Are the assistant employees who are the subjects participating in voluntary social insurance in Vietnam?

Pursuant to Article 8 of the Procedure issued together with the Decision No. 595/QD-BHXH dated 2017, participants in voluntary social insurance in Vietnam include:

The persons participating in voluntary social insurance are Vietnamese citizens aged full 15 years or older and not subject to take part in compulsory social insurance in accordance with regulations of law on social insurance, including:

- The employees who work under labor contracts with a term of less than 03 months before January 01, 2018; the employees who work under labor contracts with a term of less than 01 month from January 01, 2018 onwards;

- Part-time workers in hamlets, villages, residential groups, areas and quarters;

- The domestic worker;

- Those who participate in production, business and service activities without salary;

- Cooperative members who do not enjoy salaries or wages working in their cooperatives or unions of cooperatives;

- Farmers and self-employed workers, including those who organize their work to earn income for themselves and their families;

- The employees are eligible for age but not eligible for the time of payment to enjoy their pension in accordance with regulations of law on social insurance;

- Other participants.

Agencies, organizations and individuals related to voluntary social insurance.

Thus, in accordance with the above regulation, the domestic worker is subject to the detention of voluntary social insurance.

How to pay voluntary social insurance in Vietnam?

Pursuant to the provisions in Article 9 of the Procedure issued together with Decision No. 595/QD-BHXHC dated 2017 amended by Clause 14, Article 1 of Decision No. 505/QD-BHXH by 2020, the method of payment of voluntary social insurance in Vietnam premium is specified as follows:

A participant in voluntary social insurance may choose one of the following methods of payment to the retirement and survivorship fund:

- Monthly payment;

- Payment every 03 months;

- Payment every 06 months;

- Payment every 12 months;

- Lump sum payment for multiple years but not exceeding 5 years once;

- Lump sum contributions for remaining years shall be paid to a participant in social insurance who has reached the statutory retirement age but his/her payment period of social insurance contributions lacks 10 years or less (120 months). Where they are participating in compulsory social insurance, they shall pay the one-time voluntary social insurance premium for the remaining years in the month of eligibility for age pension entitlement.

If a participant in social insurance in Vietnam who has reached the statutory retirement age but still lacks over 10 years of his/her payment period wishes to continue paying voluntary social insurance contributions by one of the methods prescribed in Points 1.1, 1.2, 1.3, 1.4 and 1.5 Clause 1 of this Article until the payment period of social insurance lacks under 10 years, he/she will make a lump sum payment for remaining years to receive his/her pensions as prescribed in Point 1.6. Clause 1 of this Article.

Change of method of payment of voluntary social insurance premium

- The participant in voluntary social insurance may change the payment method when completing the previously chosen method.

- If a participant in voluntary special insurance who has chosen one of the methods prescribed in Clause 1 of this Article is eligible for making a lump sum payment for the remaining years (a man shall be 60 years old and a woman shall be 55 years old and the remaining period is 10 years or less), he/she may choose to make a lump sum payment as soon as eligible and the chosen method is not required to be completed.

Thus, the method of payment of voluntary social insurance premium is the same as above.

For voluntary social insurance, the premium rate is how much?

Pursuant to Clauses 1 and 2 Article 10 of the Procedure issued together with the Decision No. 595/QD-BHXHC:

The monthly premiums of a participant in voluntary social insurance shall be calculated as follows:

Mdt = 22% x Mtnt

Where:

- Mdt: Monthly payment rate of voluntary social insurance premium.

- Mtnt: the monthly income chosen by the participant in voluntary social insurance.

Mtnt = CN + m x 50,000 (dong/month)

Where:

- CN: Poverty line of rural areas at the time of payment (dong/month).

- m: Natural parameter valued from 0 to n.

The monthly income chosen by the participant in voluntary social insurance in Vietnamvoluntary social insurance in Vietnam is at least equal to the poverty line in rural areas and not exceeding 20 times the statutory pay rate.

The premium for every 03, 06 or 12 months equals the monthly premium prescribed in Clause 1 of this Article multiplied by 3, 6, 12 respectively.

Pursuant to Clause 7 Article 10 of the Procedures issued together with the Decision No. 595/QD-BHXH in 2017 as follows:

7. Change of monthly income as a basis for payment of voluntary social insurance premium
7.1. A participant in voluntary social insurance may change his/her monthly income as the basis for payment when completing the method of payment of the previous chosen monthly income.
7.2. If a participant in voluntary social insurance who has chosen the monthly income as the basis for payment of voluntary social insurance is eligible for making a lump-sum payment for the remaining years (a man shall be 60 years old and a woman shall be 55 years old and the remaining period is 10 years or less), he/she may choose the monthly income as the basis for payment of voluntary social insurance premium for the remaining years without waiting for completing the chosen monthly income.
