Pursuant to Article 21 of the Law on People’s Public Security Force 2018, the system of ranks of the Vietnam People’s Public Security Force is as follows:

* Operation officers and non-commissioned officers:

- General officers subdivided into 04 grades:

General;

Senior Lieutenant General;

Lieutenant General;

Major General;

- Field officers subdivided into 04 grades:

Colonel;

Senior Lieutenant Colonel;

Lieutenant Colonel;

Major;

- Company officers subdivided into 04 grades:

Captain;

Senior Lieutenant Captain;

Lieutenant;

Second Lieutenant;

- Non-commissioned officers subdivided into 03 grades:

Sergeant major;

* Technical officers and non-commissioned officers:

- Field officers subdivided into 03 grades:

Vietnam: Are people's police officers a cadre or an official? Is the Head of a People’s Public Security Office a cadre or an official?

Pursuant to Clauses 1 and 2, Article 4 of the Law on Cadres and Officials 2008, a number of provisions as amended by Clause 1, Article 1 of the Law on amendments to the Law on Cadres and Civil Servants and the Law on Public Employees 2019 have also defined:

- Cadres are Vietnamese citizens who are elected, approved and appointed to hold posts or titles for a given term of office in agencies of the Communist Party of Vietnam, the State, socio-political organizations at the central level, in provinces and centrally run cities (below collectively referred to as provincial level), in districts, towns and provincial cities (below collectively referred to as district level), included in the payrolls and salaried from the state budget.

- Officials are Vietnamese citizens who are recruited and appointed to ranks, posts or titles in agencies of the Communist Party of Vietnam, the State, socio-political organizations at the central, provincial and district levels; in People’s Army agencies and units, other than officers, professional military personnel and defense workers; in People’s Police offices and units other than officers and professional non-commissioned officers, included in the payrolls and salaried from the state budget;

Thus, to identify whether a police officer is a cadre or official, the following provisions must be considered:

- If a person is elected, approved and appointed to hold post or title for a given term, he/she may be a cadre.

- If a person is recruited and appointed to rank, post or title, he/she may be an official.

Note: In case the People's Public Security Forces are officers, non-commissioned officers serving under the professional regime, public security workers are not civil servants.

Head of a People’s Public Security Office (of a rural district, urban district, town or provincial city according to the provisions of the Law on People’s Public Security Force 2018) is an official (based on Point a, Clause 3, Article 61 of the Law on Cadres and Officials 2008, as amended by Clause 13, Article 1 of the Law on amendments to the Law on Cadres and Civil Servants and the Law on Public Employees 2019).
