Who are the relatives of martyrs entitled to monthly survivor benefits?
Based on the provisions of Clause 3, Article 16 of the Ordinance on Preferences for People with Meritorious Services to the 2020 Revolution, the following guidelines apply:
Preferential Regime for Relatives of Martyrs
1. Issuance of the "Certificate of Martyr's Family" as prescribed by the Government of Vietnam.
2. One-time survivor benefit upon posthumous award of the "Fatherland's Acknowledgment"; in case there are no surviving relatives, the heir of the martyr who keeps the "Fatherland's Acknowledgment" is entitled to a one-time survivor benefit.
3. Monthly survivor benefits for the following individuals:
a) Biological father, biological mother, children of martyrs under 18 years old or aged 18 years or older who continue to study or have severe disabilities, especially severe disabilities, persons who took care of martyrs; in the case of multiple martyrs, according to the levels for relatives of two martyrs, three martyrs, or more;
b) Spouse of the martyr.

Therefore, based on the above provisions, the relatives of martyrs entitled to monthly survivor benefits include:
- Biological father, biological mother, children of martyrs under 18 years old or aged 18 years or older who continue to study or have severe disabilities, especially severe disabilities, persons who took care of martyrs; in the case of multiple martyrs, according to the levels for relatives of two martyrs, three martyrs, or more;
- Spouse of the martyr.

Based on the provisions of Point c, Clause 1, Article 2 of Decision 22/2013/QD-TTg, Clause 1, Article 4 of Circular 98/2013/TT-BTC, relatives of martyrs are among the entities eligible for housing support for people with meritorious services.
Based on Clause 2, Article 4 of Circular 98/2013/TT-BTC guiding Article 3 of Decision 22/2013/QD-TTg on housing support levels for relatives of martyrs as follows:

2. Housing support levels from the state budget (including central and local budgets):
- 40 (forty) million VND/household for cases where existing houses are severely damaged and need to be demolished to build new houses.
- 20 (twenty) million VND/household for cases where the frame, walls need repair, and the existing roof needs to be replaced.
Therefore, based on the above provisions, the housing support level for relatives of martyrs is as follows:
- For cases where existing houses are severely damaged and need to be demolished to build new houses, the housing support level is 40,000,000 VND/household.
- For cases where the frame, walls need repair, and the existing roof needs to be replaced, the housing support level is 20,000,000 VND/household.
What are the procedures for providing housing support to relatives of martyrs?
Based on Article 4 of Circular 09/2013/TT-BXD, the procedures for providing housing support to relatives of martyrs include the following steps:
- Step 1:
+ The village head guides eligible individuals to apply for housing support.
+ Relatives of martyrs submit an application for housing support using the form in Appendix I attached to Circular 09/2013/TT-BXD.
+ The village head consolidates the applications and the list, sending them to the People's Committee of the commune-level town (collectively referred to as the commune-level People's Committee) where the house is located.
- Step 2:
+ The commune-level People's Committee establishes a steering committee to implement housing support for people with meritorious services, including representatives of the commune-level government, the Fatherland Front, the Veteran's Association, and organizes the inspection of the house status of each applicant.
+ After the inspection, the commune-level People's Committee prepares a list of individuals eligible for housing support within the commune (list, quantity, estimated support capital) using the form in Appendix II attached to Circular 09/2013/TT-BXD and sends it to the district-level People's Committee.
- Step 3: Based on the report from the commune-level People's Committee, the district-level People's Committee directs the Office of Labor, Invalids, and Social Affairs and related offices and departments to review, inspect, cross-check with the list of individuals with meritorious services under management, summarize and approve the list of individuals with meritorious services eligible for housing support within the district (using the form in Appendix III attached to Circular 09/2013/TT-BXD) and reports to the provincial-level People's Committee.
- Step 4:
+ Based on the report from the district-level People's Committee, the provincial-level People's Committee assigns the Department of Construction as the standing body to cooperate with the Department of Finance and the Department of Labor, Invalids, and Social Affairs to inspect, compare with regulations to prepare and submit to the provincial-level People's Committee for approval of the Scheme to support people with meritorious services with housing within the entire province, clearly stating the number of individuals eligible for support, divided by support levels, the responsibilities of related agencies in implementation, and the estimated capital from various sources for implementation.
+ In the Scheme to support people with meritorious services with housing in the province, the number, level of financial aid for individuals with meritorious services to be implemented in 2013 and the quantity to be implemented after 2013 (if any) should be clearly defined.
- Step 5: After the approval of the Scheme to support people with meritorious services with housing, the provincial-level People's Committee sends the proposal and report (using the form in Appendix IV attached to Circular 09/2013/TT-BXD) to the Ministry of Construction, Ministry of Planning and Investment, and Ministry of Finance for summarization, reporting to the Prime Minister for consideration and decision on allocation of support funds from the central budget.
