Will the allowances for the Chief of the Commune Military Command be reduced when implementing the 2024 salary reform?
Currently, the Chief of the Commune Military Command receives the following allowances according to Decree 72/2020/ND-CP:
- The position allowance of the Chief of the Commune Military Command is paid monthly at a specific rate of 357,600 VND.
- In addition to the monthly position allowance, the Chief of the Commune Military Command is entitled to a seniority allowance of 5% of the current salary and position allowance, including any additional seniority allowance beyond the norm if they have served for at least 60 months. From the 6th year onward, an additional 1% is added each year.
According to the salary reform directive in Resolution 27-NQ/TW of 2018, existing allowance policies will be rearranged, ensuring that the total allowance fund accounts for a maximum of 30% of the total salary fund as follows:
- Continued application of position allowances; seniority allowance beyond the norm; regional allowance; work responsibility allowance; mobility allowance; security, defense service allowance; and specific allowances for armed forces (military, police, cipher).
- Combining professional incentive allowances, responsibility allowances according to profession, and hazardous and dangerous allowances (collectively referred to as professional allowances) applicable to officials and public employees in occupations and jobs with higher-than-normal working conditions and having appropriate preferential policies of the State (education and training, health, court, prosecution, civil judgment enforcement, inspection, examination, audit, customs, forest protection, market management, etc.). Combining special allowances, attraction allowances, and long-term work subsidies in areas with particularly difficult socio-economic conditions into allowances for working in extremely difficult areas.
- Abolishing professional seniority allowances (except for the military, police, and cipher to ensure salary correlation with officials); leadership position allowances (as leadership positions in the political system will implement position-based salaries); party, socio-political organization service allowances; public service allowances (as they are included in the basic salary); hazardous and dangerous allowances (as hazardous and dangerous working conditions are included in professional allowances).
- Establishing new allowance policies according to administrative unit classification for communes, districts, and provinces.
Thus, after implementing the 2024 salary reform, the allowances that the Chief of the Commune Military Command receives will change:
+ Currently, the Chief of the Commune Military Command is still an official at the commune level according to the provisions of Decree 33/2023/ND-CP. However, clause 3 of Article 23 of the Militia and Self-Defense Force Law 2019 stipulates that an officer of the Vietnam People's Army holds the position of chief of the militia and self-defense force in necessary cases. Therefore, concerning the seniority allowance after salary reform if:
(1) The Chief of the Commune Military Command is appointed under normal standards and is not an officer of the Vietnam People's Army filling the position in necessary cases, they are still a commune-level official and hence the professional seniority allowance will be abolished.
(2) The Chief of the Commune Military Command is an officer of the Vietnam People's Army holding the position in necessary cases, they will continue to receive the professional seniority allowance.
+ The position allowance for the Chief of the Commune Military Command will be abolished regardless of whether they are a commune-level official or an officer of the Vietnam People's Army.
+ The seniority allowance beyond the norm will continue to be applied.

Who comprises the Commune Military Command?
According to clause 1, Article 20 of the Militia and Self-Defense Force Law 2019, the Commune Military Command is the permanent agency for defense work at the commune level. The Commune Military Command includes:
+ The Chief, who is a member of the Commune People's Committee, a reserve officer; in a defense emergency, wartime, may be called to active service as prescribed by the Law on Vietnam People's Army Officers and continue to hold the position of Chief of the Commune Military Command;
+ The Political Commissar, who is also the Secretary of the Commune Party Committee;
+ The Deputy Political Commissar, who is the Secretary of the Ho Chi Minh Communist Youth Union at the commune level;
+ The Deputy Chief, who is a part-time worker at the commune level.
Who has the authority to establish the Commune Military Command and appoint the Chief of the Commune Military Command?
According to point e, clause 1, Article 22 of the Militia and Self-Defense Force Law 2019, the Commander of the Hanoi Capital Command, the Commander of the Ho Chi Minh City Command, the Chief of the Provincial Military Command decide to establish the Commune Military Command.
The authority to appoint the Chief of the Commune Military Command belongs to the Chairman of the District People's Committee according to point d, clause 1, Article 23 of the Militia and Self-Defense Force Law 2019.
