Prohibiting the Giving of Tet Gifts to Leaders at All Levels in All Forms During Tet Nguyen Dan Giap Thin 2024?

Based on Section 3 Directive 26-CT/TW of 2023, the Secretariat directs the organization of Tet Nguyen Dan 2024 as follows:

3. Do not organize visits and extend Tet greetings to superiors and leaders at all levels; do not organize Central delegations to visit and extend Tet greetings to committees, authorities of provinces, and cities; strictly prohibit the giving and receiving of Tet gifts to leaders at all levels in all forms; leaders at all levels are only allowed to attend temple ceremonies and festivals when assigned; do not participate in superstitious activities; do not use state budget, means, and public assets illegally for festival and entertainment activities... Strictly observe regulations on the responsibility of setting an example by officials, party members, and things party members are not allowed to do.

The Secretariat strictly prohibits the giving and receiving of Tet gifts for leaders at all levels in all forms during Tet Nguyen Dan 2024.

Strictly prohibiting the giving and receiving of Tet gifts to leaders at all levels in all forms aims to limit acts of power manipulation as regulated in Article 4 of Regulation 114-QD/TW of 2023 as follows:

Acts of Power Manipulation

1. Directly or indirectly mediating, giving, and receiving bribes to help others acquire positions, titles, and benefits.

2. Giving gifts, money, real estate, or other material and immaterial benefits, arranging entertainment activities for those with authority and responsibility to gain support, trust, positions, titles, and benefits.

3. Manipulating age, seniority, emulative titles, commendations, degrees, assignments, appointments, nominations, designations, transfers, deployments, and military rank promotions... to meet standards and conditions to obtain positions and benefits.

4. Exploiting personal relationships or utilizing the influence, position, or prestige of others to impact, curry favor, create pressure on those with authority and responsibility to obtain positions, titles, and benefits.

5. Leveraging insider information or the unfavorable information of organizations or individuals to impose conditions or exert pressure on those with authority and responsibility in assignment, appointment, nomination, designation of oneself or others.

6. Using one’s or a family’s background, achievements, service record to impose unreasonable demands on organizations or individuals with authority and responsibility to gain positions and benefits.

Tet Nguyen Dan 2024 Holiday Schedule for Officials and Public Employees?

On November 22, 2023, the Ministry of Labor, Invalids, and Social Affairs announced the Tet Nguyen Dan Giap Thin and National Day holiday schedule for 2024 for officials and public employees and workers.

According to Notice 5015/TB-LDTBXH of 2023 by the Ministry of Labor, Invalids, and Social Affairs (MOLISA), officials and public employees and workers will have Lunar New Year 2024 off from Thursday, February 8, 2024 (29th of Lunar December, Quy Mao year) to Wednesday, February 14, 2024 (5th of Lunar January, Giap Thin year).

(The Tet Nguyen Dan holiday includes 05 days of the Lunar New Year and 02 compensatory weekly rest days as prescribed in Clause 3, Article 111 of the Labor Code 2019).

How is the Salary for Working During Lunar New Year 2024 Calculated?

Based on the provisions of Article 98 of the Labor Code 2019, regulations on overtime wages and nighttime work wages are as follows:

Overtime Wages and Nighttime Work Wages

1. Employees working overtime shall be paid according to the wage unit price or the paid wage of the work being done as follows:

*a) On regular days, at least 150%;*
*b) On weekly rest days, at least 200%;*
*c) On holidays, Tet, paid leave days, at least 300% not including the wage for holidays, Tet, or paid leave days for employees paid on a daily basis.*

2. Employees working at night shall be paid an additional night work wage of at least 30% of the wage unit price or the paid wage of the daytime work of a regular day.

3. Employees working overtime at night shall be paid, apart from the wage prescribed in Clauses 1 and 2 of this Article, an additional 20% of the wage unit price or the paid wage of the daytime work of a regular day or weekly rest day or holiday, Tet.

4. the Government of Vietnam shall detail this Article.

In the case of employees working on Tet holidays, they shall receive a wage of at least 300%, not including the Tet holiday wage for employees paid on a daily basis.

Moreover, in the case of nighttime work, employees shall be paid an additional 30% of the wage of a regular working day and 20% of the wage of Tet holiday.

Thus, working during Tet Nguyen Dan 2024, the salary is calculated as follows:

- Daytime work: At least 400% of the wage.- Nighttime work: At least 490% of the wage.
