How is a Communist Party member treated if they have a third child?
Based on the regulations in Article 52 of Regulation 69-QD/TW in 2022, the provisions are as follows:
Violation of population policy regulations
1. A Communist Party member who violates one of the following cases causing less severe consequences shall be disciplined in the form of a reprimand:
a) Hindering or coercing the implementation of family planning; participating in activities such as testing, diagnosing to determine the sex of the fetus contrary to regulations.
b) Violating population policy.
2. In cases where the violation has been disciplined according to Clause 1 of this Article but reoccurs, or the first-time violation causes serious consequences, or one of the following cases, the disciplinary action shall be a warning or dismissal (if holding a position):
a) Propagating, disseminating, or issuing documents with content contrary to population policy and the nation's fine ethical traditions.
b) Deceiving in giving birth to or adopting a child who is essentially one’s own child to have more children out of wedlock or contrary to regulations.
3. In cases where the violations in Clause 1 and Clause 2 of this Article cause very serious consequences, the disciplinary action shall be expulsion from the Communist Party.
If a Communist Party member has a third child, they will be disciplined with a reprimand if it causes less severe consequences; if it causes serious consequences or they have been reprimanded but repeat the offense, they will be given a warning or dismissed; if it causes very serious consequences, they will be expelled from the Communist Party.
**** In addition, based on the provisions in Clause 8, Section III of Guide 05-HD/UBKTTW in 2022, it is stipulated as follows:
- Violation due to family planning measures affecting reproductive health (certified by a district-level or higher hospital) will be considered for mitigation of disciplinary action.
- Violation due to intentional or coerced non-implementation of family planning will be considered for increased disciplinary action.

d) Not fulfilling tasks
A Communist Party member who does not achieve the "Fulfill tasks" rating or falls into one of the following cases:
- Evaluated by competent authorities as showing signs of ideological, political, moral, lifestyle degeneration, "self-evolution," "self-transformation."
- Achieving less than 50% of the assigned targets and tasks for the year.
- Communist Party members who are officials and public employees rated as "Not fulfilling tasks."
- Communist Party members disciplined within the year (a single violation subjected to disciplinary action is only counted once when rating).
Simultaneously, based on the provisions in point d, Clause 1.3, Section 1, Part B of Guide 21-HD/BTCTW in 2019, the provisions are as follows:

d) Not fulfilling tasks
An organization (Communist Party branch) that does not achieve the "Fulfill tasks" rating or falls into one of the following cases:
- Completing less than 50% of the socio-economic development, defense-security tasks assigned by competent authorities (except for force majeure cases) or poor implementation of Communist Party building programs and plans and the political system of the Party Committee.
- Having 02 organizations (among organizations such as: Fatherland Front, political-social organizations at the same level) rated as "Not fulfilling tasks."
- Communist Party organization disciplined.
- Communist Party branch having over 20% of subordinate Communist Party organizations rated as "Not fulfilling tasks," grassroots Communist Party branch having over 20% of members rated as "Not fulfilling tasks."
According to the above regulations, a Communist Party member disciplined for having a third child will be rated as not fulfilling tasks.
Additionally, if a cell branch has over 20% of its members disciplined for having a third child, it will be rated as "Not fulfilling tasks."
In which cases are Communist Party members not yet disciplined, exempted, or not disciplined?
Based on the provisions in Clause 14, Article 2 of Regulation No. 69-QD/TW in 2022 stipulating cases of not yet disciplined, exempted, or not disciplined as follows:
- Female Communist Party members who are pregnant, on maternity leave, nursing a child under 12 months old, or male Communist Party members (in cases of a deceased wife or due to other objective or force majeure reasons) nursing a child under 12 months old are not yet considered for disciplinary action.
- Communist Party members with severe illnesses being treated in a hospital are not yet considered for disciplinary action; once their health is stable (discharged from the hospital), they will be considered for disciplinary action.
- Communist Party members who have passed away; the organization reviews and concludes but does not decide on disciplinary action, except in cases of particularly serious violations.
- Communist Party members declared missing, if violations are found, a review and conclusion are still made but disciplinary actions are not taken. If the member is found alive, disciplinary actions will be implemented according to regulations.
- Communist Party members who undertake proposals for innovation, following Conclusion 14-KL/TW in 2021 of the Politburo, approved by competent authorities but resulting in damage, the competent authorities will clearly determine objective and subjective reasons, assess objectively and comprehensively; if conducted with right motives and for the common good, they will be exempted or reduced from disciplinary responsibility.
- Violations resulting from following the wrongful policies, decisions, instructions of organizations or superiors, or due to coercion but actively and promptly reported in writing to the competent organization, authority about their opinions and proposals before implementation are exempted from disciplinary action.
