How Are the Duties and Powers of a Railway Train Conductor Regulated?

The duties and powers of a train conductor are regulated under Article 5 of Circular 15/2023/TT-BGTVT as follows:

* Duties of a Passenger Train Conductor

- Being the highest commander on the train, responsible for ensuring safety, security, order, customer service, and the operation of onboard sections.- Recording incidents with witnesses concerning births, deaths, injuries, and security-related issues on the train; documenting incidents and railway traffic accidents as per legal requirements.- Complying with all regulations regarding the transportation of goods, passengers, and luggage by railway, and other relevant laws and enterprise guidelines.- Performing procedures for rescue requests and organizing rescues.- Recording and summarizing reports on all incidents related to train journeys.- In the case where multiple trains are combined into a passenger train, the conductor of the last train becomes the overall commander of the combined passenger train.

* Duties of a Freight Train Conductor

- Being the highest commander on a freight train, responsible for maintaining safety, security, order, and customer service.- Ensuring the train runs according to the schedule and dispatch orders, adhering to national technical standards on railway operation, railway signals, train operation processes, and train shunting tasks.- Recording incidents with witnesses concerning births, deaths, injuries, and security-related issues on the train; documenting incidents and railway traffic accidents as per legal requirements.- Complying with all regulations regarding the transportation of goods and luggage by railway and other relevant laws and enterprise guidelines.- Observing road signals, train signals, and any conditions stipulated in permits, orders, and warnings to enforce and supervise compliance by the train driver.- When passing stations, confirming the train's integrity and signaling safety to station personnel. If any threat to train safety is detected en route, stopping the train to address the issue or notifying station personnel.- Promptly recording, in full and accurately, the train log and any incidents related to train operations.- Signaling for the train to run only when ensuring all safety conditions are met.- Commanding brake tests on the train, participating in brake test councils as per enterprise regulations for train conductors.- Performing rescue procedure requests and organizing rescues.- In cases where multiple trains are combined into a freight train, the conductor of the last train becomes the overall commander of the combined freight train.

* Powers of a Passenger Train Conductor

- In emergency cases, the passenger train conductor has the right to require passengers to take measures ensuring the train’s safety and must report immediately to the train dispatcher or the nearest station about the emergency situation.- Rejecting unqualified personnel from working on the train based on professional competency or health standards; suspending onboard personnel who violate legal regulations or enterprise guidelines, risking train safety or impacting service quality. This must be reported immediately to the competent authority for resolution as stipulated in point b, clause 4, Article 5 of Circular 15/2023/TT-BGTVT.- Deciding to stop the train at the nearest convenient station or location for emergency medical assistance, and transferring injured or deceased individuals along with related assets and documents to the station chief, police, hospital, or local authorities for further handling.

* Powers of a Freight Train Conductor

- Refusing to run the train when safety conditions are not met.- Rejecting unqualified personnel from working on the train based on professional competency or health standards.- Deciding to stop the train at the nearest convenient station or location for emergency medical assistance, and transferring injured or deceased individuals along with related assets and documents to the station chief, police, hospital, or local authorities for further handling.

* Note: For trains without a deputy safety passenger train conductor, the passenger train conductor must fulfill all duties and powers of the safety passenger train conductor position.

How Is the Position of Deputy Passenger Train Conductor Regulated in the Latest Circular?

The position of deputy passenger train conductor is regulated under Article 6 of Circular 15/2023/TT-BGTVT as follows:

* Standards

- Holding a diploma or certificate of vocational training at a primary level or higher in railway operation or railway transportation.- Meeting the health conditions as stipulated by the Minister of Health.- Having served for at least one year as a freight train conductor or completed a probation period according to labor law.- Successfully passing a professional competency exam for deputy passenger train conductors organized by the employing enterprise.

* Duties

- Ensuring the train runs according to the schedule and dispatch orders, adhering to national technical standards on railway operation, railway signals, train operation processes, and train shunting tasks.- Observing road signals, train signals, and any conditions stipulated in permits, orders, and warnings to enforce and supervise compliance by the train driver.- Signaling for the train to run only when ensuring all safety conditions are met.- When passing stations, confirming the train's integrity and signaling safety to station personnel.
