Are medical staff and grassroots health workers entitled to increase occupational incentive allowances in Vietnam from January 1, 2023?

The current level of occupational incentive allowance for incentive health workers and grassroots medical staff is specified in Article 3 of Decree 56/2011/ND-CP as follows:

- The allowance level of 70% applies to civil servants who regularly and directly perform the following tasks:

+ Testing, examining, treating and caring for patients with HIV/AIDS, leprosy, tuberculosis, and mental illness;

+ Forensic examination, forensic psychiatry, pathology.

- The allowance level of 60% applies to civil servants who regularly and directly perform the following jobs:

+ Examining, treating and taking care of patients in emergency, emergency resuscitation, emergency 115, infectious disease;

+ Testing and prevention of infectious diseases;

+ Border medical quarantine.

- The 50% allowance applies to civil servants and public employees who regularly examine, treat, care for and serve patients with anesthesia, resuscitation, intensive care, pediatrics, anti-toxicity, burns and dermatology.

- The allowance level of 40% applies to regular civil servants and employees who directly work in incentive medicine; test; medical examination and treatment; infection control, patient care, functional rehabilitation; medical assessment; traditional medicine; cosmeceuticals; food safety and hygiene, medical equipment; reproductive health at public non-business medical establishments and at nursing facilities for war invalids, sick soldiers and people with special disabilities, except for the cases specified in Clauses 1, 2 and 3, Article 3 of the Decree 56/2011/ND-CP.

- The 30% allowance applies to the following civil servants and public employees:

+ Civil servants and public employees who regularly and directly work as medical professionals to perform the following tasks: health education communication; population - family planning;

+ Civil servants and public employees who manage and serve not directly working as medical professionals at establishments, institutes, specialized hospitals, centers: HIV/AIDS, leprosy, tuberculosis, psychiatric, pathological surgery , forensics.

- For civil servants and public employees who do not directly work as medical professionals; public servants and health workers in charge of management and service at medical non-business units in general (except for the subjects specified at Point b, Clause 5, Article 3 of Decree No. 56/2011/ND-CP), medical staff If a person performs medical professional work at an agency, unit or school, the head of the unit shall consider and decide based on the characteristics of the job and revenue sources, but not exceeding 20% of the salary level. , the current beneficiary plus the allowance for the position of leader, the seniority allowance beyond the bracket (if any) of the beneficiary.

However, according to Clause 1, Article 3 of Resolution 69/2022/QH15 stipulating the implementation of the salary policies:

- From January 1, 2023, raise the professional allowance of preventive and center-based healthcare workers according to Conclusion No. 25-KL/TW dated December 30, 2021 of the Politburo.

- General reform of salary policies under Resolution No. 27-NQ/TW dated May 21, 2018 of the 12th Central Executive Committee is implemented.

Increase salary for medical staff according to the statutory pay rate increase regime?

Also in Clause 1, Article 3 of Resolution 69/2022/QH15 on the implementation of the salary policy, it is mentioned as follows:

From July 1, 2023, the statutory pay rate will be adjusted from VND 1,490,000/month (according to Decree 38/2019/ND-CP) to VND 1,800,000 /month.

Ministries, central government authorities, and local government authorities shall adopt solutions for generating resources for salary policy reform as per the law.

During 2023 - 2025, continue to exclude some revenues when calculating revenues of the local government budget in order to implement salary reform in accordance with Resolution No. 34/2021/QH15 dated November 13, 2021 of the National Assembly.

How to calculate occupational incentive allowance for medical staff in Vietnam?

Pursuant to Article 5 of the Joint Circular 02/2012/TTLT-BYT-BNV-BTC stipulating the calculation method and funding sources for the payment of occupational incentive allowances as follows:

- The level of occupational incentive allowances is calculated on the salary by grade, the current enjoying level plus the allowance for the leadership position, the allowance for seniority beyond the bracket (if any), is determined by the following formula:

Occupational incentive allowances = General minimum salary x [Coefficient of salary grade, current rank + coefficient of allowance for leadership positions (if any) + % (according to coefficients) of intensive allowance years beyond the bracket (if any)] x Incentive allowances according to the occupations to be enjoyed

Occupational incentive allowances for 1 month = 830,000 VND x [4.06 + 0.4 + (4.06 x 7%)] x 70% = 2,756,802 VND

- Occupational incentive allowances in Vietnam are calculated and paid in the same monthly salary period.

- Occupational incentive allowances in Vietnam are not used to calculate payment and enjoy social insurance and health insurance regimes.
