Circular 28/2024/TT-BCA on handling of administrative violations against regulations on road traffic by traffic police forces under Circular 32/2023/TT-BCA.

On June 29, 2024, the Minister of Public Security promulgated Circular 28/2024/TT-BCA link amending and supplementing several articles of Circular 32/2023/TT-BCA, which regulates the tasks, powers, forms, content, and procedures of patrolling, controlling, and handling administrative violations in road traffic by Traffic Police. Circular 32/2023/TT-BCA also provides for the issuance and revocation of motor vehicle registration and plates.

Circular 28/2024/TT-BCA amends and supplements various articles of Circular 32/2023/TT-BCA and Circular 24/2023/TT-BCA as follows:

- Amend and supplement several articles of Circular 32/2023/TT-BCA link as follows:

+ Amend and supplement Clause 3, Article 18.

+ Amend and supplement Clause 1, Article 20.

+ Amend and supplement Point b, Clause 2, Article 21.

+ Add Point g after Point e, Clause 2, Article 21.

+ Amend and supplement Points b, c, đ of Clause 1; Points c, d of Clause 2, Article 27.

- Amend and supplement several articles of Circular 24/2023/TT-BCA:

+ Amend and supplement Clause 10, Article 3.

+ Amend and supplement Clause 1, Article 6.

+ Amend and supplement Clause 2, Article 6.

+ Add Clause 6 after Clause 5, Article 6.

+ Amend and supplement Article 9.

From July 1, 2024, will the driving license integrated on VNeID have the same value as direct documents in Vietnam?

According to the provisions of Clause 1, Article 1 of Circular 28/2024/TT-BCA, which amends and supplements Point a, Clause 2, Article 12 of Circular 32/2023/TT-BCA, as follows:

Content of Patrol and Control

1. Patrol content

a) Observing and understanding the situation of order and traffic safety on the road traffic routes; preventing violations, traffic accidents, traffic congestion; maintaining order and road traffic safety;

b) Detecting, preventing, and handling violations of road traffic laws and other legal violations as prescribed;

c) Ensuring road traffic safety, security, and order on the transportation routes;

d) Assisting and supporting individuals and vehicles participating in road traffic when necessary;

đ) Implementing other work-related contents assigned by the competent authority as prescribed.

2. Control content

a) Controlling documents related to individuals and road vehicles, including:

Driver’s license; certificate of legal knowledge training on road traffic; certificate of professional driving; vehicle registration certificate or certified copy of the vehicle registration certificate with the original receipt from the credit institution (within the time the credit institution holds the original vehicle registration certificate); inspection certificate, safety and environmental protection inspection seal, certificate of inspection validity period and inspection seal validity (for traffic vehicles required to be inspected); compulsory civil liability insurance of motor vehicle owners and other necessary documents as prescribed (hereinafter collectively referred to as documents);

When the information of the documents has been integrated and updated in the electronic ID card, electronic identification account on the national identification application, in the database managed by the Ministry of Public Security, the inspection and control shall be carried out through the information in the electronic ID card, electronic identification account on the national identification application, database; the inspection of the document information in the electronic ID card, electronic identification account on the national identification application, database shall have the same value as directly inspecting those documents;

b) Controlling the conditions for participating in traffic of road traffic vehicles

The control shall be performed according to the order from front to rear, from left to right, from outside to inside, from top to bottom, including contents: Shapes, dimensions, outer colors, front, rear, and two-side vehicle plates; technical safety and environmental protection conditions of motor road traffic vehicles and specialized machinery as prescribed;

c) Controlling compliance with road transport safety regulations

Controlling the legality of goods, types, quantity, specifications, dimensions; items; the actual number of passengers compared to the allowed number and safety measures in road transport;

d) Controlling other related contents as prescribed by law.

Therefore, when the information of the aforementioned documents has been integrated and updated in the electronic ID card, electronic identification account on the national identification application (VNeID), in the database managed by the Ministry of Public Security, the inspection and control shall be carried out through the information in the electronic ID card, electronic identification account on VNeID, and database.

Furthermore, inspecting the information of documents in the electronic ID card, VNeID, and database has the same value as directly inspecting those documents.

When does Circular 28/2024/TT-BCA take effect?

According to Article 3 of Circular 28/2024/TT-BCA, it stipulates as follows:

Effective date

1. This Circular takes effect from July 1, 2024, except for the case specified in Clause 2 of this Article.

2. Article 2 of this Circular takes effect from August 1, 2024.

Circular 28/2024/TT-BCA takes effect from July 1, 2024, except for Article 2, which takes effect from August 1, 2024.
