What are new official regulations on road traffic safety for vehicles transporting preschool children and primary school students in Vietnam from January 1, 2025?

The National Assembly of Vietnamhas passed the Law on Road Traffic Order and Safety 2024.

Article 46 of the Law on Road Traffic Order and Safety 2024 stipulates the requirements for ensuring road traffic order and safety for vehicles transporting preschool children and primary school students.

- Commercial vehicles transporting preschool children and primary school students must meet the following requirements:

+ Ensure the conditions stipulated in Clause 1 and Clause 2, Article 35 of the Law on Road Traffic Order and Safety 2024, have devices to record images of the children, and equipped with systems capable of warning and preventing children from being forgotten on the vehicle; have a usage duration not exceeding 20 years; and be painted in a color as regulated by the Government of Vietnam;

+ Vehicles transporting preschool or primary school children must have seat belts appropriate for their age or use seats designed for their age as per the legal regulations.

- Commercial vehicles used in conjunction with transporting preschool children and primary school students must meet the requirements as stipulated in Clause 3, Article 10, Clause 1 and Clause 2, Article 35 of the Law on Road Traffic Order and Safety 2024 and be equipped with devices that record images of the children and systems capable of warning and preventing children from being forgotten on the vehicle as per the requirements in subsection (a), Clause 1, Article 46 of the Law on Road Traffic Order and Safety 2024.

- When transporting preschool children and primary school students, at least one supervisor must be arranged on each vehicle to guide, supervise, maintain order, and ensure the safety of the children throughout the trip. In case of vehicles with 29 seats or more (excluding the driver’s seat) transporting 27 or more children, at least two supervisors must be arranged on each vehicle. The supervisors and drivers are responsible for checking the children when they get off the vehicle; children must not be left on the vehicle once the supervisors and drivers have left.

- Drivers of vehicles transporting preschool children and primary school students must have at least 2 years of experience in passenger transportation.

- Educational institutions must establish safety protocols when transporting preschool children and primary school students; guide drivers and supervisors to thoroughly understand and implement the protocols; and are responsible for ensuring road traffic order and safety when organizing the transportation for their schools.

- Vehicles transporting preschool children and primary school students are to be prioritized in traffic management, allocated specific lanes, and provided with designated stop and parking areas at schools and along the transportation routes.

Driver's license categories in Vietnam from January 1, 2025

Based on Clause 1, Article 57 of the Law on Road Traffic Order and Safety 2024, the categories of driver's licenses in Vietnam from January 1, 2025, include:

- Class A1: Issued to drivers of two-wheeled motorcycles with an engine capacity up to 125 cm3 or with electric motor power up to 11 kW;

- Class A: Issued to drivers of two-wheeled motorcycles with an engine capacity over 125 cm3 or with electric motor power over 11 kW and the types of vehicles regulated for Class A1 licenses;

- Class B1: Issued to drivers of three-wheeled motorcycles and the types of vehicles regulated for Class A1 licenses;

- Class B: Issued to drivers of cars seating up to 08 passengers (excluding the driver's seat); trucks and specialized vehicles with a total designed weight up to 3,500 kg; the types of cars regulated for Class B licenses pulling trailers with a total designed weight up to 750 kg;

- Class C1: Issued to drivers of trucks and specialized vehicles with a total designed weight between 3,500 kg and 7,500 kg; trucks regulated for Class C1 licenses pulling trailers with a total designed weight up to 750 kg; and the types of vehicles regulated for Class B licenses;

- Class C: Issued to drivers of trucks and specialized vehicles with a total designed weight over 7,500 kg; trucks regulated for Class C licenses pulling trailers with a total designed weight up to 750 kg; and the types of vehicles regulated for Class B and C1 licenses;

- Class D1: Issued to drivers of cars seating over 08 and up to 16 passengers (excluding the driver's seat); the types of cars regulated for Class D1 licenses pulling trailers with a total designed weight up to 750 kg; and the types of vehicles regulated for Class B, C1, and C licenses;

- Class D2: Issued to drivers of cars (including buses) seating over 16 and up to 29 passengers (excluding the driver's seat); the types of cars regulated for Class D2 licenses pulling trailers with a total designed weight up to 750 kg; and the types of vehicles regulated for Class B, C1, C, and D1 licenses;

- Class D: Issued to drivers of cars (including buses) seating over 29 passengers (excluding the driver's seat); sleeper buses; the types of cars regulated for Class D licenses pulling trailers with a total designed weight up to 750 kg; and the types of vehicles regulated for Class B, C1, C, D1, and D2 licenses;

- Class BE: Issued to drivers of cars regulated for Class B licenses pulling trailers with a total designed weight over 750 kg;

- Class C1E: Issued to drivers of cars regulated for Class C1 licenses pulling trailers with a total designed weight over 750 kg;

- Class CE: Issued to drivers of cars regulated for Class C licenses pulling trailers with a total designed weight over 750 kg; tractor-trailer trucks;

- Class D1E: Issued to drivers of cars regulated for Class D1 licenses pulling trailers with a total designed weight over 750 kg;

- Class D2E: Issued to drivers of cars regulated for Class D2 licenses pulling trailers with a total designed weight over 750 kg;

- Class DE: Issued to drivers of cars regulated for Class D licenses pulling trailers with a total designed weight over 750 kg; articulated buses.

When does the Law on Road Traffic Order and Safety 2024 take effect in Vietnam?

Article 88 of the Law on Road Traffic Order and Safety 2024 stipulates the law's effective date as follows:

Effective Date

1. This Law takes effect from January 1, 2025, except as otherwise provided in Clause 2 of this Article.

2. Clause 3, Article 10 of this Law takes effect from January 1, 2026.

3. The Road Traffic Law No. 23/2008/QH12 amended by Law No. 35/2018/QH14 and Law No. 44/2019/QH14 ceases to be effective from the date this Law takes effect, except as provided in Clauses 1, 2, 5, and 6 of Article 89 of this Law.

4. Resolution No. 73/2022/QH15 of the National Assembly on piloting the auction of car number plates ceases to be effective from the date this Law takes effect, except as provided in Clause 7 of Article 89 of this Law.

The Law on Road Traffic Order and Safety 2024 takes effect in Vietnam from January 1, 2025, except for Clause 3, Article 10 of the Law on Road Traffic Order and Safety 2024, which takes effect in Vietnam from January 1, 2026.
