What categories of tourist accommodation establishments in Vietnam are there?
Pursuant to Article 48 of the 2017 Law on Tourism in Vietnam stipulating the following categories of tourist accommodation establishments:
Categories of tourist accommodation establishments
1. Hotel.
2. Tourist villa.
3. Tourist apartment.
4. Cruise ship.
5. Tourist guest house.
6. Houses with rooms for rent.
7. Tourist campsite.
8. Other tourist accommodation establishments.
At the same time, according to the provisions of Article 21 of Decree No. 168/2017/ND-CP stipulating the following categories of tourist accommodation establishments:
- Hotel: it must satisfy requirements for quality of infrastructure, equipment and services necessary to serve tourists, including hotel resort, motel, floating hotel and city hotel.
+ Hotel resort: it is built in the form of blocks or complex of villas, apartments and low-rise buildings and apartments in areas with beautiful natural landscape;
+ Motel: it is built near roads and has parking lots to serve accommodation demands of tourists who use road vehicle (mopeds, motor vehicles) to travel or take a break during a long drive;
+ Floating hotel: it floats on the surface of the water and is able to move when necessary;
+ City hotel: it is constructed in urban areas.
- Tourist villa: it is built for lease and furnished with all necessary equipment and amenities so that tourists can serve themselves during their stay.
- Tourist apartment: it is furnished with all necessary equipment and amenities so that tourists can serve themselves during their stay.
- Cruise ship: it is a water way vehicle that is equipped with sleeping rooms to serve tourists' accommodation demands.
- Tourist guest house: it is furnished with all necessary equipment and amenities to serve tourists.
- Homestay: it is a house with areas furnished with necessary equipment and amenities to serve tourists' accommodation demands. Tourists live with the house owner’s family.
- Tourist campsite: it is an area planned in areas with beautiful natural landscape and necessary infrastructure and services provided for campers.

What are the conditions for tourist accommodation service business?
Pursuant to Article 49 of the 2017 Law on Tourism in Vietnam, the conditions for tourist accommodation service business are as follows:
- Have registered business in accordance with regulations of law;
- Meet the conditions for security and order, fire prevention and fighting, environmental protection and food safety in accordance with regulations of law;
- Meet the minimum conditions for infrastructure and services provided for tourists.
What are the rights and obligations of owners of the tourist accommodation establishments in Vietnam?
Pursuant to the provisions of Article 53 of the 2017 Law on Tourism in Vietnam stipulating the rights and obligations of owners of the tourist accommodation establishments as follows:
An owner of the tourist accommodation establishment has the following rights:
- Reject any tourist in the cases where he/she acts against the law or regulations of the tourist accommodation establishment or the tourist accommodation establishment is no longer capable of meeting the tourist’s demand;
- Cancel the contract for provision with any tourist that act against the law or regulations of the tourist accommodation establishment.
An owner of the tourist accommodation establishment has the following obligations:
- Maintain the fulfillment of conditions for tourist accommodation service business prescribed in Clause 1, Article 49 of the 2017 Law on Tourism in Vietnam;
- Openly post the prices of goods and services, and regulations of the tourist accommodation establishment.
- Provide compensation for the damage for tourists in accordance with regulations of civil law;
- Send a written notice to the tourism authority of the province where the tourist accommodation establishment is located upon the change in the name, scale and address of the establishment and of the legal representative;
- Only use the word “sao” (“star”) or star shape to advertise the tourist accommodation establishment after it is rated by a competent authority.
- Comply with regulations on reporting, statistics and accounting in accordance with regulations of law.
The owner of a rated tourist accommodation establishment has the following rights and obligations:
- Rights and obligations specified in Clause 1 and Clause 2 Article 53 of the 2017 Law on Tourism in Vietnam;
- Display and advertise the rating plate which shows the exact rating of the establishment.
- Maintain the quality of the tourist accommodation establishment corresponding to its rating and category.
