What are use of force according to the Law on Mobile Police of Vietnam?
Pursuant to Clause 1, Article 2 of the Law on Mobile Police 2022 stipulates as follows:
“Article 2. Interpretation of terms
In this Law, the following terms are construed as follows:
1. Use of force means a method of using mental and physical strength, weapons, explosives, supporting tools, professional technical means and equipment for the Mobile Police to carry out functions, duties and powers.”
Accordingly, use of force are methods that the Mobile Police of Vietnam use to promote their functions, duties and powers.

Do Mobile Police of Vietnam have the duty to use use of force to fight riots and terrorism?
Pursuant to Article 9 of the Law on Mobile Police 2022, the duties of the Mobile Police are as follows:
“Article 9. Duties of Mobile Police
1. Advise the Minister of Public Security on use of force to protect national security and ensure social order and safety; build a revolutionary, regular, elite and modern Mobile Police.
2. Use of force mainly to combat acts of riots and terrorism.
3. Use of force and other working measures to perform the following tasks:
a) Attack, prevent the subject from committing the act of kidnapping hostages, using violence to infringe upon or threaten to infringe upon the life, health and property of individuals or organizations;
b) Dissolute mass gatherings causing disturbances to security and order;
c) Protect important political, economic, diplomatic, scientific - technical, cultural and social events and objectives and protecting the transportation of special goods;
d) Patrol and control to ensure security and order.
4. Develop and rehearse plans to perform the tasks specified in Clauses 2 and 3 of this Article. The Minister of Public Security shall prescribe the process of formulating and implementing the Mobile Police's plan.
5. Train and foster in command, military, martial arts, techniques and tactics for Mobile Police officers and soldiers and officers, soldiers and students in the People's Public Security; assume the prime responsibility for, and coordinate in training in, anti-terrorism work for specialized forces and forces mobilized to participate in counter-terrorism; participate in professional security training for security forces of ministries, branches and localities in accordance with law.
6. Manage, train and use professional animals to protect national security, ensure social order and safety.
7. Perform rituals in the People's Police and important events as prescribed.
8. Coordinate and support the People's Public Security and agencies, organizations, units and other forces in protecting national security, ensuring social order and safety, and fighting for prevention. Anti-crime; prevent, combat and overcome disasters, natural disasters and epidemics; search, rescue, rescue; build a movement of all people to protect national security.
9. Perform other duties as prescribed by the Law on People's Public Security and relevant laws.”
Thus, the Mobile Police have the duty to carry out the activities according to the above provisions.
Can the Mobile Police of Vietnam carry weapons and explosives when boarding civilian aircraft?
Pursuant to Article 10 of the Law on Mobile Police 2022 stipulates as follows:
“Article 10. Powers of Mobile Police
1. Use weapons, explosives, combat gears, technical means and equipment as prescribed in Article 15 of this Law.
2. Bring weapons, explosives, combat gears, vehicles and professional technical equipment to the airport or to board a civilian aircraft for duty in one of the following cases:
a) Fight terrorism, rescue hostages; repress subjects committing dangerous acts using weapons and explosives;
b) Protect special cargo transportation; escort the accused or defendants of particularly serious crimes;
c) Use aircrafts specifically mobilized by competent authorities for the Mobile Police to promptly deal with complicated security and order cases.
3. Prevent and disable unmanned aircraft and ultralight aircraft from directly attacking, threatening to attack or infringing on the protection targets of the Mobile Police within the no-fly zone, the area restricted areas according to regulations of the Prime Minister.
4. Handle administrative violations in accordance with the law on handling of administrative violations.
5. Mobilize civil people, vehicles and equipment from agencies, organizations and individuals in Vietnam according to the provisions of Article 16 of this Law and relevant laws.
6. Request agencies, organizations and individuals to provide diagrams and designs of works, headquarters, houses and vehicles, except for defense works, military zones, and vehicles under the management of Department of Defense; enter the headquarters of agencies, organizations and individuals according to the provisions of Article 13 of this Law to fight terrorism, rescue hostage.
7. Other powers as prescribed by the Law on People's Public Security and relevant laws.”
Accordingly, the Mobile Police of Vietnam will have the rights specified above. In particular, the Mobile Police will have the right to carry weapons and explosives when boarding a civilian aircraft to perform tasks according to the cases mentioned in the above regulations.
The Law on Mobile Police 2022 will take effect from January 1, 2023.
