On August 1, 2024, the Ministry of Transport issued Circular 29/2024/TT-BGTVT, which outlines regulations on the conditions, standards, uniforms, and cards of inspector for individuals assigned to perform specialized transport inspection tasks; the duties and powers of agencies performing the transportation sector’s inspection functions.
Circular 29/2024/TT-BGTVT addresses the conditions, standards, uniforms, and cards of inspector for individuals assigned to perform specialized transport inspection tasks (hereinafter referred to as "specialized transport inspection officials"); the duties and powers of agencies carrying out the transportation sector’s inspection functions.
Circular 29/2024/TT-BGTVT applies to the Inspectorate of the Ministry of Transport; the Inspectorate of the Civil Aviation Administration of Vietnam; the Inspectorate of the Vietnam Maritime Administration; the Inspectorate of the Department of Transport; and the Departments: Vietnam Road Administration, Vietnam Inland Waterways Administration, Vietnam Register, and Vietnam Railway Administration (collectively referred to as agencies assigned the function of specialized inspection under the Ministry of Transport); inspection officials, specialized transport inspection officials, and other relevant organizations and individuals.

Which agencies perform inspection in Vietnam?
According to Article 9 of the Inspectorate Law 2022, the agencies performing inspection functions include:
- Inspectorates at the administrative level, including:
+ The Inspectorate of the Government of Vietnam;+ The Inspectorate of provinces and centrally-run cities (collectively referred to as provincial inspectorates);+ The Inspectorate of districts, district-level towns, cities of provinces, and cities of centrally-run cities (collectively referred to as district inspectorates);+ Inspectorates in special administrative-economic units as prescribed by the National Assembly.
- Inspectorates by sector or field, including:
+ The Inspectorate of Ministries, ministry-level agencies (collectively referred to as ministry Inspectorates);+ The Inspectorate of General Departments and Departments under Ministries and equivalent agencies (collectively referred to as Inspectorates of General Departments and Departments);+ The Inspectorate of departments.
- Inspectorates in agencies under the Government of Vietnam.
- Inspectorates in the People's Army, People's Police, State Bank of Vietnam, and the Government’s Cipher Committee.
- Agencies assigned the function of specialized inspection.
What are the standards for specialized inspectors in Vietnam?
Pursuant to Article 3 of Circular 29/2024/TT-BGTVT, the conditions and standards for specialized inspection officials are as follows:
- Specialized transport inspection officials are public employees affiliated with the organization advising and assisting the head of the agency assigned the function of specialized inspection under the Ministry of Transport;Subordinate units of the agency assigned the function of specialized inspection under the Ministry of Transport.
- Specialized transport inspection officials must meet the conditions and standards specified in Clause 3 of Article 38 of the Inspectorate Law 2022 and the following conditions and standards:
+ Specialized transport inspection officials of the Vietnam Road Administration, Vietnam Railway Administration, and Vietnam Inland Waterways Administration must have a university degree or higher suitable for the job position requirements in one of the following fields: transportation, construction, architecture, mechanics, information technology, telecommunications, law, economics, finance;
+ Specialized transport inspection officials of the Vietnam Register must have a university degree or higher in a technical field related to vehicle and transport equipment inspection or one of the fields related to law or finance.
What are prohibited acts in inspection in Vietnam?
According to Article 8 of the Inspectorate Law 2022, the prohibited acts in inspection in Vietnam include:
- Abusing inspection authority and power to perform unlawful acts, harass, cause difficulties, and trouble for the inspected entities and other organizations, and individuals; abusing power during the inspection process.
- Conducting inspections outside the jurisdiction scope, not compliant with the content of the inspection decision, or the approved inspection plan.
- Intentionally not issuing an inspection decision when discovering signs of legal violations requiring inspection as prescribed by law; covering for the inspected entity;Intentional wrongful conclusions; unlawful conclusions, decisions, and handling;Failing to recommend the prosecution and transfer case files showing criminal signs detected through inspection to investigation agencies for consideration and decision on criminal case prosecution as prescribed by law.
- Offering, accepting, or mediating bribes during inspection activities.
- Disclosing information and documents related to the inspection when the inspection conclusion has not been made public.
- Illegally interfering with inspection activities; impacting the inspection results, conclusions, and recommendations.
- Failing to provide information, documents or providing untimely, incomplete, untruthful, and inaccurate information; embezzling, destroying documents, and evidence related to the inspection.
- Resisting, obstructing, bribing, threatening, retaliating against, or suppressing those conducting the inspection, those performing oversight, appraisals, and those providing information and documents to the inspection agency; causing difficulties for inspection activities.
- Other behaviors prohibited under the law.
Circular 29/2024/TT-BGTVT comes into effect in Vietnam on September 20, 2024.
