Basis for Offshore Construction Design Can Receive Certification Results Through Online Public Service System from the Registration Authority?
According to current regulations, what are the procedures to obtain the Certificate of Design Appraisal for offshore structures?
According to Article 5 of Circular 33/2011/TT-BGTVT stipulating the procedures for obtaining the Certificate of Design Appraisal for offshore structures as follows:
"Article 5. Procedures for obtaining the Certificate of Design Appraisal for offshore structures
1. Implementation sequence
a) The design facility completes the design dossier as prescribed and submits the design dossier to the Registration Authority;
b) The Registration Authority accepts the design dossier, checks the composition of the design dossier: if the design dossier is not complete as prescribed, a written response guiding the design facility to complete it should be given; if the design dossier meets the prescribed components, a receipt with an appointment to provide the result should be issued.
c) The Registration Authority conducts the design appraisal: if the design dossier does not meet the requirements, a written response will be sent to the design facility to supplement and amend; if the design dossier meets the requirements, the Certificate of Design Appraisal will be issued according to the form in Appendix IV issued with this Circular.
2. Method of implementation:
a) The design facility submits the dossier directly at the Registration Authority or via the postal system or via Fax, Email.
b) The design facility receives the result through the postal system or directly at the Registration Authority.
3. Regulations on the design dossier
a) Component of the dossier includes: 01 application for design appraisal according to the form in Appendix III issued with this Circular (original or copy); 03 design documents for offshore structures (original or copy).
The volume and content of the design documents for offshore structures are detailed in the standards, technical regulations, and applicable international conventions for each type of offshore structures stated in Appendix I issued with this Circular, and must be presented according to current regulations.
b) Number of dossiers: 01 set.
4. Processing time
The time for design appraisal and issuance of the Certificate or notification that the design dossier does not meet the requirements is no later than 20 working days from the date of receiving the complete dossier as prescribed. In case of new or complex offshore structure design where the appraisal time needs to be extended, the Registration Authority conducting the design appraisal will agree with the design facility.
5. Administrative procedure implementation agency: Registration Authority.
6. Result of administrative procedure implementation
The result of administrative procedure implementation is the design document being appraised and the Certificate of Design Appraisal.
7. Requirement, conditions for design appraisal
The design dossier for offshore structures must meet the requirements of standards, technical regulations of Vietnam, and relevant international conventions that Vietnam is a member of, concerning technical safety and environmental protection for each type of offshore structures specified in Appendix I issued with this Circular.
8. Fees and charges
The level of fees and charges according to the regulations of the Ministry of Finance, paid directly or transferred to the agency issuing the Certificate."

According to Clause 1, Article 3 of Circular 16/2022/TT-BGTVT, the regulation is as follows:
"Article 3. Amendment and supplementation of some articles of Circular 33/2011/TT-BGTVT dated April 19, 2011, of the Minister of Transport stipulating the procedures for issuing the Certificate of Technical Safety and Environmental Protection for vehicles, equipment exploring, exploiting, and transporting petroleum at sea (hereinafter referred to as Circular 33/2011/TT-BGTVT)
1. Amend and supplement Clause 2, Article 5 as follows:
“2. Method of implementation
a) The design facility submits the dossier directly or via the postal system or via the online public service system or other appropriate methods to the Registration Authority.
b) The design facility receives the result directly or via the postal system or via the online public service system or other appropriate methods at the Registration Authority.”

“3. Regulations on the design dossier: 01 set of dossier includes:
a) In case the design facility submits directly or via the postal system or via other appropriate methods: 01 copy of the application for design appraisal according to the form in Appendix III issued with this Circular; 03 copies of the design documents for offshore structures;
b) In case the design facility submits via the online public service system: 01 electronic form application for design appraisal according to the form in Appendix III issued with this Circular and 01 (one) set of design documents in electronic form;
c) The volume and content of the design documents for offshore structures are detailed in the standards, technical regulations, and applicable international conventions for each type of offshore structures stated in Appendix I issued with this Circular, and must be presented according to current regulations.”
Thus, from August 15, 2022, the design facility for offshore structures can receive the results of the issuance of the Certificate of Design Appraisal for offshore structures through the online public service system from the Registration Authority.
Circular 16/2022/TT-BGTVT takes effect from August 15, 2022.
