How to register online temporary residence for tenants in 2023?

Pursuant to the provisions of Article 3 of Circular No. 55/2021/TT-BCA stipulating as follows:

Receipt of applications for residence registration and announcement of results thereof
1. Applications for residence registration shall be directly received at offices of residence registration authorities (hereinafter referred to as “registration authorities”) or via the national public service portal, public service portal of the Ministry of Public Security or public service portal for residence management.
2. Applicants submitting their applications directly may submit certified copies or copies issued from the master registers (hereinafter referred to as “copies”) or photocopies together with their authentic copies for comparison. In case an applicant submits a photocopy together with its authentic copy, the application recipient shall inspect and compare the photocopy with its authentic copy and countersign and shall not request the applicant to submit a copy of such document.
3. Applicants submitting their applications via the national public service portal, public service portal of the Ministry of Public Security or public service portal for residence management shall declare information and attach scans or photocopies of necessary documents according to regulations. Citizens shall present the authentic copies of provided documents at the request of residence registration personnel.

Step 4: Enter the phrase "Temporary residence" in the search box and select "Registration for temporary residence"

Step 5: Fill in the required information.

Note: Fill in all information; Information fields marked with a red (*) are required and cannot be left blank.

Step 6: In the section “Procedures for implementation”, you can choose one of the following two items to declare the corresponding case and upload the files according to Section 2 - Registration of temporary residence to establish a new household - Registration of temporary residence into an existing household

Do I have to sign a rental agreement? Does the rental agreement have to be notarized?

In essence, renting a motel is the same as renting a house, so based on Article 121 of the 2014 Law on Housing in Vietnam stipulating as follows:

Housing agreement in Vietnam
A housing agreement in Vietnam shall be concluded by contracting parties and made in writing, including:
1. Full names of individuals, names of organizations and addresses of contracting parties;
2. Description of characteristics of the house and the piece of land attached to that house. Regarding agreements on apartment sale or lease purchase, contracting parties must state the common areas or common-using areas; private areas; floor area; purposes of the common areas or common-using areas in the apartment building according to approved design;
3. The value of contributed capital, the transaction price of housing if there is a term on pricing in the agreement; regarding transactions in housing sale, lease, or lease purchase which is regulated pricing by the State, contracting parties shall comply with that regulations;
4. Deadline for and method of payment regarding transactions in housing sale, lease, lease purchase or transfer of agreements on housing sale;
5. Deadline for housing transfer; housing warranty duration regarding transactions in buying or renting and buying new house; terms of agreements on housing lease, lease purchase, mortgage, lending, permission for stay, authorization of housing management; deadline for capital contribution;
6. Rights and obligations of contracting parties;
7. Commitments of contracting parties;
8. Other agreements;
9. Effective date of the agreement;
10. Date of agreement;
11. Signatures and full names of contracting parties, or stamps (if any) and positions of the signatories regarding organizations.

Pursuant to the provisions of Article 122 of the 2014 Law on Housing in Vietnam as follows:

Notarization and authentication of agreements and effective date of housing agreements
1. Regarding agreements on housing sale, giving, exchange, capital contribution, mortgage, or transfer of agreement on commercial housing sale, it is required to notarize or authenticate the agreement, except for cases prescribed in Clause 2 of this Article.
Regarding any agreement prescribed in this Clause, the effective date of the agreement shall be the date on which the agreement is notarized or authenticated.
2. Regarding transactions in giving houses of gratitude; sale or lease purchase of state-owned housing; sale or lease purchase of social housing, housing serving the relocation; contributed housing which one entity of contracting parties is an organization; housing lease, lending, permission for stay, or authorization of housing management, it is not required to notarize or authenticate the agreement, unless contracting parties wish to notarize or authenticate the agreement.
Regarding any agreement prescribed in this Clause, the effective date of the agreement shall be agreed by contracting parties; if the contracting parties do not agree, the effective date of agreement shall be the date on which the agreement is signed.
3. The documents on housing inheritance must be notarized or authenticated as prescribed in law on civil.
4. The notarization of housing agreement must be carried out at a notary; the authentication of housing agreement must be carried out at the People’s Committee of the commune where the house is located.

Thus, students need to pay attention when renting an accommodation, the first thing to do is to sign a written rental agreement.

At the same time, the rental agreement of a house or inn is not required to be notarized or authenticated.

How much is the electricity price for students renting accommodation?

Pursuant to Point c, Clause 4, Article 10 of Circular No. 16/2014/TT-BCT (amended by Clause 5, Article 1 of Circular No. 25/2018/TT-BCT) stipulating as follows:

Retail price for domestic purpose
....
4. Electricity used for domestic purposes by tenants, the price of electricity shall be applied as follows:
...
c) In case tenants are students or workers (not a household):
- If a tenant enters into a lease agreement with a lease period of at least 12 months and has completed procedures for registration of temporary residence, the house owner or the tenant's representative shall enter into a power purchase agreement (accompanied by the house owner's commitment to make electricity bill payment);
- If the lease period is less than 12 months and the house owner fails to declare the number of occupants using electricity as regulated, the retail price of electricity for domestic purpose at level 3 (from 101 kWh to 200 kWh) shall apply to total amount of electricity measured by the electric meter.
If the house owner has completed procedures for declaration of the number of occupants using electricity in the house, the electricity seller shall decide the limit on amount of electricity based on the temporary residence register or the document certifying registered temporary residence granted by local police agency; Every four occupants shall be considered as a household for deciding the limit on amount of electricity. To be specific: 01 occupant, 02 occupants, 03 occupants and 04 occupants are regarded as 1/4 of a household, 1/2 of a household, 3/4 of a household and a household respectively. In case of change in the number of occupants, the house owner shall inform the seller to adjust the limit on amount of electricity for calculating electricity bill.
The seller is entitled to monthly inspect and request the buyer to present the temporary residence register to verify the number of occupants in the house.

At the same time, according to the Appendix issued with Decision No. 648/QD-BCT in 2019 stipulating that the price of electricity used for domestic purposes is calculated incrementally according to the retail price list as follows:

Currently, usually when renting to students, the rental period is usually less than 12 months. Therefore, students who rent accommodation usually only have to pay the electricity price corresponding to the retail electricity price of level 3 which is 2,014 VND/kWh.
