The units stipulated from items 1 to 20 of this Article are organizations that assist the Minister in performing state management functions; the units stipulated from items 21 to 26 of this Article are public service providers under the Ministry. The Minister of Information and Communications stipulates the functions, tasks, powers, and organizational structure of attached units as prescribed by law.”
Currently, the organizational structure of the Ministry of Information and Communications includes 26 units as listed above.
According to previous regulations, the Vietnam Ministry of Information and Communications had up to 28 units. Some units such as the Enterprise Management Department and the Vietnam Post Newspaper are no longer operating under the new regulations.

Under Clause 12, Article 2 of Decree 48/2022/ND-CP:
“Article 2. Tasks and powers
…
12. Regarding telecommunications
a) Guide, direct, and organize the implementation of planning, plans, programs, mechanisms, and policies for the development of telecommunications, Internet, and digital infrastructure (broadband telecommunications infrastructure, cloud computing infrastructure, Internet of Things infrastructure); manage the telecommunications market; issue and regulate lists, scopes, subjects, pricing of public telecommunications services, and mechanisms and levels of support for enterprises to invest in telecommunications infrastructure, digital infrastructure, and provide public telecommunications services as prescribed by law; organize the implementation of the public telecommunications service provision program and public telecommunications tasks assigned by the State;
b) Lead in formualting and organizing the implementation of regulations on competition in the field of telecommunications, telecommunications applications, and the Internet; protect the rights of users of telecommunications services, telecommunications applications, and the Internet as prescribed by law;
c) Issue, extend, modify, supplement, suspend, revoke various telecommunications licenses as prescribed by law;
d) Issue and implement planning and regulations on the management and use of telecommunications number resources and domain names, Internet addresses; allocate, revoke telecommunications number resources and domain names, Internet addresses; develop, submit to competent authorities for issuance, and organize the implementation of regulations on auctioning, transferring the right to use telecommunications number resources, Internet domain names; provide detailed regulations on the auction of telecommunications number resources, Internet resources, and the list of telecommunications number resources, Internet resources subject to auction;
dd) Issue mechanisms, policies, regulations, and organize the implementation of management of telecommunications service charges and promotions in the field of telecommunications and the Internet as prescribed by law; control, suspend the application of telecommunications charges when telecommunications enterprises impose anti-competitive tariffs, causing telecommunications market instability, damaging the legitimate rights and interests of users of telecommunications services, other telecommunications enterprises, and the State. Direct and guide the implementation of reporting, accounting, and auditing policies serving the management of telecommunications and Internet charges;
e) Issue and implement regulations on managing the connection of telecommunications networks;
g) Regulate under its authority and guide the activities of private telecommunications networks serving the Communist Party and State agencies;
h) Guide the construction and implementation of plans and projects for the development of telecommunications network infrastructure, development of digital infrastructure; direct, guide, and inspect the sharing and joint use of telecommunications infrastructure, digital infrastructure;
i) Lead in ensuring infrastructure safety, cooperate with the Ministry of Public Security to ensure information security in telecommunications activities as prescribed by law;
k) Manage telecommunications and Internet service quality; build, manage, and operate telecommunications and Internet sector-specific testing and calibration laboratories as prescribed by law;
l) Establish, manage, operate, and exploit systems for collecting and managing telecommunications data and systems for mobile number portability;
m) Establish, manage, operate, and ensure the safety of national domain name server systems, national Internet exchange points.”
Thus, the Ministry of Information and Communications will have the tasks and powers in the telecommunications sector as stipulated above.

Under Clause 16, Article 2 of Decree 48/2022/ND-CP:
“Article 2. Tasks and powers

16. Regarding cybersecurity
a) Manage cybersecurity; ensure cybersecurity for information systems, information technology application and development activities; prevent spam; ensure personal information safety online; protect children in cyberspace; organize the function of managing and coordinating cybersecurity incident response activities nationwide; lead and coordinate emergency response to assurance about national cybersecuriy and information security as prescribed by law;
b) Manage activities of producing, trading cybersecurity products and services; manage activities of testing, evaluating, certifying cybersecurity; issue, extend, modify, supplement, suspend, revoke business licenses for cybersecurity products and services (excluding civil cryptographic products and services; cybersecurity products and services) as prescribed by law;
c) Manage the quality of cybersecurity products and services (excluding civil cryptographic products and services; cybersecurity products and services) as prescribed by law;
d) Build and operate systems ensuring cybersecurity, national-scale centralized technical infrastructure systems to handle and mitigate cyberattacks, support cybersecurity monitoring for information systems providing online public services, develop the Government of Vietnam electronic services; appraise cybersecurity in the design documents of information systems, the safety level of information systems; manage cybersecurity monitoring as prescribed by law;
dd) Cooperate with the Ministry of Public Security to ensure the security and safety of key projects related to national security in the information technology sector.”
Thus, the Ministry of Information and Communications will have the tasks and powers regarding cybersecurity as stipulated above.
