Measures to Terminate Domestic Violence Implemented as Prescribed in the Law on Domestic Violence Prevention and Control 2022
Pursuant to the provisions of Article 23 of the Law on Domestic Violence Prevention and Control 2022, measures to terminate acts of domestic violence are implemented as follows:
- The competent person handling the domestic violence incident may immediately apply necessary measures as prescribed by law to terminate the act of domestic violence.
- Individuals present at the scene of a domestic violence incident, depending on their capabilities and the nature of the violence, have the responsibility to require the violator to cease the act of domestic violence immediately.

What are the Current Measures to Prevent Domestic Violence and Protect, Support Victims of Domestic Violence?
Pursuant to the provisions of Article 22 of the Law on Domestic Violence Prevention and Control 2022, the measures to prevent domestic violence and protect, support victims of domestic violence include:
- Force to terminate the act of domestic violence;
- Require the perpetrator of domestic violence to report to the commune-level police office where the incident occurred;
- Prohibit contact;
- Arrange temporary shelter and support essential needs;
- Care, treat the victims of domestic violence;
- Legal assistance and psychological counseling, skills training to cope with domestic violence;
- Educate, support behavior change in domestic violence perpetrators;
- Criticize, rebuke the domestic violence perpetrator within the community;
- Perform community service;
- Measures to prevent and ensure administrative violation handling according to the law on handling administrative violations; measures to prevent, protect victims according to the criminal procedure law for domestic violence perpetrators.
Where to Report Acts of Domestic Violence?
Pursuant to the provisions of Article 19 of the Law on Domestic Violence Prevention and Control 2022, the addresses receiving reports and allegations of domestic violence acts include:
- Commune-level people's committee where the domestic violence act occurred;
- Police agency, Border Guard station near the location of domestic violence act;
- Educational institution where the victim of domestic violence is a learner;
- Village chief, Residential group leader, Head of the Front Working Committee in the residential area where the domestic violence act occurred;
- Head of socio-political organizations at the commune level where the domestic violence act occurred;
- National hotline for domestic violence prevention and control.
Additionally, reports and allegations of domestic violence acts can be made in the following forms:
- Making calls, sending messages;
- Sending applications, letters;
- Directly reporting.
Furthermore, pursuant to the provisions of Article 10 of Decree 76/2023/ND-CP, the receipt of reports at points a, b, c, d, and e of Clause 1, Article 19 of the Law on Domestic Violence Prevention and Control 2022 is carried out as follows:
Step 1: Receive reports, allegations of domestic violence acts at addresses specified at points a, b, c, d, and e Clause 1 Article 19 of the Law on Domestic Violence Prevention and Control 2022:
- When receiving direct or phone reports, the receiver records information as per Form No. 04 of the Annex issued with this Decree and provides psychological counseling, coping skills with domestic violence acts;
- When receiving reports or allegations of domestic violence acts via messages, applications, letters, the receiver records information as per Form No. 05 of the Annex issued with Decree 76/2023/ND-CP.
Step 2: Handle reports, allegations of domestic violence acts at addresses specified at points a, b, c, d, and e Clause 1 Article 19 of the Law on Domestic Violence Prevention and Control 2022:
- The police agency, Border Guard station receiving reports, allegations of domestic violence acts must promptly prevent and handle domestic violence acts according to their competence; simultaneously notify the Chairman of the commune-level people's committee where the domestic violence act occurred. In case of reports, allegations of domestic violence acts where the victim is a child, they must handle according to the law on child protection;
- Immediately after receiving reports, allegations of domestic violence acts, the addresses specified at points c, d, and e Clause 1 Article 19 of the Law on Domestic Violence Prevention and Control 2022 must notify the Chairman of the commune-level people's committee of the area where the domestic violence act was reported and participate in preventing the act of domestic violence, supporting, protecting the victim of domestic violence according to their capabilities.
Step 3: Agencies, organizations, individuals receiving reports, allegations of domestic violence acts have the responsibility to cooperate with state agencies and competent persons according to the law on domestic violence prevention and control to verify the reports, allegations of domestic violence acts when requested.
Step 4: The police agency, Border Guard station specified in point a Clause 2 Article 10 of Decree 76/2023/ND-CP has the responsibility to notify the result of handling reports, allegations of domestic violence acts when requested by agencies, organizations, individuals reporting, alleging the domestic violence acts.
