Structure of the Farmers Support Fund: Organizational Provisions and Management Council's Duties and Powers.
How is the Organizational Structure of the Farmer Support Fund Defined?
Based on the provisions of Article 9 Decree 37/2023/ND-CP, the organizational structure is defined as follows:
Organizational Structure of the Farmer Support Fund
1. The organizational structure of the Farmer Support Fund includes:
a) Board of Management;
b) Supervisory Board;
c) Executive Board consisting of: Director, Deputy Directors, Chief Accountant, and supporting apparatus.
2. The authority to decide on planning, appointment, reappointment, resignation, dismissal, transfer, rotation, commendation, and discipline of the managers of the Farmer Support Fund as stipulated in Articles 10, 11, and 12 of this Decree, the organizational and operational charter of the Farmer Support Fund, and the guiding documents of the Vietnam Farmers' Union (if any).
According to the above regulation, the organizational structure of the Farmer Support Fund includes:
- Board of Management;
- Supervisory Board;
- Executive Board.

How Many Members Are in the Board of Management of the Farmer Support Fund?
Based on the provisions of Article 10 Decree 37/2023/ND-CP, the regulation is as follows:
Board of Management of the Farmer Support Fund
1. The Board of Management of the Central Farmer Support Fund has a maximum of 05 members who are concurrent officers of the Central Farmers' Union, including:
a) The Chairman of the Board of Management of the Central Farmer Support Fund is the Vice Chairman of the Central Vietnam Farmers' Union;
b) One member of the Board of Management is the Director of the Central Farmer Support Fund;
c) Other members of the Board of Management are appointed by the Standing Committee of the Central Farmers' Union.
2. The Board of Management of the Provincial Farmer Support Fund has a maximum of 05 members who are concurrent officers of the Provincial Farmers' Union, including:
a) The Chairman of the Board of Management of the Provincial Farmer Support Fund is the Vice Chairman of the Provincial Farmers' Union;
b) One member of the Board of Management is the Director of the Provincial Farmer Support Fund;
c) Other members of the Board of Management are appointed by the Standing Committee of the Provincial Farmers' Union; in necessary cases, the Provincial People's Committee may assign a representative from a local department or agency to join the Board of Management of the Provincial Farmer Support Fund.
3. The Board of Management of the District Farmer Support Fund has a maximum of 03 members who are concurrent officers of the District Farmers' Union, including:
a) The Chairman of the Board of Management of the District Farmer Support Fund is the Vice Chairman of the District Farmers' Union;
b) One member of the Board of Management is the Director of the District Farmer Support Fund;
c) Other members of the Board of Management are appointed by the Standing Committee of the District Farmers' Union, working concurrently; in necessary cases, the District People's Committee may assign a representative from a local office to join the Board of Management of the District Farmer Support Fund.

The members of the Board of Management of the Farmer Support Fund are defined as follows:
- The Board of Management of the Central Farmer Support Fund: a maximum of 05 members who are concurrent officers of the Central Farmers' Union.
- The Board of Management of the Provincial Farmer Support Fund: a maximum of 05 members who are concurrent officers of the Provincial Farmers' Union.
- The Board of Management of the District Farmer Support Fund: a maximum of 03 members who are concurrent officers of the District Farmers' Union.
What Are the Duties and Powers of the Board of Management of the Farmer Support Fund?
Based on the provisions in Clause 9, Article 10 Decree 37/2023/ND-CP, the duties and powers are defined as follows:

9. The duties and powers of the Board of Management include:
a) Receiving, managing, and using the capital of the Farmer Support Fund in accordance with the law and the Charter for the organization and operation of the Farmer Support Fund; accountable to the Standing Committee of the same level Farmers' Union for the tasks and powers assigned;
b) Developing annual, medium-term, and long-term activity and financial plans of the Farmer Support Fund, submitting them to the Standing Committee of the same level Farmers' Union for approval;
c) Issuing or amending operational and other internal regulations as stipulated in the Charter for the organization and operation of the Farmer Support Fund;
d) Supervising and inspecting the Executive Board of the Farmer Support Fund in the implementation of legal policies and the decisions of the Board of Management;
e) Deciding on the lending interest rates of the Farmer Support Fund during each period as specified in Article 16 of this Decree;
f) Approving loans, deciding on capital mobilization plans, and handling risks within their jurisdiction;
g) Approving financial reports, distributing revenue and expenditure differences, and setting up annual funds of the Farmer Support Fund after receiving comments and assessments from the Supervisory Board to submit to the same level Farmers' Union Standing Committee for approval;
h) Submitting to the same level Farmers' Union Standing Committee for decision-making the issuance, amendment, and supplementation of the Charter for the organization and operation of the Farmer Support Fund;
i) Submitting to the same level Farmers' Union Standing Committee for approval of the personnel arrangement plan to establish the operational apparatus of the Farmer Support Fund;
k) Issuing or amending operational regulations, assigning tasks to members of the Board of Management of the Farmer Support Fund;
l) Other duties and powers as stipulated in the Charter for the organization and operation of the Farmer Support Fund.
The Board of Management of the Farmer Support Fund has the duties and powers as defined above.
Decree 37/2023/ND-CP will take effect from August 8, 2023.
