New standards on honorary consularity effective from June 1, 2022?
- Vietnamese people can work as honorary consuls for foreign countries.
Pursuant to Clause 1, Article 6 of Decree 26/2022/ND-CP stipulating the criteria for Honorary Consular candidates are as follows:
“Article 6. Criteria for Honorary Consular Candidates
The person who is approved to be an Honorary Consul must meet the following conditions:
1. Having nationality of the sending country or of Vietnam. In case a person has a nationality of a third country or a person with dual or multiple nationalities, the consent of the Ministry of Foreign Affairs must be obtained according to the procedures specified in Clause 2, Article 5. This consent on nationality is valid. may be withdrawn at any time without giving a reason. In this case, the Ministry of Foreign Affairs shall send a note to the sending State.”
Accordingly, the Honorary Consul may have Vietnamese nationality or that of the sending country. If you are from a third country or have multiple nationalities, the consent of the Ministry of Foreign Affairs is required.
- The honorary consular area must not coincide with the consular area of the professional consular office of the sending country in Vietnam.
According to Clause 2, Article 9 of Decree 26/2022/ND-CP stipulating the consular area of the Honorary Consul as follows:
“Article 9. Consular areas of Honorary Consuls
...
2. The consular area of an honorary consular post must not coincide with the consular area prescribed for a professional consular post in case the sending State has a professional consular post in Vietnam.”
- Relatives of the honorary consul will not be entitled to privileges and immunities.
Pursuant to Clause 4, Article 16 of Decree 26/2022/ND-CP stipulates as follows:
“Article 16. Privileges and Immunities for Honorary Consuls
...
4. Family members of the Honorary Consul are not entitled to privileges and immunities.”
Thus, the family members of the Honorary Consul will not be entitled to privileges and immunities in Vietnam.

From June 1, 2022, there will be 8 positions in the field of organization and staff that must periodically be transformed according to Article 2 of Circular 3/2022/TT-BNV as follows:
- Appraisal of personnel to submit to competent authorities for appointment, transfer, rotation, training and retraining of cadres, civil servants and public employees.
- Organization of recruitment of civil servants and public employees; exam for raising the rank of civil servants and public employees; exam for promotion to the professional title of public employees.
- Appraise documents to submit to competent authorities for approval on organizational structure and payroll.
- Appraisal of projects on new establishment, rearrangement of agencies, organizations, units and state-owned enterprises, non-governmental organizations, professional associations.
- Appraisal of dossiers of request for new establishment, import, division and adjustment of administrative boundaries at all levels.
- Appraise dossiers to submit to competent authorities to decide forms of emulation, commendation and discipline.
- Allocating training targets and budgets.
- Manage and implement the salary regime for cadres, civil servants, public employees and employees.
In addition, the period of periodic change of working position according to Article 3 of Circular 3/2022/TT-BNV is from full 03 years to 05 years.
Circular 3/2022/TT-BNV takes effect from June 1, 2022.
