Circular 119/2023/TT-BQP guiding the identification of remains of unknown martyrs effective from February 5, 2024?

On December 22, 2023, the Minister of National Defense issued Circular 119/2023/TT-BQP on the procedures for identifying remains of unknown martyrs.

The principles for implementing the procedures for identifying remains of unknown martyrs are as follows:

The four procedures specified in Articles 4, 5, 6, and 7 of Circular 119/2023/TT-BQP are technical procedures of two methods: empirical evidence and DNA testing; they have dialectical relationships with each other.

One, two, three, or all procedures can be chosen and applied until scientific evidence is sufficient to identify the remains of the martyrs.

Agencies, units, organizations, and individuals involved in performing the procedures for identifying remains of unknown martyrs.

What are the procedures for collecting and processing data on martyrs' remains of unknown martyrs effective from February 5, 2024?

Article 4 of Circular 119/2023/TT-BQP stipulates the procedures for collecting and processing data on martyrs' remains of unknown martyrs effective from February 5, 2024 as follows:

- The Permanent Office of the Steering Committee 515 at all levels receives dossiers requesting the collection and processing of data on unknown martyrs. The compiled information is recorded in Form BM01-QT01.01/HCLS specified in Appendix V, issued with Circular 119/2023/TT-BQP.

- The Labor, Invalids, and Social Affairs sector establishes an inter-agency task force to perform the duty.

- The task force, Department of Labor, Invalids, and Social Affairs, management board of martyrs' cemeteries, local authorities, collection teams, and witnesses carry out surveys of martyrs' cemeteries and locations where martyrs' remains have been sought and collected. The task force prepares survey reports.

- The task force, Department of Labor, Invalids, and Social Affairs, cemeteries' management board, provincial military commands, collection teams, units, local authorities, organizations, and individuals concerned collect and provide relevant information and documents on unknown martyrs, martyrs' cemeteries, and martyrs' remains. The collected information is recorded in Forms BM02-QT01.01/HCLS and BM03-QT01.01/HCLS specified in Appendix V, issued with Circular 119/2023/TT-BQP.

- The task force, based on the collected information, prepares a report on the data collection results.

- The task force and the Office of the Steering Committee 515 supplement missing information on the remains of martyrs and their graves into the martyrs’ records.

- The task force transfers the dossiers to the Labor, Invalids, and Social Affairs sector. The Labor, Invalids, and Social Affairs sector receives the dossiers, supplements the information on the gravestones and management records. Military units receive, supplement, and correct information on martyrs in the units' management records and lists of martyrs.

- Detailed methods are instructed in Appendix I issued with Circular 119/2023/TT-BQP.

What are the procedures for exhumation and morphological examination of remains of martyrs of unknown martyrs?

Article 5 of Circular 119/2023/TT-BQP stipulates the procedures for exhumation and morphological examination of remains of unknown martyrs as follows:

- The Labor, Invalids, and Social Affairs sector prepares a dossier requesting the exhumation and morphological examination of remains, and the identification of remains of unknown martyrs. It requests the assessment agency to conduct the exhumation, morphological examination of remains, and transfer the dossier to the assessment agency.

- The assessment agency receives the dossier, supplements the professional information, prepares an examination plan, and assigns an examination team to perform the duty.

- The examination team and the coordinating agency carry out the exhumation and morphological examination of the martyrs’ remains according to the prepared plan. Examination results are recorded in Form BM01-QT02.01/HCLS.

- The examination team collects sample remains for subsequent DNA analysis. The results of sample collection are recorded in Section III, Form BM01-QT02.01/HCLS, specified in Appendix V, issued with Circular 119/2023/TT-BQP.

- The examination team and the coordinating unit restore the grave status of the martyrs and hand it over to the agency or individual responsible for managing the martyrs’ graves.

- The assessment agency transfers the morphological examination dossier and collected sample remains to the Labor, Invalids, and Social Affairs sector for subsequent processing steps.

- Detailed methods are instructed in Appendix II issued with Circular 119/2023/TT-BQP.

What are the steps in the procedures for collecting and preserving remains samples and biological samples of martyrs’ relatives for DNA analysis to identify unknown martyrs’ remains?

Article 6 of Circular 119/2023/TT-BQP stipulates the procedures for collecting and preserving remains samples and biological samples of martyrs’ relatives for DNA analysis to identify unknown martyrs’ remains as follows:

- The Labor, Invalids, and Social Affairs sector prepares a dossier requesting the collection of remains samples and biological samples of martyrs’ relatives for DNA analysis to identify unknown martyrs’ remains. It requests the assessment agency to collect samples and transfer the dossier to the assessment agency.

- The assessment agency receives the dossier, supplements the professional information, prepares a plan for collecting and preserving samples, and assigns an examination team to perform the duty of collecting and preserving samples for DNA analysis.

- The examination team and the coordinating agency collect samples according to the plan.

+ For remains samples, the collection process is conducted together with the exhumation and morphological examination of martyrs’ remains (stipulated in Article 5 of this Circular). Detailed methods and techniques for collecting samples are instructed in Section A of Appendix III issued with this Circular. Sample collection information is recorded in Section III, Form BM01-QT02.01/HCLS specified in Appendix V, issued with Circular 119/2023/TT-BQP.

+ For biological samples of martyrs’ relatives, methods, and techniques for collecting samples are implemented according to the procedures instructed in Sections B, C, and D of Appendix III issued with Circular 119/2023/TT-BQP. Sample collection information is recorded in Form BM01-QT02.02/HCLS specified in Appendix V, issued with Circular 119/2023/TT-BQP.

The assessment agency transfers the dossier and samples to the Labor, Invalids, and Social Affairs sector after completing the sample collection duty.

The assessment agency tasked with DNA analysis to identify unknown martyrs’ remains, after receiving the samples preserved by the Labor, Invalids, and Social Affairs sector, conducts the analysis process according to the procedures instructed in Appendix III issued with Circular 119/2023/TT-BQP.

Circular 119/2023/TT-BQP takes effect from February 5, 2024.
