On July 10, 2024, the Minister of Public Security of Vietnam issued Circular 32/2024/TT-BCA amending several articles of Circular 149/2020/TT-BCA and Circular 08/2018/TT-BCA.

Circular 32/2024/TT-BCA amends several Articles of Circular 149/2020/TT-BCA as follows:

(1) Amending and supplementing documents on management and monitoring of fire prevention and fighting activities.

(2) The duration of fire-fighting practice.

(3) Establishment of specialized fire prevention and fighting teams.

(4) Inspection stamp for fire prevention and fighting equipment.

Circular 32/2024/TT-BCA also amends and supplements Circular 08/2018/TT-BCA on the inspection of conditions ensuring safety for rescue and emergency work of the police.

Additionally, Circular 32/2024/TT-BCA amends and supplements certain terms and abolishes specific clauses in the Articles of Circular 149/2020/TT-BCA and Circular 18/2018/TT-BCA.

What are the regulations on administrative penalties for acts leading to fire and explosion?

Article 51 of Decree 144/2021/ND-CP stipulates the levels of administrative penalties for violations leading to fire and explosion as follows:

- A warning or a fine from VND 100,000 to VND 300,000 for violations of fire prevention and fighting safety regulations leading to fire, explosion causing damage to property under VND 20,000,000.

- A fine from VND 1,000,000 to VND 3,000,000 for violations of fire prevention and fighting safety regulations leading to fire, explosion causing damage to property from VND 20,000,000 to under VND 50,000,000.

- A fine from VND 3,000,000 to VND 5,000,000 for violations of fire prevention and fighting safety regulations leading to fire, explosion causing damage to property from VND 50,000,000 to under VND 100,000,000.

- A fine from VND 5,000,000 to VND 10,000,000 for any of the following acts:

+ Violating fire prevention and fighting safety regulations leading to fire, explosion causing damage to property over VND 100,000,000;

+ Violating fire prevention and fighting regulations causing injury or harm to the health of one person with a body injury rate under 61%;

+ Violating fire prevention and fighting regulations causing injury or harm to the health of two or more people with a total body injury rate of these individuals under 61%.

* Measures to remedy consequences

Required to pay all medical examination and treatment costs for the following violations:

+ Violating fire prevention and fighting regulations causing injury or harm to the health of one person with a body injury rate under 61%;

+ Violating fire prevention and fighting regulations causing injury or harm to the health of two or more people with a total body injury rate of these individuals under 61%.

*Note: The above fines apply to individuals' administrative violations. For organizations committing the same violations, the fine is twice the amount applied to individuals.

What are the requirements and contents of the fire-fighting plan in Vietnam?

According to Clause 2, Article 19 of Decree 136/2020/ND-CP, the fire-fighting plan must meet the following basic requirements and content:

- Describe the hazardous characteristics of fire, explosion, toxicity, and other related conditions for fire-fighting operations;

- Present the most complex fire scenarios and some typical fire situations that may occur, and the potential development of the fire at different levels;

- Propose a plan to mobilize, use forces, equipment, organize commands, technical measures, fire-fighting tactics, and relevant work suitable for each phase of each fire situation;

- The fire-fighting plan must be promptly supplemented and adjusted and re-approved by competent authorities when there are significant changes in scale, nature, fire, explosion, toxicity hazards, and other conditions related to fire-fighting operations.

What are the regulations on fire prevention and fighting equipment in Vietnam?

Article 37 of Decree 136/2020/ND-CP stipulates the fire prevention and fighting equipment in Vietnam as follows:

- Fire prevention and fighting equipment include motorized vehicles, devices, machinery, tools, chemicals, specialized support tools for fire prevention, fire-fighting, rescue, and asset protection as regulated in Appendix VI issued together with Decree 136/2020/ND-CP.

- The fire-fighting motor vehicles of the Fire Prevention and Fighting Police are stipulated in Section 1 of Appendix VI issued together with Decree 136/2020/ND-CP.

- Fire prevention and fighting equipment produced domestically or imported must meet the following requirements:

+ Ensure technical parameters according to the design for fire prevention and fighting purposes.

+ Comply with Vietnamese norms, standards, or approved foreign and international standards permissible in Vietnam.

Circular 32/2024/TT-BCA comes into force in Vietnam from August 24, 2024.
