The report form for labor usage in the first six months of 2024 is Form No. 01/PLI, Appendix I, issued together with Decree 145/2020/ND-CP.

Instructions for filling out Form 01/PLI for 2024 labor usage report are as follows:
- Section (1): Indicate the Department of Labor, Invalids, and Social Affairs; the district-level social insurance agency where the headquarters, branches, or representative offices are located.
- Section (2) Job positions classified as follows:
+ Column (8) Managers: This group includes leaders and managers working in various sectors, levels, and within agencies, organizations, and enterprises holding positions with the authority to manage, command, and direct from central to commune levels;
+ Column (9) High-level technical professionals: This group includes occupations that require advanced knowledge, expertise, and experience (university level or higher) in science and technology, health, education, business and management, information and communication technology, law, culture, and society;
+ Column (10) Mid-level technical professionals: This group includes occupations that require mid-level knowledge and experience (college, intermediate) in fields of science and technology, health, business and management, law, culture, society, information and communication, teachers, education, and information technology.

What is the deadline for submitting labor usage reports in 2024?
In Article 4 of Decree 145/2020/ND-CP, as amended by Clause 1, Article 73 of Decree 35/2022/ND-CP, it is regulated about labor usage reporting as follows:
Labor Usage Reporting
The registration of labor usage, periodic reporting on changes in labor at Clause 2, Article 12 of the Labor Code is regulated as follows:
1. The employer registers labor usage as per Decree No. 122/2020/ND-CP dated October 15, 2020, of the Government of Vietnam, stipulating the coordination and interlinking of procedures for enterprise establishment registration, branch, and representative office establishment registration, labor usage registration, issuance of unit code for social insurance participation, and registration for enterprise bill usage.
2. Periodically every 6 months (before June 5) and annually (before December 5), employers must report changes in labor to the Department of Labor, Invalids, and Social Affairs through the National Public Service Portal according to Form No. 01/PLI in Appendix I issued together with this Decree and notify the district-level social insurance agency where the headquarters, branches, or representative offices are located. In cases where employers cannot report labor changes through the National Public Service Portal, they shall send paper reports in accordance with Form No. 01/PLI in Appendix I issued together with this Decree to the Department of Labor, Invalids, and Social Affairs and notify the district-level social insurance agency where the headquarters, branches, or representative offices are located. For labor working in industrial zones, economic zones, employers must report labor changes to the Department of Labor, Invalids, and Social Affairs, district-level social insurance agency where the headquarters, branches, or representative offices are located, and the Management Board of the industrial zone, economic zone for monitoring.
The Department of Labor, Invalids, and Social Affairs is responsible for compiling labor changes in case employers send paper reports to fully update information according to Form No. 02/PLI in Appendix I issued together with this Decree.
3. Periodically every 6 months, before June 15, and annually, before December 15, the Department of Labor, Invalids, and Social Affairs is responsible for reporting to the Ministry of Labor, Invalids, and Social Affairs on labor usage in their area through the National Public Service Portal according to Form No. 02/PLI in Appendix I issued together with this Decree.

Thus, according to the above regulations, the time to submit labor usage reports in the year is specified as follows:
- Reporting time to the Department of Labor, Invalids, and Social Affairs: Periodically every 6 months (before June 5) and annually (before December 5).
*In cases where employers cannot report labor changes through the National Public Service Portal, they shall send paper reports according to Form No. 01/PLI in Appendix I issued together with Decree 145/2020/ND-CP to the Department of Labor, Invalids, and Social Affairs and notify the district-level social insurance agency where the headquarters, branches, or representative offices are located.
- Reporting time to the Ministry of Labor, Invalids, and Social Affairs: Periodically every 6 months, before June 15, and annually, before December 15.
*In cases where the Department of Labor, Invalids, and Social Affairs cannot report labor usage through the National Public Service Portal, they shall send paper reports to the Ministry of Labor, Invalids, and Social Affairs according to Form No. 02/PLI in Appendix I issued together with Decree 145/2020/ND-CP.
Penalties for Late Submission of Labor Usage Reports
According to Point 2, Article 8 of Decree 12/2022/ND-CP, regulations on sanctions for violations regarding recruitment and labor management include:

2. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed on employers committing any of the following acts:
a) Discrimination in labor except for discriminatory actions stipulated at Point d, Clause 1, Article 13; Clause 2, Article 23; Clause 1, Article 36; and Clause 2, Article 37 of this Decree;
b) Employing untrained labor or labor without national vocational skill certificates for jobs requiring trained labor or national vocational skill certificates;
c) Failing to report changes in labor as prescribed;
d) Failing to establish or properly maintain labor management books within the stipulated time or ensuring basic content as per the law.
Thus, employers failing to submit labor usage reports within the prescribed timeframe will be fined from VND 5 million to VND 10 million.
Note: The above-mentioned monetary penalty applies to individuals. In the case of organizational violations, the monetary penalty is double that of individuals.
