Regulations on methods for building price brackets for generating solar power plants and transitional wind power plants apply to whom in Vietnam?
Pursuant to Clause 2 Article 1 of Circular 15/2022/TT-BCT, this Circular applies to the following subjects:
Firstly, Electricity of Vietnam;
Secondly, organizations and individuals participating in the implementation of investment in solar power plants or plants have signed power purchase contracts with Electricity of Vietnam before January 1, 2021 and wind power plants or parts have signed power purchase contracts with Electricity of Vietnam before November 1, 2021. 2021 but do not meet the conditions for applying the electricity purchase price specified in Clause 1, Clause 3 Article 5 of Decision 13/2020/QD-TTg and Clause 1 Article 1 of Decision 39/2018/QD-TTg (amending and supplementing a number of articles of Decision 37/2011/QD-TTg).
These plants or plant sections must strictly comply with the legal provisions on investment, construction, closely follow the absorption capacity of the national electricity system and the capacity of the power grid; comply with the electricity price mechanism at the time of commissioning, take responsibility for the project efficiency according to the approved mechanism.
In case the inspection and inspection agencies detect violations, they will be strictly handled in accordance with the provisions of law. In case of serious violations, the competent authority may withdraw the investment license or suspend the project in accordance with the provisions of the law on construction investment.

On what basis is the principle of building a power generation price bracket in Vietnam?
Pursuant to the provisions of Article 3 of Circular 15/2022/TT-BCT, the principles for building a power generation price bracket are as follows:
Principles of building power generation price brackets
1. The price bracket for power generation of ground-based solar power plants, floating solar power plants, inland wind power plants, and sea-based wind power plants is a range of values from the minimum value (VND 0/kWh) to the maximum value.
2. The maximum value applicable to a solar power plant is the power generation price of a standard solar power plant determined according to the method specified in Articles 4, 5 and 6 of this Circular.
3. The maximum value applicable to a wind power plant is the power generation price of a standard wind power plant determined according to the method specified in Articles 7, 8 and 9 of this Circular.
Thus, the construction of the power generation price bracket is carried out according to the above-mentioned principle.
When is the regulation on the method of building a price bracket for generating solar power plants and transitional wind power plants applied in Vietnam?
Pursuant to Clause 1, Article 15 of Circular 15/2022/TT-BCT, stipulating the method of building a price bracket for generation of solar power plants and transitional wind power plants effective from 25/11/2022.
In addition, pursuant to the provisions of Article 12, Article 13, Article 14 of Circular 15/2022/TT-BCT, assign responsibilities for implementing the following provisions:
* For the Ministry of Industry and Trade
- Appoint independent experts or establish an advisory council to participate in the appraisal of the power generation price framework as prescribed at Point d, Clause 4, Article 10 of this Circular. In case of necessity, the Ministry of Industry and Trade shall collect opinions from relevant ministries and agencies on this electricity generation price bracket.
- Promulgate the power generation price bracket of ground solar power plants, floating solar power plants, inland wind power plants, wind power plants at sea after completing the appraisal.
* For the Electricity Regulatory Authority
- Assume the prime responsibility for, and coordinate with, designated independent experts or advisory councils as prescribed at Point d, Clause 4, Article 10 of this Circular to appraise the results of calculation of the power generation price bracket.
- Submit to the Minister of Industry and Trade for signing the electricity generation price framework as prescribed in this Circular.
* For Electricity of Vietnam
- Promulgate documents to investors of ground solar power plants, floating solar power plants to sign power purchase contracts before January 1, 2021 and inland wind power plants and sea wind power plants to sign power purchase contracts before November 1, 2021 on the provision of research reports feasible, technical design appraised.
- Submit to the Electricity Regulatory Authority a dossier of calculation of the price bracket for electricity generation of ground solar power plants, floating solar power plants, inland wind power plants, wind power plants at sea as prescribed in Articles 10 and 11 of this Circular.
Circular 15/2022/TT-BCT comes into force form November 25th, 2022.
