In the past time, loan sharking and "black credit" activities with many sophisticated and reckless tricks, especially tricks of lending money through applications (apps) or setting up accounts and groups on the Internet. Social networks (Zalo, Facebook) to invite and seduce small business people, low-income workers, workers, young people, etc. to borrow money are complicated. The subjects that individuals and organizations lend "black credit" towards are people with difficult circumstances, students, students, low-income workers, etc.

For this type of crime, the Ministry of Public Security and functional ministries and branches have been stepping up activities to investigate and strictly handle the subjects participating in the line, committing illegal acts related to " black credit” or other subjects involved in introducing and propagating black credit. Black credit activities on the internet are sophisticatedly deployed, associated with debt collection activities in real life, violating the criminal law, so it needs to be strictly handled by the authorities as a deterrent.

Although over the past time, the Government has given instructions to drastically push back the situation of "black credit" which is becoming more and more popular and widespread. However, this situation continues to recur and brings bad results to society. There have been cases where debtors beat or killed a “black credit” creditor or debtors decided to commit suicide because they could not pay off the interest.

What solutions has the Ministry of Information and Communications implemented to prevent the current "black credit"in Vietnam situation?

Pursuant to Official Letter 2163/BTTTT-VP-2163-BTTTT-VP-2022-giai-phap-kiem-tra-cac-dich-vu-cho-vay-nang-lai-truc-tuyen-7E384.html dated June 6, 2022 issued by the Ministry of Information and Communications on answering questions from National Assembly Delegate Nguyen Tao. According to the content of this Official Dispatch, the Ministry of Information and Communications has implemented and coordinated with relevant ministries and agencies the following solutions to prevent the situation of "black credit":

- Directing and orienting press information:

+ The Ministry has coordinated with the Ministry of Finance and the State Bank to direct the press, radio and television agencies to inform and propagate about crime prevention and combat in general and "black credit" financial lending. in particular.

+ Proposing to develop regulations on inter-sectoral coordination in communication, prevention and control of financial crimes and "black credit" activities.

- Directing and processing information on the network:

+ The Ministry has directed domestic social network service providers to strengthen their review and work closely with the Ministry of Public Security, the Ministry of Information and Communications and functional agencies to prevent illegal activities.

+ Request cross-border social networks to remove fraudulent links related to loan sharking, "black credit" activities

+ Research and apply technical tools to scan online information for "black credit" content, thereby improving the efficiency of information management.

- Guide and exchange expertise and experience in inspection work with the Departments of Information and Communications to deploy synchronously and focus resources, proactively detect and handle violations related to the inspection activities early. activities of "black credit" in general and "black credit" in the network environment in particular.

- Closely coordinate and provide information to relevant ministries, departments and agencies such as the Ministry of Public Security, the Ministry of Finance, and the State Bank in management, supervision, inspection, examination and handling. crimes in cyberspace and nationwide.

Specific results: In the first 5 months of 2022, the Ministry of Information and Communications has written and applied its own technical systems to direct and coordinate telecommunications carriers to prevent and handle more than 15 Website impersonating official financial companies such as: Homecredit, LOTTE Finance... to perform online fraud.

Lending "black credit" in Vietnam can be criminally prosecuted?

Pursuant to Article 201 of the Penal Code 2015 (replacing the phrase by point i, clause 2, Article 2 of the Law amending the Penal Code 2017) as follows:

“Article 201. Crime of lending heavy interest in civil transactions
1. Those who, in a civil transaction, lend at an interest rate 5 times or more than the highest interest rate prescribed in the Civil Code, earn an illegal profit of between VND 30,000,000 and under VND 100,000,000 or who have been administratively sanctioned for this act or have been convicted for this crime, have not yet had their criminal records remitted but continue to commit them, shall be subject to a fine of between VND 50,000,000 and 200,000,000 or a non-rehabilitative penalty. imprisoned for up to 3 years
2. Committing the crime and earning an illegal profit of VND 100,000,000 or more, the offenders shall be subject to a fine of between VND 200,000,000 and 1,000,000,000 or a prison term of between 6 months and 3 years.
3. The offenders may also be subject to a fine of between VND 30,000,000 and 100,000,000, a ban from holding certain posts, practicing certain professions or doing certain jobs for one to five years.”

Accordingly, lending "black credit" in VIetnam in one of the above cases will be prosecuted for criminal responsibility for the crime of lending heavy interest in civil transactions.
