on implementing democracy in public education institutions, the Charter, and other current legal regulations, including the above contents;

- Based on the results of electing internal and external members, the principal reports the list of school council members to the CPV committee of the school. After the list is approved by the CPV committee, the principal organizes a meeting of all school council members (including ex officio and elected internal and external members) to elect the Chairperson of the school council (according to Item a, Clause 3, Article 8 of this Charter);

- Personnel introduced for election as Chairperson of the school council must meet standards and conditions similar to the principal (stipulated in Article 10 of this Charter).

Based on the resolutions at this meeting, the principal sends a document (submission) to propose the managing agency of the school issue a decision to establish the school council and appoint the Chairperson of the school council;

- The Chairperson of the school council appointed by the managing agency of the school presides over the school council meeting to elect the Secretary of the school council (according to Clause 4, Article 8 of this Charter) and passes a resolution. Based on the resolutions at this meeting, the Chairperson of the school council issues a decision to appoint the Secretary of the school council.

Establishing the school council and appointing the Chairperson for pedagogical colleges that already have a school council

- Three months before the end of the term, the incumbent Chairperson of the school council calls a meeting of the school leadership collective (including members as stipulated in Clause 2 of this Article) to implement the provisions in Clause 1 of this Article.

- At the same time, report to the school’s managing agency to establish the school council and appoint the Chairperson for the next term as per the Charter, organizing and operating regulations of the school, and other current legal regulations;

- At least 30 working days before the end of the term, the incumbent school council is responsible for completing and sending one set of documents as stipulated in Clause 4 of this Article to the school’s managing agency to issue a decision to establish the school council and appoint the Chairperson for the new term.

Note: The school leadership collective stipulated in this Charter includes the standing committee of the CPV committee or the committee (if there is no standing committee), the principal, the vice-principals, and the Chairperson of the school council (if any).

The school leadership collective is presided over by the Chairperson of the school council or the principal (when there is no Chairperson), operating on the principle of collective decision-making by the majority; if the number is even, the decision will follow the opinion of the presiding side.

Is the principal of a pedagogical college in Vietnam required to hold a master's degree?

According to the provisions of Clause 1, Article 10 of Circular 23/2022/TT-BGDDT regarding the standards and conditions to become the Principal of a pedagogical college:

Principal

1. The standards, conditions, roles, positions, tasks, powers, and terms of the principal of a pedagogical college are in accordance with the Law on Vocational Education; the regulations on recruitment, use, and management of public employees of the Government of Vietnam, and the specific provisions as follows:

a) The principal of a pedagogical college must have scientific and educational credibility; hold a master's degree or higher, including at least one bachelor's degree or higher in the Educational Science and pedagogy training sector, and have at least 5 years of teaching or managing at the departmental level or higher in pedagogical colleges or universities, or have at least 5 years of educational management at the departmental level or higher in educational management agencies from the provincial level upwards; have undergone training and retraining in educational management assessed as satisfactory or higher by the training institution, possessing school management capacity; before appointment, the principal must have been evaluated as successfully completing tasks for at least 3 consecutive years.

b) In case an appointment is made from another agency or organization to the position of Principal of a pedagogical college, the competent management authority must undertake legal procedures to make the principal an official of the pedagogical college.

Thus, the Principal of a pedagogical college must have scientific and educational credibility;

- Hold a graduation degree at least at the master's level, including:

+ Have at least one bachelor's degree or higher in the Educational Science and pedagogy training sector

+ Have at least 5 years of teaching or managing at the departmental level or higher in pedagogical colleges or universities, or have at least 5 years of educational management at the departmental level or higher in educational management agencies from the provincial level upwards;

+ Have undergone training and retraining in educational management assessed as satisfactory or higher by the training institution, possessing school management capacity; before being appointed, the principal must have been evaluated as successfully completing tasks for at least 3 consecutive years.

Circular 23/2022/TT-BGDDT takes effect from February 14, 2023.
