Decision 1368/QD-KTNN on Regulations on Evaluation and Classification of the State Audit applied to whom?

Pursuant to Article 1 of the Regulations issued with Decision 1368/QD-KTNN in 2023, the scope and subjects of application are clearly stated as follows:

- The Regulations issued with Decision 1368/QD-KTNN in 2023 prescribe the principles, criteria, authorities, sequences, and procedures for annual quality evaluation and classification applied to officials from the rank of Department Director and equivalent or lower, public employees, and contract laborers as per Decree 111/2022/ND-CP.

- For officials who are the Leaders of the State Audit, the quality evaluation and classification of officials shall be conducted according to the provisions on evaluating and classifying the quality of officials by the Communist Party and the State.

What are the principles for evaluating and classifying the quality of officials, public employees, and laborers of the State Audit?

Pursuant to Article 2 of the Regulations issued with Decision 1368/QD-KTNN in 2023, the principles for evaluating and classifying the quality of officials, public employees, and laborers of the State Audit are as follows:

- Ensure objectivity, fairness, accuracy; avoid favoritism, reprisals, bias, formalities; ensure the correct authority in managing and evaluating officials and public employees.

- Evaluation and classification of quality must be based on the responsibilities and duties assigned and the results of task performance shown through specific work and products; for officials and public employees in management, it must be based on the results of task performance of the unit they lead, manage, or are responsible for; for officials and public employees participating in audit teams, it must be based on audit results in the year and the results of implementing audit conclusions and recommendations from previous years as determined in the evaluation year (if any).

The evaluation should clarify the strengths, weaknesses, shortcomings, limitations in morality, capacity, task performance results, work efficiency, level, and development prospects of officials and public employees. For officials and public employees participating in the audit in the evaluation year with audit recommendation results requiring adjustment, they shall not be classified at the level of "Excellent Completion"; depending on the nature and extent, the Head of the unit shall consider the appropriate quality classification.

- The individual rating level of a person holding a management position shall not be higher than the organization or unit directly under their charge.

- Officials, public employees who have worked for less than six months in the year shall not be subject to evaluation and classification, but still must review their work time in the year, excluding those on maternity leave according to policy.

Officials, public employees who did not participate in work according to legal regulations from 03 to less than 06 months in the year shall still be evaluated but shall not be classified at the level of "Good Completion of Tasks" or higher.

Officials, public employees on maternity leave according to legal regulations, the results of the year's quality classification shall be based on the actual working time results of that year.

- The results of evaluating and classifying the quality of officials and public employees are used as a basis for interlinking in evaluating and classifying party members' quality.

- Officials, public employees subject to party or administrative disciplinary actions shall be classified as follows:

+ Officials, public employees subject to party or administrative disciplinary action in the evaluation year shall be classified at the "Not Completed Tasks" level, except for cases stipulated at Point b, Clause 6, Article 2 of the Regulations issued with Decision 1368/QD-KTNN in 2023.

+ In case of behavior violations without a disciplinary decision from the competent authority but used as a basis for evaluating and classifying quality at the "Not Completed Tasks" level in the evaluation year, any disciplinary decision issued after the evaluation year for that behavior (if any) shall not be used to evaluate and classify quality in the year with the disciplinary decision.

+ In case officials and public employees are party members and have been subject to both party and administrative disciplinary actions for the same violation, but the party disciplinary decision and the administrative disciplinary decision do not take effect in the same evaluation year, it shall only be accounted for in one evaluation year.

- The rate of officials and public employees classified as "Excellent Completion of Tasks" in the total number of officials and public employees at the unit shall not exceed the rate of party members classified as "Excellent Completion of Tasks" as per the Communist Party regulations. In cases where the unit has outstanding achievements, exceeding assigned tasks, successfully completing spontaneous tasks, proposing or implementing innovative solutions that bring positive changes, and practical value and efficiency, the Auditor General shall decide the appropriate rate of "Excellent Completion of Tasks" in line with reality, ensuring the legitimate rights and benefits of officials and public employees.

What are the standards of ethics and lifestyle for evaluating and classifying the quality of officials, public employees of the State Audit?

Pursuant to Article 3 of the Regulations issued with Decision 1368/QD-KTNN in 2023, the standards for evaluating and classifying the quality of officials, public employees of the State Audit in terms of ethics and lifestyle are as follows:

- No embezzlement, corruption, negativity, wastefulness, bureaucracy, opportunism, self-interest, high-handedness, arbitrariness; no signs of moral decline, self-evolution, self-transformation;

- Having an honest, humble, sincere, clear, and simple lifestyle;

- Having a spirit of solidarity, building a clean, strong agency, organization, or unit;

- Not allowing relatives and acquaintances to exploit one's position and power for profit.
