Circular 57/2023/TT-BCA on guidelines for receiving and processing feedback and recommendations on administrative regulations of the Ministry of Public Security of Vietnam.
On October 31, 2023, the Minister of Public Security issued Circular 57/2023/TT-BCA stipulating the receipt and processing of feedback and recommendations from individuals and organizations regarding administrative regulations under the state management function of the Ministry of Public Security of Vietnam.
Circular 57/2023/TT-BCA applies to:
- Units under the Ministry’s apparatus; Police of provinces and centrally-run cities (hereinafter collectively referred to as local police units).
- Officers, non-commissioned officers, and police soldiers authorized to receive, classify, and handle feedback and recommendations on administrative regulations under the state management function of the Ministry of Public Security of Vietnam (hereinafter collectively referred to as police officers and soldiers).
- Individuals and organizations providing feedback and recommendations on administrative regulations under the state management function of the Ministry of Public Security of Vietnam, as well as related agencies, organizations, and individuals.
Circular 57/2023/TT-BCA does not apply to:
- Feedback and recommendations from individuals and organizations on administrative regulations under the state management function of the Ministry of Public Security of Vietnam that are classified as state secrets.
- Complaints, denunciations, and the resolution of complaints and denunciations.
- Accusations and crime reports.

What does feedback and recommendations content include?
Article 5 of Circular 57/2023/TT-BCA stipulates the content of feedback and recommendations as follows:
- Feedback on administrative regulations under the state management function of the Ministry of Public Security of Vietnam includes the following:
+ Specific obstacles and difficulties in implementing administrative regulations due to delays, inconveniences, or non-implementation, non-compliance with administrative regulations under the state management function of the Ministry of Public Security of Vietnam as stipulated in Clause 1, Article 3, Circular 57/2023/TT-BCA by units, officers, and police soldiers.
+ Inconsistencies between administrative regulations and reality.
+ Lack of uniformity and consistency in administrative regulations.
+ Illegality of administrative regulations.
+ Administrative regulations contrary to international treaties that Vietnam has signed or joined.
+ Other issues related to administrative regulations.
- Recommendations on administrative regulations under the state management function of the Ministry of Public Security of Vietnam include:
+ Providing information, presenting opinions, aspirations, proposing solutions for dealing with the regulations stipulated in Points a, b, c, d, dd, e, Clause 1, Article 5, Circular 57/2023/TT-BCA.
+ Initiatives for issuing new administrative regulations related to business activities, and people's lives under the state management function of the Ministry of Public Security of Vietnam.
How are the forms of feedback and recommendations regulated according to the latest Circular?
Article 6 of Circular 57/2023/TT-BCA stipulates the forms of feedback and recommendations.
Feedback and recommendations from individuals and organizations on administrative regulations can be made in one of the following forms:
(1) Written Form
Requirements for written feedback and recommendations (Article 7, Circular 57/2023/TT-BCA)
Written feedback and recommendations from individuals and organizations must meet the following requirements:
- Written feedback and recommendations must be made by individuals and organizations through:
+ Direct submission to the receiving agency
+ Postal services
- Written feedback and recommendations must be presented and conducted in Vietnamese.
- The content of feedback and recommendations must be clear, specific, and coherent.
- Written feedback and recommendations must include full names, addresses, correspondence addresses, and phone numbers of the individuals or organizations providing the feedback and recommendations as stipulated in Clause 4, Article 8, Circular 57/2023/TT-BCA.
(2) Telephone
Requirements for feedback and recommendations via telephone (Article 8, Circular 57/2023/TT-BCA)
Feedback and recommendations via telephone from individuals and organizations (through the Ministry of Public Security of Vietnam’s hotline, located at the Legal Department and administrative reform and judicial reform agency or the hotlines of police units and localities) must meet the following requirements:
- Conducted in Vietnamese.
- Clearly state the content of feedback and recommendations.
- Provide names, addresses, correspondence addresses, and phone numbers of the individuals or organizations providing feedback and recommendations as stipulated in Clause 4 of this Article.
- Individuals and organizations must use regular phone numbers registered with telecommunications companies as stipulated in Clause 23, Article 3 of the Telecommunications Law 2009, publicly announced.
- Officers and soldiers must honestly and fully record the content and information of feedback and recommendations from individuals and organizations, then present it in written form and report immediately to the competent authority for resolution.
(3) Feedback Form
Requirements for feedback and recommendations via the feedback form (Article 9, Circular 57/2023/TT-BCA)
Feedback and recommendations via feedback form must meet the following requirements:
- The feedback form for individuals and organizations on administrative regulations under the state management function of the Ministry of Public Security of Vietnam must be carried out through the following methods:
+ Sending official dispatches to gather opinions
+ Gathering opinions through mass media
- The feedback form is only implemented when the entities stipulated in Clause 1, Article 2 of Circular 57/2023/TT-BCA want to gather individual and organizational opinions on administrative regulations under the state management function of the Ministry of Public Security of Vietnam.
- The content of the feedback form must be clear, specific, and accurately reflect the issues requiring feedback as stipulated in Point b, Clause 3, Article 22, Circular 57/2023/TT-BCA.
(4) Data Message sent via the National Public Service Portal, Ministry of Public Security of Vietnam's Public Service Portal, Ministry of Public Security of Vietnam's Electronic Information Portal, and Electronic Information Portals of police units and localities as stipulated in Clause 2, Article 10 of Circular 57/2023/TT-BCA.
Requirements for feedback and recommendations via data message (Article 10, Circular 57/2023/TT-BCA)
Ensure the following requirements:
- Comply with the requirements in Clause 7, Article 3, Circular 57/2023/TT-BCA.
- Feedback and recommendations must be sent to the following addresses:
+ Ministry of Public Security of Vietnam's Public Service Portal
+ National Public Service Portal
+ Ministry of Public Security of Vietnam's Electronic Information Portal
+ Electronic information portals of police units and localities.
- Use Vietnamese language; Unicode font according to Vietnam standard TCVN 6909:2001.
- The content of feedback and recommendations must be clear, coherent, and specific.
- Feedback and recommendations must include full names, addresses, email addresses, correspondence addresses, and phone numbers.
- Attachments must be in suitable formats as required by the Information System.
