What will be the employee holiday schedule for 2024?
Employees will have the following holidays and Tet in 2024:
(1) New Year Holiday Schedule 2024 (point a clause 1 Article 112 Labor Code 2019)
Employees are entitled to a day off with full pay on New Year’s Day (January 01 according to the Gregorian calendar).
(2) Lunar New Year Holiday Schedule 2024 (point b clause 1 Article 112 Labor Code 2019)
Employees are entitled to 5 days off with full pay for Lunar New Year.
On November 03, 2023, the Office of the Government of Vietnam issued Official Dispatch 8662/VPCP-KGVX in 2023 on Lunar New Year and National Day holidays in 2024.
The Lunar New Year holiday schedule for officials and public employees, employees is as follows:
- For officials and public employees: from Thursday, February 08, 2024 (Gregorian calendar) to the end of Wednesday, February 14, 2024 (Gregorian calendar) (from the 29th day of the 12th lunar month of the Year of the Cat to the 5th day of the 1st lunar month of the Year of the Dragon). Thus, the Lunar New Year holiday in 2024 for officials and public employees will be 7 days (including 5 days of Lunar New Year holidays and 2 compensatory days off according to the weekly rest day regulation in clause 3 Article 111 Labor Code 2019).
- For employees:
In Official Dispatch 4594/LDTBXH-ATLD, it is recommended based on actual conditions and holiday schedules for officials and public employees that employers arrange the 2024 Lunar New Year holiday schedule for employees similarly to the holiday schedule for officials and public employees, and inform employees of the 2024 Lunar New Year holiday plan at least 30 days before implementation.
(3) Reunification Day and International Workers' Day Holiday Schedule 2024 (points c, d clause 1 Article 112 Labor Code 2019)
Employees are entitled to a day off with full pay on:
- Reunification Day: 1 day (April 30 according to the Gregorian calendar).
- International Workers' Day: 1 day (May 01 according to the Gregorian calendar).
April 30, 2024, falls on a Tuesday, and May 01, 2024, falls on a Wednesday.
Thus, for the holidays on April 30 and May 01, 2024, employees have 2 consecutive days off.
(4) National Day Holiday Schedule September 02, 2024 (point dd clause 1 Article 112 Labor Code 2019)
Employees are entitled to 2 days off with full pay for National Day: (September 02 according to the Gregorian calendar and 1 adjacent day before or after).
On November 03, 2023, the Office of the Government of Vietnam issued Official Dispatch 8662/VPCP-KGVX in 2023 on Lunar New Year and National Day holidays in 2024.
The Government of Vietnam agreed on National Day holidays from August 31, 2024, to the end of September 03, 2024.
September 02, 2024, falls on a Monday.
Thus, the National Day holiday schedule for officials and public employees in 2024 is from August 31, 2024, to the end of September 03, 2024.
- For employees:
Employers can decide the 2-day holiday for employees (September 02 according to the Gregorian calendar and 1 adjacent day before or after).
(5) Hung Kings' Commemoration Day Holiday Schedule 2024 (point e clause 1 Article 112 Labor Code 2019)
Employees are entitled to one day off with full pay for Hung Kings' Commemoration Day: 1 day (March 10 according to the lunar calendar).
March 10 of the lunar calendar in 2024 falls on a Thursday.
Thus, for Hung Kings' Commemoration Day in 2024, officials and public employees, and employees have 1 day off.
*Note: If the weekly rest day coincides with the holiday, as provided in clause 1 Article 112 Labor Code 2019, employees are entitled to an additional compensatory day off immediately thereafter.
For foreign employees working in Vietnam, in addition to the above statutory holidays, they are entitled to 1 traditional New Year holiday and 1 National Day of their own country.
Can enterprises unilaterally require employees to work on holidays?
Article 59 of Decree 145/2020/ND-CP stipulates the consent of employees for overtime as follows:
Consent of employees for overtime
1. Except as provided in Article 108 of the Labor Code, for other cases where overtime is organized, employers must obtain the consent of employees participating in the overtime regarding the following contents:
a) Overtime duration;
b) Overtime location;
c) Overtime work.
2. If the consent of the employee is signed into a separate written agreement, refer to the Form No. 01/PLIV attached to this Decree.
Thus, if wanting employees to work overtime on holidays, excluding the cases stipulated in Article 108 Labor Code 2019, the enterprise must notify and obtain the consent of the employees participating in overtime regarding the following contents:
- Overtime duration;
- Overtime location;
- Overtime work.
If the employee agrees, they must sign a separate written agreement (Form No. 01/PLIV attached to Decree 145/2020/ND-CP.)
