Circular 82/2023/TT-BQP on the monthly allowance levels for military personnel and cipher officers

On November 3, 2023, the Minister of National Defense issued Circular 82/2023/TT-BQP regulating the adjustment of monthly allowances for military personnel and cipher officers receiving salaries equivalent to those of veterans, discharged, or resigned soldiers.

Pursuant to the provisions of Clause 1, Article 3 of Circular 82/2023/TT-BQP on the calculation method and the level of monthly allowance for military personnel and cipher officers as follows:

- Increase the monthly allowance by 12.5% over the monthly allowance for June 2023 for the subjects specified in Clause 1, Clause 2, Article 2 of Circular 82/2023/TT-BQP.

The formula for calculating the monthly allowance for military personnel and cipher officers receiving salaries equivalent to those of veterans, discharged, or resigned soldiers is stipulated as follows:

The monthly allowance from July 2023 = The monthly allowance of June 2023 * 1.125.

In addition, according to Clause 2, Article 3 of Circular 82/2023/TT-BQP, the monthly allowance for the following subjects is regulated:

- Veterans and discharged soldiers currently receiving monthly allowances according to Decision 142/2008/QD-TTg of the Prime Minister of Vietnam on implementing policies for military personnel who participated in the resistance war against the United States but have less than 20 years of service in the army and have returned to their localities; Decision 38/2010/QD-TTg of the Prime Minister of Vietnam on amending and supplementing Decision 142/2008/QD-TTg.

- Military personnel and cipher officers receiving salaries equivalent to those of veterans, discharged, or resigned soldiers currently receiving monthly allowances according to Decision 62/2011/QD-TTg of the Prime Minister on policies for participants in the war to protect the fatherland, international missions in Cambodia, and assisting Laos after April 30, 1975, who have been discharged or resigned.

Specifically, the post-adjustment monthly allowances are as follows:

- From 15 years to less than 16 years, the allowance is 2,285,000 VND/month;- From 16 years to less than 17 years, the allowance is 2,388,000 VND/month;- From 17 years to less than 18 years, the allowance is 2,494,000 VND/month;- From 18 years to less than 19 years, the allowance is 2,598,000 VND/month;- From 19 years to less than 20 years, the allowance is 2,700,000 VND/month.

Thus, depending on the number of years of service, military personnel and cipher officers receiving salaries equivalent to those of veterans, discharged, or resigned soldiers will have a certain adjustment level according to the law.

Article 2 of Circular 82/2023/TT-BQP prescribes the subjects eligible for the new allowance levels under Circular 82/2023/TT-BQP, including:

- Veterans and discharged soldiers currently receiving monthly allowances according to Decision 142/2008/QD-TTg on implementing policies for military personnel who participated in the resistance war against the United States but have less than 20 years of service in the army and have returned to their localities; Decision 38/2010/QD-TTg on amending and supplementing Decision 142/2008/QD-TTg.

What is the current monthly allowance for military personnel and cipher officers?

Pursuant to Joint Circular 182/2013/TTLT-BQP-BTC, the monthly allowance for military personnel and cipher officers receiving salaries equivalent to those of veterans, discharged, or resigned soldiers is as follows:

- From 15 years to less than 16 years, the allowance is 1,282,000 VND/month;- From 16 years to less than 17 years, the allowance is 1,347,000 VND/month;- From 17 years to less than 18 years, the allowance is 1,411,000 VND/month;- From 18 years to less than 19 years, the allowance is 1,475,000 VND/month;- From 19 years to less than 20 years, the allowance is 1,539,000 VND/month.

Who is responsible for implementing the adjustment of monthly allowances for military personnel and cipher officers?

According to Article 5 of Circular 82/2023/TT-BQP, the implementation responsibilities for adjusting the monthly allowances for military personnel and cipher officers are as follows:

- The General Political Department directs the Policy Department to:

+ Take the lead and cooperate with relevant agencies within and outside the army to implement, guide, and inspect the units and localities in executing this Circular;

+ Adjust the allowance levels as guided in Article 3 of Circular 82/2023/TT-BQP for subjects with decisions on monthly allowances from the effective date of this Circular onwards.

- The Department of Labor, War Invalids, and Social Affairs of provinces and cities directly under the central government adjusts and disburses the monthly allowances as guided in Article 3 of Circular 82/2023/TT-BQP for subjects with decisions on monthly allowances before the effective date of Circular 82/2023/TT-BQP.

Circular 82/2023/TT-BQP is effective from December 19, 2023. However, the provisions of Circular 82/2023/TT-BQP are applied from July 1, 2023.
