According to the provisions of Article 1 Circular 95/2022/TT-BYT on the position and functions of the Ministry of Health, they are as follows:

The Ministry of Health is a governmental body of the Government of Vietnam, performing state management functions in health, including the following fields: preventive medicine; medical examination, treatment, and rehabilitation; medical expertise, forensic medicine, forensic psychiatry; traditional medicine and pharmacy; medical equipment; pharmaceuticals, cosmetics; food safety; health insurance; population and reproductive health; state management of public services in the fields under the state management of the Ministry.

According to the provisions of Clause 6 Article 2 Circular 95/2022/TT-BYT, one of the tasks of the Ministry of Health, which includes tasks and powers regarding medical examination, treatment, and rehabilitation, medical expertise, forensic medicine, forensic psychiatry, is as follows:

- Develop, promulgate according to authority or submit to competent authorities for the promulgation of professional regulations, national standards, national technical regulations, economic-technical norms, and quality criteria in the fields of: medical examination, treatment, blood safety, nursing, rehabilitation, clinical nutrition, infection control, cosmetic surgery; donation, collection, and transplantation of tissues and organs of the human body; medical expertise, forensic medicine, forensic psychiatry as prescribed by law;

- Approve the planning of the specialized healthcare system; specify the specialization details of technical levels for medical examination and treatment facilities according to each level;

- Manage the issuance, re-issuance, and revocation of practicing certificates and operational licenses in the field of medical examination and treatment; organize the initial issuance, adjustment, re-issuance, and revocation of medical practice certificates for individuals working at medical facilities under the Ministry of Health, individuals working at medical facilities under other ministries (except the Ministry of National Defense), foreign individuals practicing medical examination and treatment in Vietnam; initial issuance, adjustment, re-issuance, and revocation of operational licenses for medical facilities under the Ministry of Health, private hospitals, or hospitals under other ministries (except the Ministry of National Defense) as prescribed by law;

- Appraise and authorize medical facilities to apply new techniques and methods for the first time in Vietnam as prescribed by law;

- Issue confirmations of advertising content for activities related to medical examination and treatment within its authority as prescribed by law;

- Lead and cooperate with relevant ministries and central authorities to perform state management of service prices for medical examination and treatment as prescribed by law;

- Direct, guide, inspect, and audit the implementation of legal documents, professional regulations, national standards, and national technical regulations in the fields of medical examination, treatment, rehabilitation, cosmetic surgery, medical expertise, forensic medicine, forensic psychiatry.

How has the organizational structure of the Ministry of Health changed?

According to the provisions of Article 3 Decree 95/2022/ND-CP, the organizational structure of the Ministry of Health includes:

- 18 organizations assisting the Minister in performing state management functions:

+ Department of Health Insurance.

+ Department of Maternal and Child Health.

+ Department of Personnel and Organization.

+ Department of Planning and Finance.

+ Department of Legal Affairs.

+ Department of International Cooperation.

+ Ministry Office.

+ Ministry Inspectorate.

+ Department of Science Technology and Training.

+ Department of Preventive Medicine.

+ Department of HIV/AIDS Prevention and Control.

+ Department of Health Environmental Management.

+ Department of Medical Examination and Treatment Management.

+ Department of Traditional Medicine and Pharmacy Management.

+ Department of Pharmaceutical Management.

+ Department of Food Safety.

+ Department of Infrastructure and Medical Equipment.

+ Department of Population.

- 03 public service providers directly under the Ministry, serving the state management functions of the Ministry of Health, including:

+ Institute of Health Strategy and Policy.

+ National Health Information Center.

+ Health and Life Newspaper.

Thus, compared to the previous organizational structure, Decree 95/2022/ND-CP has established and dissolved certain agencies and public service providers as follows:

- Dissolve 03 agencies and public service providers under the Ministry: Department of Communications and Emulation, Commendation, Department of Medical Equipment and Works, Journal of Medicine and Pharmacy.

- Establish 02 new agencies and public service providers under the Ministry: Department of Infrastructure and Medical Equipment, National Health Information Center.

- Reorganize 01 agency and public service provider under the Ministry: General Department of Population reorganized into the Department of Population.

Decree 95/2022/ND-CP takes effect from November 15, 2022, replacing Decree 75/2017/ND-CP.
