According to Article 17 of Decision 1496/QD-BTP in 2022 on consideration for early salary increase as follows:
"Article 17. Conditions for a pay raise ahead of schedule
Officials, public employees and employees who have received retirement notices and meet the conditions specified in Clause 2, Article 3 of Circular No. 08/2013/TT-BNV of the Ministry of Home Affairs will be entitled to one (01) pay raise ahead of 12 months specified at Point a, Clause 1, Article 2 of Circular No. 08/2013/TT-BNV of the Ministry of Home Affairs."

What are the procedures for considering a pay raise ahead of schedule for officials, public employees and employees at the Ministry of Justice of Vietnam who have received retirement notices?
According to Article 19 of Decision 1496/QD-BTP in 2022 on consideration for early salary increase as follows:
"Article 19. Procedure of considering a pay raise ahead of schedule
1. Step 1. The personnel organization department or the officer in charge of personnel organization of the unit under the Ministry, the public service provider under the Department, the public service provider under the General Department, the Civil Judgment Execution Department review control the salary of officials, public employees and employees upon the notice of retirement, consider and report to the Head of the unit on the cases eligible to raise the salary level ahead of time.
2. Step 2. The head of the unit shall decide or request the Minister to consider and decide to raise the salary level ahead of time for officials, public employees and employees who have announced their retirement according to their competence.
In case officials, public employees and employees of units under the Ministry (including officials of affiliated public service providers) fall under the decision-making competence of the Minister, the head of the unit under the Ministry shall send a written request to recommendations to the Personnel and Organization Department to report to the Minister for consideration and decision.

"Article 20. Selection of a pay raise ahead of schedule
In case officials, public employees and employees are both considered to be considered for raising the salary level ahead of time due to outstanding achievements in performing tasks and also subject to consideration for raising the salary level ahead of time when receiving information from the Government. When announcing their retirement, officials, public employees and employees may choose one (01) out of two (02) salary increase regimes ahead of time, which is more favorable as prescribed in this Regulation."

According to Article 24 of Decision 1496/QD-BTP in 2022 as follows:
"Article 24. Record and consider a regular pay raise and a pay raise ahead of schedule
1. Personnel organization division or staff in charge of personnel organization of units under the Ministry, public service providers under the Department, public service providers under the General Department, the Civil Judgment Execution Department of provinces and cities The city directly under the Central Government is responsible for keeping records of regular salary increase and salary increase before the deadline of public employees, public employees and employees of their units according to regulations on record keeping.

2. The case of the Head units under the Ministry, heads of public service providers under the Department, heads of public service providers under the General Department of Civil Judgment Execution, Directors of the Civil Judgment Enforcement Departments of provinces and centrally run cities may decide to raise their regular salary and raise the salary level ahead of time for officials, public employees and employees of the unit whose dossier is managed by the Department of Organization and Personnel, the General Department of Civil Judgment Enforcement, the head of the unit must send 01 copy of the Decision on the Department of Organization and Personnel, the General Department of Civil Judgment Execution to keep records of officials, public employees and employees according to regulations.
3. The decision to raise the regular salary level and raise the salary level ahead of time for officials, public employees and employees signed by the heads of the units according to their decentralized authority must be copied and sent to the Department of Organization and Personnel.
